/ u, d& h! p( t7 ~8 M1 e; p 第一条 中华人民共和国国籍的取得、丧失和恢复,都适用本法。. F+ W. E }1 T4 |- e
第二条 中华人民共和国是统一的多民族的国家,各民族的人都具有中国国籍。
5 u: m4 J" M5 g* ]: F C5 }0 Z 第三条 中华人民共和国不承认中国公民具有双重国籍。
8 H7 n _8 Y* T 第四条 父母双方或一方为中国公民,本人出生在中国,具有中国国籍。
9 c7 p1 B, F8 K8 }6 j7 } 第五条 父母双方或一方为中国公民,本人出生在外国,具有中国国籍;但父母双方或一方为中国公民并定居在外国,本人出生时即具有外国国籍的,不具有中国国籍。3 {! R) Y* S9 v" I; J" S3 s
第六条 父母无国籍或国籍不明,定居在中国,本人出生在中国,具有中国国籍。( R3 u! @4 y" k2 ], ~- V
第七条 外国人或无国籍人,愿意遵守中国宪法和法律,并具有下列条件之一的,可以经申请批准加入中国国籍:& S( u6 z/ a6 x' R, x8 j9 X
一、中国人的近亲属;5 i5 R9 T9 C; e/ C+ V/ A
二、定居在中国的;
6 r+ X& Z6 O# ^2 a 三、有其它正当理由。
& N/ `- [( i$ k, c9 d 第八条 申请加入中国国籍获得批准的,即取得中国国籍;被批准加入中国国籍的,不得再保留外国国籍。
5 Q7 O7 `! s, k7 L+ r 第九条 定居外国的中国公民,自愿加入或取得外国国籍的,即自动丧失中国国籍。
! T) Q- R6 W2 s 第十条 中国公民具有下列条件之一的,可以经申请批准退出中国国籍:
) w# e: r9 s& U2 }, r 一、外国人的近亲属;
7 ?9 ?5 U4 s! \6 y# d- r' r 二、定居在外国的;
9 p W) E0 U5 H7 |7 ~ 三、有其它正当理由。; q; [9 P; z/ b! R, g k
第十一条 申请退出中国国籍获得批准的,即丧失中国国籍。0 P( C& X! e, I1 Q/ k0 i, \
第十二条 国家工作人员和现役军人,不得退出中国国籍。' k1 u" q5 y5 w+ }3 X
第十三条 曾有过中国国籍的外国人,具有正当理由,可以申请恢复中国国籍;被批准恢复中国国籍的,不得再保留外国国籍。
5 L. B. M5 A& P: N5 f4 w& u5 U5 x 第十四条 中国国籍的取得、丧失和恢复,除第九条规定的以外,必须办理申请手续。未满十八周岁的人,可由其父母或其他法定代理人代为办理申请。, y5 u) `, c# k, i* I1 Z
第十五条 受理国籍申请的机关,在国内为当地市、县公安局,在国外为中国外交代表机关和领事机关。
. F+ R- q8 X% D7 s4 e1 D5 R, B 第十六条 加入、退出和恢复中国国籍的申请,由中华人民共和国公安部审批。经批准的,由公安部发给证书。
, M9 v5 M( D( O# f1 C 第十七条 本法公布前,已经取得中国国籍的或已经丧失中国国籍的,继续有效。

Article 1

Article 2

belonging to any of the nationalities in China shall have Chinese

0 b8 V& m' u9 J7 J$ JAny person born in China whose parents are both Chinese nationals or one
- x8 Q( R% Z( _9 W* lof whose parents is a Chinese national shall have Chinese nationality.

; I( T4 {* c3 UAny person born abroad whose parents are both Chinese nationals or one of
4 D9 g9 V/ p$ Twhose parents is a Chinese national shall have Chinese nationality. But a; i$ H: L. J2 ?9 _% K
person whose parents are both Chinese nationals and have both settled
! G: p3 [; [7 W$ k1 ?' w W' Pabroad, or one of whose parents is a Chinese national and has settled
% k1 b7 C6 d- T" ]/ L' U0 m3 kabroad, and who has acquired foreign nationality at birth shall not have

Article 6
& @0 u, R6 |: T" d; c! S8 dAny person born in China whose parents are stateless or of uncertain' e( F8 ^$ o( h8 o# L* n6 N
nationality and have settled in China shall have Chinese nationality.) |8 o" M) Q" y" `
Article 7
( ^4 ~5 G$ O5 X5 NForeign nationals or stateless persons who are willing to abide by China''s% H! H# E; f7 F9 w' z
Constitution and laws and who meet one of the following conditions may be
: s( X" `5 R2 unaturalized upon approval of their applications:
6 S5 M: c6 O: g- @0 |(1) they are near relatives of Chinese nationals;
; ?2 {- ?! N; _! |(2) they have settled in China; or# V( o3 k6 Y9 Y. S
(3) they have other legitimate reasons.

$ F$ ?% t5 V1 i, D7 a ^- ]Any person who applies for naturalization as a Chinese national shall
u0 t( f! F, y% E! M$ T0 N0 E jacquire Chinese nationality upon approval of his application; a person
1 s/ f a7 |+ n$ e6 N% @/ hwhose application for naturalization as a Chinese national has been# {) x1 F1 b# C( ^" S y! q4 K2 `
approved shall not retain foreign nationality.7 [( {7 |- ?, x4 g, f Y0 V2 ?
Article 9
( }6 g+ P; A, W: xAny Chinese national who has settled abroad and who has been naturalized
& K3 _4 i6 C% T K& ]. |as a foreign national or has acquired foreign nationality of his own free
/ K1 o: X; u; ?. J7 D( I" J3 Fwill shall automatically lose Chinese nationality.
K$ J: d) A1 P6 K* ]Article 10# \3 g0 t% @+ w8 o: m3 }
Chinese nationals who meet one of the following conditions may renounce- S' Z( Z2 z1 `3 ^9 o
Chinese nationality upon approval of their applications:
6 X3 l& _/ L1 t& t; s(1) they are near relatives of foreign nationals;8 G! |5 b, W$ m8 S2 S
(2) they have settled abroad; or( ]6 D p5 P) [ J7 m7 P2 g
(3) they have other legitimate reasons.

Any person who applies for renunciation of Chinese nationality shall lose
/ l+ F8 d3 b4 ~9 ~. g; l) U( oChinese nationality upon approval of his application.9 c' a& Y: I# X
Article 12( s8 b8 d- O+ Z: t
State functionaries and military personnel on active service shall not! h1 w5 k$ j$ j6 [+ F% o5 N
renounce Chinese nationality.
5 @9 ^4 \7 q* K" vArticle 13
* I; w0 @& D* O$ p$ ~* s: x1 VForeign nationals who once held Chinese nationality may apply for$ j/ z8 Z( n% d0 l+ I0 {
restoration of Chinese nationality if they have legitimate reasons; those
+ W; D9 A. P' M) qwhose applications for restoration of Chinese nationality have been
2 s6 r3 M R: ~+ C9 }approved shall not retain foreign nationality." A n; S x; \2 u: G% g' r
Article 14* G, X7 D, U4 t7 o- u1 |8 C
Persons who wish to acquire, renounce or restore Chinese nationality, with6 B2 k, }) i5 S- X/ D0 H0 Z
the exception of the cases provided for in Article 9, shall go through the
$ p& C+ V) p5 \formalities of application. Applications of persons under the age of 18
1 G2 k7 ^% [& n( W J: pmay be filed on their behalf by their parents or other legal
) {8 B5 \) e' {representatives.

/ A% X+ l* U! \/ Y+ u9 H) ]Nationality applications at home shall be handled by the public security
6 K5 M' v/ \2 Y5 ]) o4 {3 vbureaus of the municipalities or counties where the applicants reside;5 X; e% B9 t3 u4 m9 H. Z8 Z5 o
nationality applications abroad shall be handled by China''s diplomatic
2 x K3 F& x& }- _% r0 r( Frepresentative agencies and consular offices.
) I% Y8 B6 \# \! cArticle 16
" L2 \! S, e& w4 g1 jApplications for naturalization as Chinese nationals and for renunciation
3 r! r! d- V: L ]or restoration of Chinese nationality are subject to examination and
5 J i$ c, j: G2 c! [: E4 |7 X4 Japproval by the Ministry of Public Security of the People''s Republic of; ]7 H" z& ]# J+ ?/ Q
China. The Ministry of Public Security shall issue a certificate to any
8 a. r2 u0 V: @; w, q* operson whose application has been approved.
/ M% U4 [# f. G+ k& k! p" \Article 17# m4 O# N5 R1 p+ U+ ]
The nationality status of persons who have acquired or lost Chinese
& t$ y5 m6 l- {! q( y0 c' U% cnationality before the promulgation of this Law shall remain valid.: O3 y6 X, @6 `6 P, V
Article 18; b; T# k7 P0 H% i
This Law shall come into force on the day of its promulgation. |
