/ b( L: k+ ?7 b3 D" d3 _ 第一条 中华人民共和国国籍的取得、丧失和恢复,都适用本法。
9 w2 G7 w+ r% E: c& n* r, [ 第二条 中华人民共和国是统一的多民族的国家,各民族的人都具有中国国籍。
' L! y5 w( `0 t2 T4 Z 第三条 中华人民共和国不承认中国公民具有双重国籍。
# j9 X2 \: _) v+ K3 n! s9 ? 第四条 父母双方或一方为中国公民,本人出生在中国,具有中国国籍。
% h2 j7 z9 Z5 Z4 S! ]$ ^- y" j$ R 第五条 父母双方或一方为中国公民,本人出生在外国,具有中国国籍;但父母双方或一方为中国公民并定居在外国,本人出生时即具有外国国籍的,不具有中国国籍。
$ @* M r5 B/ c 第六条 父母无国籍或国籍不明,定居在中国,本人出生在中国,具有中国国籍。7 {" e6 ]7 D8 v T" q8 G1 B
第七条 外国人或无国籍人,愿意遵守中国宪法和法律,并具有下列条件之一的,可以经申请批准加入中国国籍:

二、定居在中国的;

第八条 申请加入中国国籍获得批准的,即取得中国国籍;被批准加入中国国籍的,不得再保留外国国籍。: h' s& }* i. ^ `" {1 ]
第九条 定居外国的中国公民,自愿加入或取得外国国籍的,即自动丧失中国国籍。2 K% e' G: q4 L; i( y8 M( _0 b
第十条 中国公民具有下列条件之一的,可以经申请批准退出中国国籍:

二、定居在外国的;

第十一条 申请退出中国国籍获得批准的,即丧失中国国籍。
D0 ^. M, t2 i8 Q- R* P9 g 第十二条 国家工作人员和现役军人,不得退出中国国籍。
, x* N& X8 a6 _ 第十三条 曾有过中国国籍的外国人,具有正当理由,可以申请恢复中国国籍;被批准恢复中国国籍的,不得再保留外国国籍。/ G/ X8 V" w# }9 Q$ S0 H
第十四条 中国国籍的取得、丧失和恢复,除第九条规定的以外,必须办理申请手续。未满十八周岁的人,可由其父母或其他法定代理人代为办理申请。
6 s; Q# ]1 ^2 { 第十五条 受理国籍申请的机关,在国内为当地市、县公安局,在国外为中国外交代表机关和领事机关。
+ D% s: n6 n3 h( x& q+ K5 y 第十六条 加入、退出和恢复中国国籍的申请,由中华人民共和国公安部审批。经批准的,由公安部发给证书。$ w$ V# P2 {7 p% N x L" A
第十七条 本法公布前,已经取得中国国籍的或已经丧失中国国籍的,继续有效。

Article 1
# n" b& |' r: p! g4 {( MThis Law is applicable to the acquisition, loss and restoration of/ A5 h4 A) R A# D
nationality of the People''s Republic of China.: l$ y( l7 M! }

The People''s Republic of China is a unitary multinational state; persons
4 ]. @( ~6 y- V9 hbelonging to any of the nationalities in China shall have Chinese; y: K i+ F. y+ x5 F

Article 3
+ `! w8 E# h% s( [The People''s Republic of China does not recognize dual nationality for any
, C2 S) ~/ O, U, r+ K& ~Chinese national.

7 d/ e5 y2 E2 d# z0 a! z' P$ ?Any person born in China whose parents are both Chinese nationals or one; V9 S6 ]* ?8 c4 |( m$ k3 p
of whose parents is a Chinese national shall have Chinese nationality.2 O) b( B+ B4 q$ v5 r

Any person born abroad whose parents are both Chinese nationals or one of3 R9 b( T+ v* N: I6 u5 f% w
whose parents is a Chinese national shall have Chinese nationality. But a& a3 D5 Q. U& Y
person whose parents are both Chinese nationals and have both settled
3 W/ A) w. x8 Y( R9 l/ Nabroad, or one of whose parents is a Chinese national and has settled2 v2 I* z; W8 }
abroad, and who has acquired foreign nationality at birth shall not have! m( T! H# H1 a9 K- C) ]/ `) O
Chinese nationality.( d7 O0 F& h* f
Article 6
1 E! r6 h8 e% D$ X4 tAny person born in China whose parents are stateless or of uncertain) }% Q* P/ x/ L+ `
nationality and have settled in China shall have Chinese nationality.6 R: N- q x$ `
Article 7
: j* E N: s+ vForeign nationals or stateless persons who are willing to abide by China''s
* J2 K) c+ F" t( ^Constitution and laws and who meet one of the following conditions may be
3 P5 D$ w8 M: D- M! U$ `; e5 {- \naturalized upon approval of their applications:2 v+ h+ |) [( y4 U: c0 _3 P
(1) they are near relatives of Chinese nationals;, R3 i' f# }) _9 _
(2) they have settled in China; or8 { R$ F5 C0 V* B6 ?/ y$ H
(3) they have other legitimate reasons.

Any person who applies for naturalization as a Chinese national shall0 D+ e7 e1 R( n/ t: c
acquire Chinese nationality upon approval of his application; a person2 t# ~8 @, s4 e6 X% n
whose application for naturalization as a Chinese national has been
, U" G" C$ {( p" P8 kapproved shall not retain foreign nationality.

Any Chinese national who has settled abroad and who has been naturalized% B4 u' d7 q" |/ G( ?; _) G- c
as a foreign national or has acquired foreign nationality of his own free
5 }% s3 G# ]6 }2 B9 h4 G7 N1 hwill shall automatically lose Chinese nationality.- Y. ~; v. ^ `/ S5 Y
Article 10" F' p6 j* R: c) |, q
Chinese nationals who meet one of the following conditions may renounce
# _5 D; @9 ], z' ?0 }2 zChinese nationality upon approval of their applications:
( W% |) [8 l* Q d/ L$ [0 T, F(1) they are near relatives of foreign nationals;3 r5 t s6 }2 E& r( i# i! q
(2) they have settled abroad; or
0 d6 G$ H1 X, A, b" |7 E' A(3) they have other legitimate reasons.

Any person who applies for renunciation of Chinese nationality shall lose
W' o3 _" k! E8 wChinese nationality upon approval of his application.
, c# j- j$ F7 x0 I8 n7 bArticle 122 A* o; T; z5 Y" |5 T( q3 z6 M# `) m; r
State functionaries and military personnel on active service shall not
* F. G% J) {3 {$ Orenounce Chinese nationality.2 @. A7 V& u( s3 }0 H/ A4 `+ K
Article 133 C3 K* K: H0 b$ f0 k5 ^! \
Foreign nationals who once held Chinese nationality may apply for: F/ B. r/ Q& E3 O) X
restoration of Chinese nationality if they have legitimate reasons; those
$ I% U- k& M% f. gwhose applications for restoration of Chinese nationality have been' D1 B' E8 C0 o) m* C& f( W
approved shall not retain foreign nationality.7 F, V1 J# _7 r4 e) e& {6 d
Article 14
! Y, Q# k, f! f; K) [) E/ BPersons who wish to acquire, renounce or restore Chinese nationality, with
+ ~! |/ K! D$ W* U" ~the exception of the cases provided for in Article 9, shall go through the# z6 J0 n3 e' R9 D
formalities of application. Applications of persons under the age of 181 |6 o" ]8 V" `' @, s& w$ U
may be filed on their behalf by their parents or other legal2 ?! c/ j" @8 ~' O
representatives.
9 z$ v: C% h+ A: m O# [ U4 FArticle 15
8 g* N% X, }& ]9 _" cNationality applications at home shall be handled by the public security: n5 O+ s" [! }( W: N
bureaus of the municipalities or counties where the applicants reside;
9 D" e4 b- P- G& g" u$ _, enationality applications abroad shall be handled by China''s diplomatic+ B! @0 k7 g' C: C
representative agencies and consular offices.8 t+ M8 _) d1 ?, s
Article 161 j! h& a* N, e1 Z. O) W
Applications for naturalization as Chinese nationals and for renunciation
( g% u8 V! ]3 L7 m ~/ j Tor restoration of Chinese nationality are subject to examination and
" h( ~. o# P) x! F6 k1 a5 n5 n" lapproval by the Ministry of Public Security of the People''s Republic of5 c% x4 S& ]/ q. k0 T! n
China. The Ministry of Public Security shall issue a certificate to any) W0 J6 M% J6 Z! O2 G. p3 S
person whose application has been approved.9 p+ V* n- b, [
Article 176 l$ x1 z' j2 C$ L# j$ n) ^
The nationality status of persons who have acquired or lost Chinese* r' P7 s) U- Y/ |
nationality before the promulgation of this Law shall remain valid.

This Law shall come into force on the day of its promulgation. |
