《中华人民共和国国籍法》 3 E* A& p1 E, Z6 `3 i3 @5 ^! C

第一条   中华人民共和国国籍的取得、丧失和恢复,都适用本法。
* y3 n% K7 ^% D8 A& v7 Y" @    第二条   中华人民共和国是统一的多民族的国家,各民族的人都具有中国国籍。- f* n2 ?0 [3 ?8 r! ~
    第三条    中华人民共和国不承认中国公民具有双重国籍。
2 ]1 p2 i: k- d( M6 e    第四条   父母双方或一方为中国公民,本人出生在中国,具有中国国籍。
; F- s8 X0 u8 e! ~3 b- n  F    第五条   父母双方或一方为中国公民,本人出生在外国,具有中国国籍;但父母双方或一方为中国公民并定居在外国,本人出生时即具有外国国籍的,不具有中国国籍。
; X" m3 K3 t2 Y5 X! |# ?: F7 u    第六条   父母无国籍或国籍不明,定居在中国,本人出生在中国,具有中国国籍。
( p7 E' i+ {! g0 M4 r+ w/ t3 M+ \% P    第七条   外国人或无国籍人,愿意遵守中国宪法和法律,并具有下列条件之一的,可以经申请批准加入中国国籍:" `) G: K7 n/ b: ~) ~. c
    一、中国人的近亲属;2 q4 R6 D0 R% B( y+ A% Z
    二、定居在中国的;- O! h: {8 ?) R/ i4 s
    三、有其它正当理由。( O4 g, {* q9 z9 o2 l0 Y( }
    第八条   申请加入中国国籍获得批准的,即取得中国国籍;被批准加入中国国籍的,不得再保留外国国籍。
+ a5 c1 f. `$ z; S    第九条    定居外国的中国公民,自愿加入或取得外国国籍的,即自动丧失中国国籍。) H, }* z5 a4 L6 y$ [; ~, c! ]. p
    第十条    中国公民具有下列条件之一的,可以经申请批准退出中国国籍:
  X7 C6 F. \* a    一、外国人的近亲属;2 ~% N& w! l% [6 B9 o6 F
    二、定居在外国的;
# j' [3 n* O- G    三、有其它正当理由。. K0 K8 Q( l2 H0 l' j. F
    第十一条    申请退出中国国籍获得批准的,即丧失中国国籍。
+ x( A5 @; f8 I, Q    第十二条   国家工作人员和现役军人,不得退出中国国籍。
$ u5 V/ C% x& J! Q( I: i    第十三条   曾有过中国国籍的外国人,具有正当理由,可以申请恢复中国国籍;被批准恢复中国国籍的,不得再保留外国国籍。$ d  g1 p! p, r: J9 b
    第十四条   中国国籍的取得、丧失和恢复,除第九条规定的以外,必须办理申请手续。未满十八周岁的人,可由其父母或其他法定代理人代为办理申请。! J+ ~! `5 _, S/ d2 h
    第十五条    受理国籍申请的机关,在国内为当地市、县公安局,在国外为中国外交代表机关和领事机关。0 v; A6 w) c. T+ P$ p
    第十六条   加入、退出和恢复中国国籍的申请,由中华人民共和国公安部审批。经批准的,由公安部发给证书。
$ n4 ]! n, R$ c    第十七条   本法公布前,已经取得中国国籍的或已经丧失中国国籍的,继续有效。
# S& G' o" G7 W- E, |    第十八条   本法自公布之日起施行。% y. N' p7 N% ]$ X- w+ Q

Article 18 ?. O) D  n- R2 m" U5 T, P
This Law is  applicable  to  the  acquisition,  loss  and  restoration  of
$ y1 x! ]5 z/ ~" i4 f' q8 W. Mnationality of the People''s Republic of China.
6 S+ q( v5 {% q1 L7 s4 |5 ^& LArticle 2  p/ E- W/ V5 i$ U: g, b# f4 f8 J
The People''s Republic of China is a unitary multinational  state;  persons
7 W( U. D' I6 ~2 cbelonging to  any  of  the  nationalities  in  China  shall  have  Chinese0 K% E( f# w( o5 K* ]1 k$ W" G
nationality.7 z7 w8 M' g% S* o+ c
Article 3
  b% B$ K) ^7 U$ ^8 Y, qThe People''s Republic of China does not recognize dual nationality for any$ z4 M, w: k8 a5 B  V" T6 t
Chinese national.  v. ]5 _, m# r$ V- c& E/ v6 D
Article 4
2 I8 F9 S7 o( Y1 k, @/ Y: g; t$ {Any person born in China whose parents are both Chinese nationals  or  one3 O9 a% d' P7 ^2 q1 O( e, ?
of whose parents is a Chinese national shall have Chinese nationality.% o. a& M8 `4 [
Article 5, ^( |! W+ o: u$ A% W, E
Any person born abroad whose parents are both Chinese nationals or one  of: `8 A* J# H, _% p1 d" \0 c+ P& s
whose parents is a Chinese national shall have Chinese nationality. But  a  d3 H- `/ h; N$ ^% g3 C) E
person whose parents are both Chinese  nationals  and  have  both  settled
1 n" }) [" w: m! w) Oabroad, or one of whose parents is a  Chinese  national  and  has  settled
9 j9 \; ~% E. s  W* r* J3 H; O3 sabroad, and who has acquired foreign nationality at birth shall  not  have
# V3 J2 e) N# A+ V: D' V; hChinese nationality.! [5 C# R) N# P5 M
Article 6& q) R2 j" ]# h5 j. P' u
Any person born in China whose  parents  are  stateless  or  of  uncertain
5 _, H7 v0 [, m3 g/ ]7 n! a5 d- Ynationality and have settled in China shall have Chinese nationality.5 t: i2 v6 \5 z" X
Article 7/ G6 j; G( o6 L, E' I+ P4 T. M
Foreign nationals or stateless persons who are willing to abide by China''s% y) Z- M: i1 W$ `, k4 r1 D  I
Constitution and laws and who meet one of the following conditions may  be
$ [1 g& @  C! Y) B6 G- v3 b4 Dnaturalized upon approval of their applications:
; F' d3 T" |( @' v, G(1) they are near relatives of Chinese nationals;
9 F$ m4 h6 R5 m* p$ K( G3 u(2) they have settled in China; or/ C2 {' x6 c! _( C) F& n
(3) they have other legitimate reasons.
2 v6 R: a) Q+ C& H) ^Article 8
2 k2 m4 _- w' ~Any person who applies for naturalization  as  a  Chinese  national  shall& D8 Y5 e) l+ k- l
acquire Chinese nationality upon approval of  his  application;  a  person
, T4 b/ P3 v, x+ v- \2 v" Awhose application for  naturalization  as  a  Chinese  national  has  been
9 g6 @( L( s7 e* }) u% r, ?approved shall not retain foreign nationality.& e4 c1 W3 V* V0 J- h
Article 9  F4 W* J& Q2 O
Any Chinese national who has settled abroad and who has  been  naturalized# ?7 Z8 R9 \8 b1 I
as a foreign national or has acquired foreign nationality of his own  free
4 M' R* w! i% P5 `; z7 O$ X! pwill shall automatically lose Chinese nationality.! M* p" {! d9 F
Article 10" q$ F$ I) O& z: X! T
Chinese nationals who meet one of the following  conditions  may  renounce
) b) y% K2 I" w9 n% r) X' I0 [( n$ UChinese nationality upon approval of their applications:
9 \; P; r9 S3 m9 T& p5 a; r) f' C* K(1) they are near relatives of foreign nationals;
4 H# O' \$ S3 w! g(2) they have settled abroad; or
, i3 g2 b' u& [2 O. z! K& q(3) they have other legitimate reasons.6 q6 ]2 H9 q+ V8 W4 b' y
Article 11
, H) {3 W, \( O+ sAny person who applies for renunciation of Chinese nationality shall  lose( L& O: ?& L8 F8 @8 w! S
Chinese nationality upon approval of his application.
$ M5 {& e1 L% @Article 12
6 G% s# t3 p6 G  H- }+ H$ gState functionaries and military personnel on  active  service  shall  not: g- \8 ^1 t* ~0 y* `! ^
renounce Chinese nationality.
. i% y" J3 ~9 RArticle 13
' L% v0 `: L1 _. kForeign  nationals  who  once  held  Chinese  nationality  may  apply  for
* ?$ x( j7 O6 j" urestoration of Chinese nationality if they have legitimate reasons;  those% W) V- ]1 F: ~- I" {
whose applications  for  restoration  of  Chinese  nationality  have  been
7 h2 D' v4 E# N( R0 Oapproved shall not retain foreign nationality.
, U1 ?% Z3 O. @5 ~. BArticle 14* u5 X% }3 O  `: ~* E5 w7 B
Persons who wish to acquire, renounce or restore Chinese nationality, with/ L0 N5 T& R& Z% c1 G" t
the exception of the cases provided for in Article 9, shall go through the
% a& x/ J2 @! L; Lformalities of application.  Applications of persons under the age  of  18
: P% }) K, |7 D* u0 U+ Rmay  be  filed  on  their  behalf  by  their  parents   or   other   legal( T9 D, ]; O- ~& N5 E" ~7 j
representatives.
2 x" {" k0 i! j0 ~8 `( P4 b  {0 jArticle 154 W4 |+ E! `8 Z7 g2 D7 W1 M, D
Nationality applications at home shall be handled by the  public  security1 f/ A& U) t1 m8 d6 C
bureaus of the municipalities or counties where the applicants reside;- N2 B1 N4 ^. }7 s) j1 E' i
nationality applications abroad shall be  handled  by  China''s  diplomatic* g" K  b) Y& v. S( C; [" g" y2 `
representative agencies and consular offices.
' \( p/ I( t4 D# |$ v: v5 a7 c  Q& eArticle 16
5 C  Z7 p2 g, aApplications for naturalization as Chinese nationals and for  renunciation
1 K% U1 T; o2 o7 j9 q# L1 Y5 i9 Cor restoration of Chinese  nationality  are  subject  to  examination  and
, S2 {& v4 K0 w9 E$ v: iapproval by the Ministry of Public Security of the  People''s  Republic  of' ]3 g% J6 S+ p( M
China. The Ministry of Public Security shall issue a  certificate  to  any7 z, s; E0 a& {. O* v+ }
person whose application has been approved.: g  b( L4 `* s& T4 y
Article 17. n3 J* W% S9 |, j$ v5 D% \. S+ T
The nationality status of  persons  who  have  acquired  or  lost  Chinese
+ L& M+ F1 E, Fnationality before the promulgation of this Law shall remain valid.
* z$ Q* {) d+ B! g2 bArticle 18
  m2 h/ h, h. a4 @  e/ \- KThis Law shall come into force on the day of its promulgation.
