0 e, O. P; K8 I1 x' ? 第一条 中华人民共和国国籍的取得、丧失和恢复,都适用本法。3 R* ~, K2 f3 q2 [" T5 a- V0 v
第二条 中华人民共和国是统一的多民族的国家,各民族的人都具有中国国籍。
$ \# C" Q" A5 w, s6 x! M1 _. d 第三条 中华人民共和国不承认中国公民具有双重国籍。- o) z% u; C) K+ q0 H1 l8 Z
第四条 父母双方或一方为中国公民,本人出生在中国,具有中国国籍。
+ v4 @& o. i# v4 x: a! Q" Y 第五条 父母双方或一方为中国公民,本人出生在外国,具有中国国籍;但父母双方或一方为中国公民并定居在外国,本人出生时即具有外国国籍的,不具有中国国籍。
' R0 T1 C, M% ]; L) d; w 第六条 父母无国籍或国籍不明,定居在中国,本人出生在中国,具有中国国籍。2 b' `5 r1 ^* |
第七条 外国人或无国籍人,愿意遵守中国宪法和法律,并具有下列条件之一的,可以经申请批准加入中国国籍:

二、定居在中国的;
) ]/ g" Q* W7 Y! J 三、有其它正当理由。
/ O. S# q, t8 r/ O7 p 第八条 申请加入中国国籍获得批准的,即取得中国国籍;被批准加入中国国籍的,不得再保留外国国籍。& ?3 K' T! d1 C, ]3 p1 C# F
第九条 定居外国的中国公民,自愿加入或取得外国国籍的,即自动丧失中国国籍。0 p$ N- U( G" P9 K! k8 ?
第十条 中国公民具有下列条件之一的,可以经申请批准退出中国国籍:
% a$ D$ t0 l# y `6 F# e/ I+ D 一、外国人的近亲属; @( A O+ d( g( X
二、定居在外国的;' U0 e8 t- N+ I2 _0 d
三、有其它正当理由。& q* W: H- O; \; ^) X
第十一条 申请退出中国国籍获得批准的,即丧失中国国籍。
* j! C+ y: L! H4 r! E 第十二条 国家工作人员和现役军人,不得退出中国国籍。
+ V3 ?1 B$ R+ w s 第十三条 曾有过中国国籍的外国人,具有正当理由,可以申请恢复中国国籍;被批准恢复中国国籍的,不得再保留外国国籍。9 T5 U. d; ?5 Q! _3 V( b \. n3 k1 Q6 a
第十四条 中国国籍的取得、丧失和恢复,除第九条规定的以外,必须办理申请手续。未满十八周岁的人,可由其父母或其他法定代理人代为办理申请。
}- ^5 ?4 u$ P+ o9 ]; U% B1 |. n3 b 第十五条 受理国籍申请的机关,在国内为当地市、县公安局,在国外为中国外交代表机关和领事机关。
9 ]% W+ w( M, G, G: v. v' ` 第十六条 加入、退出和恢复中国国籍的申请,由中华人民共和国公安部审批。经批准的,由公安部发给证书。

Article 2

of whose parents is a Chinese national shall have Chinese nationality.

Any person born abroad whose parents are both Chinese nationals or one of
3 n X+ s" r$ b3 Uwhose parents is a Chinese national shall have Chinese nationality. But a

abroad, or one of whose parents is a Chinese national and has settled3 M8 Q7 N5 x/ U5 Y

Chinese nationality.

nationality and have settled in China shall have Chinese nationality.: f0 t' h# e0 q7 N

Foreign nationals or stateless persons who are willing to abide by China''s
8 {7 e3 ]3 p3 B! ]8 uConstitution and laws and who meet one of the following conditions may be, P- a" B2 {2 t* \! |- p1 |
naturalized upon approval of their applications:" n. f( l$ k3 p, ?
(1) they are near relatives of Chinese nationals;
9 N; P1 P) `) c2 x. R& y7 O# P(2) they have settled in China; or
+ ^' ~& K- M1 f1 W; Z(3) they have other legitimate reasons.

Any person who applies for naturalization as a Chinese national shall
0 R3 k1 U, t, x' Yacquire Chinese nationality upon approval of his application; a person" e" u" R- E9 \
whose application for naturalization as a Chinese national has been* h9 t% Z# p) @' r( l
approved shall not retain foreign nationality.0 b+ J0 W, r$ F' Y1 K6 r1 t; G
Article 9; b( i! Q" r, E! Q% |2 ]1 @
Any Chinese national who has settled abroad and who has been naturalized
& H# g l4 ]2 h' uas a foreign national or has acquired foreign nationality of his own free
- R* z" ]; s1 A' }; awill shall automatically lose Chinese nationality.9 U3 ~. e8 L% h0 S7 `
Article 10/ \' ?+ u m& e* @- k
Chinese nationals who meet one of the following conditions may renounce: S \; I2 }# R5 A8 J, R! C$ N
Chinese nationality upon approval of their applications:
8 {5 H, ^4 |$ S5 m" B( Y7 {/ P3 K(1) they are near relatives of foreign nationals;, \ H# n/ ~" q ^1 s7 t9 t& V7 K
(2) they have settled abroad; or
8 O' H9 `% l3 P5 C(3) they have other legitimate reasons.5 }! v: m0 L9 e5 K
Article 11
V0 ] z! o- x2 s) x) v. wAny person who applies for renunciation of Chinese nationality shall lose: X7 l$ c1 Z- i/ a0 f
Chinese nationality upon approval of his application.

State functionaries and military personnel on active service shall not
" a, G# I. ^# Erenounce Chinese nationality.

Foreign nationals who once held Chinese nationality may apply for" B( b2 P% r i; |2 m: f2 d
restoration of Chinese nationality if they have legitimate reasons; those' ]4 ~9 n. M& R1 `, x, f3 |
whose applications for restoration of Chinese nationality have been
4 N3 K* j0 Q/ [$ b- [% sapproved shall not retain foreign nationality.

Persons who wish to acquire, renounce or restore Chinese nationality, with$ [: M5 b8 \# ^
the exception of the cases provided for in Article 9, shall go through the# r2 B: k; N% A. _/ u7 B" A6 B6 b
formalities of application. Applications of persons under the age of 18
$ j& a' `" i% a5 j/ u: i( f" Nmay be filed on their behalf by their parents or other legal- B4 T2 h, X( }2 ?3 t: h
representatives.! n( _) Q7 S+ H, A4 N) Q+ R
Article 15) K. Y" \! L: s1 I, f
Nationality applications at home shall be handled by the public security
: d: Y/ u$ `- @0 abureaus of the municipalities or counties where the applicants reside;3 B# c+ n u* F5 I8 W( g7 @; ]
nationality applications abroad shall be handled by China''s diplomatic" P+ P& H3 H5 W, z' G
representative agencies and consular offices.! K6 R% B) } N* Q7 [7 o, E7 M
Article 16
. {. W' `4 k5 `0 C- @) ~Applications for naturalization as Chinese nationals and for renunciation
# R# L* j& Z9 ror restoration of Chinese nationality are subject to examination and$ S( f. ?, J- N# ^- ^
approval by the Ministry of Public Security of the People''s Republic of# |9 x- v: l6 T% D4 w7 {
China. The Ministry of Public Security shall issue a certificate to any
$ T3 B% j. s" c; Cperson whose application has been approved.* |$ n$ {0 J, m6 b! d
Article 17/ i' v: e7 b3 l( C! Q5 G8 p
The nationality status of persons who have acquired or lost Chinese
$ ^6 k+ K( n. G% B5 j5 _& W: R; wnationality before the promulgation of this Law shall remain valid.
