5 N) N: Q9 V' b 第一条   中华人民共和国国籍的取得、丧失和恢复,都适用本法。! d* s& f6 ^. [) q8 H4 \  g
    第二条   中华人民共和国是统一的多民族的国家,各民族的人都具有中国国籍。, ]& Z- S' }6 _
    第三条    中华人民共和国不承认中国公民具有双重国籍。
- F: T' ]9 t  q# V' U    第四条   父母双方或一方为中国公民,本人出生在中国,具有中国国籍。3 Y/ M! j0 g8 }1 [7 |1 T
    第五条   父母双方或一方为中国公民,本人出生在外国,具有中国国籍;但父母双方或一方为中国公民并定居在外国,本人出生时即具有外国国籍的,不具有中国国籍。( w. c. {. J0 w* f- Y
    第六条   父母无国籍或国籍不明,定居在中国,本人出生在中国,具有中国国籍。- ]% k# p1 t; m
    第七条   外国人或无国籍人,愿意遵守中国宪法和法律,并具有下列条件之一的,可以经申请批准加入中国国籍:. O5 Q- {: N- r1 b' r
    一、中国人的近亲属;4 ^/ }# X3 |- G$ W& F4 X# O
    二、定居在中国的;
6 \7 B5 @- r# I8 l+ k1 e    三、有其它正当理由。
2 u0 Q- v: i" W    第八条   申请加入中国国籍获得批准的,即取得中国国籍;被批准加入中国国籍的,不得再保留外国国籍。  h' C* W4 x  ^
    第九条    定居外国的中国公民,自愿加入或取得外国国籍的,即自动丧失中国国籍。1 w' ^3 r+ E# |# N. P& L5 m
    第十条    中国公民具有下列条件之一的,可以经申请批准退出中国国籍:' m" D4 ~1 [4 y" Z+ n4 D* M! o
    一、外国人的近亲属;! r1 ~2 c* _/ L! K$ n9 N4 p0 f
    二、定居在外国的;
! K* e2 a) e, n$ d+ ~' q    三、有其它正当理由。
; t. [6 E6 T5 p$ u2 F! O    第十一条    申请退出中国国籍获得批准的,即丧失中国国籍。
- g( S/ d5 g5 C    第十二条   国家工作人员和现役军人,不得退出中国国籍。) O5 T* U6 R, D! I
    第十三条   曾有过中国国籍的外国人,具有正当理由,可以申请恢复中国国籍;被批准恢复中国国籍的,不得再保留外国国籍。& Q! D1 V/ S6 w5 X$ E
    第十四条   中国国籍的取得、丧失和恢复,除第九条规定的以外,必须办理申请手续。未满十八周岁的人,可由其父母或其他法定代理人代为办理申请。! v- C* b2 E- z9 H3 i
    第十五条    受理国籍申请的机关,在国内为当地市、县公安局,在国外为中国外交代表机关和领事机关。
0 n5 J. Z  V' ^    第十六条   加入、退出和恢复中国国籍的申请,由中华人民共和国公安部审批。经批准的,由公安部发给证书。% G: d4 h: i* S6 p/ _; g  [8 M
    第十七条   本法公布前,已经取得中国国籍的或已经丧失中国国籍的,继续有效。6 d6 d. H$ J$ n: {; R2 X) n
    第十八条   本法自公布之日起施行。

Committee of the  National  People''s  Congress  on  and  effective  as  of1 Z- ]7 w) D# G4 O( S

Article 1
1 p5 \$ C' v1 ~, QThis Law is  applicable  to  the  acquisition,  loss  and  restoration  of
1 b9 X. p: ~' v  F2 p* \1 D  mnationality of the People''s Republic of China.
7 _% u% @) g8 ^" \6 ZArticle 2! Y4 k; [" B. S7 c( `
The People''s Republic of China is a unitary multinational  state;  persons! b) M7 s4 a2 g* J& H$ Q9 n: V
belonging to  any  of  the  nationalities  in  China  shall  have  Chinese
5 B  ~- G9 t; L8 V: \7 T5 @nationality.& b1 [! ~; ]& \$ e% }
Article 3
; u/ \4 V0 Q5 N/ `0 ^' s" N4 @The People''s Republic of China does not recognize dual nationality for any
' ^- K( L: ~/ A6 W6 qChinese national., Q5 i1 |7 D9 B( @
Article 4' [' y! k! P* n$ G5 A) d
Any person born in China whose parents are both Chinese nationals  or  one6 E  y( H' T& g. I6 W
of whose parents is a Chinese national shall have Chinese nationality.
6 T% P0 N, ^4 [  pArticle 5, b0 B* k! H/ t9 O
Any person born abroad whose parents are both Chinese nationals or one  of
5 O1 ~+ b9 {& ?. rwhose parents is a Chinese national shall have Chinese nationality. But  a
/ M6 A7 z# w9 z4 f, tperson whose parents are both Chinese  nationals  and  have  both  settled- c1 R" P9 U& w3 @$ }0 v2 h" |
abroad, or one of whose parents is a  Chinese  national  and  has  settled; ^6 _0 T2 K. z: s. y7 B. V
abroad, and who has acquired foreign nationality at birth shall  not  have
. p  F7 W: ?0 d! i2 C7 n+ EChinese nationality.# k! e& l% i  h6 u/ u2 F
Article 6% e' F& Y5 f$ u
Any person born in China whose  parents  are  stateless  or  of  uncertain
, y8 B* _2 q8 ?nationality and have settled in China shall have Chinese nationality.
* ?# B$ ?# D9 s' P! A1 W- PArticle 7
" B$ T8 a/ p5 ]! @Foreign nationals or stateless persons who are willing to abide by China''s" O2 a+ ~& T6 V4 r& Y, x# @
Constitution and laws and who meet one of the following conditions may  be: R1 m3 m9 q) a6 _& m* m& z
naturalized upon approval of their applications:
9 j8 U, T2 Y2 L9 m5 X" Z(1) they are near relatives of Chinese nationals;
' n2 |2 a( y! c" r$ ?, e2 V(2) they have settled in China; or2 Y$ E7 a3 r: ^% m; ]4 k) x3 u" k
(3) they have other legitimate reasons.
/ B9 g( \0 H: j& V+ w; F2 oArticle 8) F' g0 Q) K8 J0 d* e% o
Any person who applies for naturalization  as  a  Chinese  national  shall( H' o9 j* d6 H% |# U4 u% n
acquire Chinese nationality upon approval of  his  application;  a  person
+ H8 T' i) E( l3 O% @whose application for  naturalization  as  a  Chinese  national  has  been
  _/ S+ t" r# }* e* Gapproved shall not retain foreign nationality.
6 x# y2 |- M" `0 z% o: [: ]9 A6 TArticle 92 l7 G# o$ N! ~  E2 n
Any Chinese national who has settled abroad and who has  been  naturalized
7 r! c& k. f/ r" ^+ M  Aas a foreign national or has acquired foreign nationality of his own  free3 y( r9 c1 }+ G- q  p# E
will shall automatically lose Chinese nationality.; |% A" ]! |, A+ F+ T
Article 10+ ]4 U) Y0 `9 C
Chinese nationals who meet one of the following  conditions  may  renounce
9 B* L) Y+ t3 K2 MChinese nationality upon approval of their applications:& O1 G# U! z' M; f* l' ^
(1) they are near relatives of foreign nationals;
8 f# J& l: J  e8 G8 n(2) they have settled abroad; or
& [' s' K8 E: a* j* D(3) they have other legitimate reasons.
7 C( b8 }8 Z* Z( H9 |Article 11
5 K/ Z' X. N1 ~2 i6 m8 i  OAny person who applies for renunciation of Chinese nationality shall  lose
6 X8 f5 e4 r' Y9 F- w# t" }- UChinese nationality upon approval of his application.
- o: P! }$ P* kArticle 12
/ h3 M. l1 l! N) ]7 b" VState functionaries and military personnel on  active  service  shall  not: f$ w7 d: l: N- Z- r, m: @9 C
renounce Chinese nationality.
# [8 g; K$ k/ B% ?! M1 EArticle 13. G$ g4 y! O3 V% `" a" t
Foreign  nationals  who  once  held  Chinese  nationality  may  apply  for
4 @9 r, p6 w, _& Z, K- m: C9 T6 V" urestoration of Chinese nationality if they have legitimate reasons;  those
- n: |+ I7 I: `0 J0 U% Iwhose applications  for  restoration  of  Chinese  nationality  have  been2 [  a5 x2 d& v
approved shall not retain foreign nationality.5 D+ r+ e' o. O- u  n  q
Article 144 x, }/ R3 ?7 @3 S" i' Z; R% ?( E2 Y
Persons who wish to acquire, renounce or restore Chinese nationality, with
/ k& F% X7 @1 K8 y- ethe exception of the cases provided for in Article 9, shall go through the
% O( {5 h: _- J9 b7 D2 f# }6 A8 cformalities of application.  Applications of persons under the age  of  18
/ W# p' N5 K9 b5 N7 U  S) r! G; kmay  be  filed  on  their  behalf  by  their  parents   or   other   legal8 P# _) f: j3 T
representatives.
; {1 Z9 N% X/ h& lArticle 15
1 R  D8 s: o4 W; C* jNationality applications at home shall be handled by the  public  security* b9 h9 E; s: D
bureaus of the municipalities or counties where the applicants reside;
3 g9 u# f, R- H5 [$ snationality applications abroad shall be  handled  by  China''s  diplomatic
4 h; [; F, h3 s. Nrepresentative agencies and consular offices.
' K# t; R9 P6 q4 ~Article 16( V' ^: e) U9 T! r. q
Applications for naturalization as Chinese nationals and for  renunciation( P2 Y* Z3 ~! v5 I) l- y
or restoration of Chinese  nationality  are  subject  to  examination  and" Y" i2 {# W' z
approval by the Ministry of Public Security of the  People''s  Republic  of
: z( `6 r/ M% S# I/ G2 XChina. The Ministry of Public Security shall issue a  certificate  to  any' R. H7 O9 w3 T9 O& G  Y8 e
person whose application has been approved.$ U: ^- j9 ?/ Y. O' [, F8 Y
Article 172 s7 s# r5 ^7 ~( U
The nationality status of  persons  who  have  acquired  or  lost  Chinese( o; j8 f% e8 u
nationality before the promulgation of this Law shall remain valid.) f+ h! Y3 s' x! p: @5 L
Article 186 K) Z# h: x; z4 v0 ]0 a8 o) G+ C
This Law shall come into force on the day of its promulgation.
