《中华人民共和国国籍法》
7 I4 x5 @( K/ @& e& Z  - X; v  B& X9 b$ o4 z8 b5 C4 l
第一条   中华人民共和国国籍的取得、丧失和恢复,都适用本法。; j9 r$ [) j; N, J  X
    第二条   中华人民共和国是统一的多民族的国家,各民族的人都具有中国国籍。
0 Q7 a# b  x9 X    第三条    中华人民共和国不承认中国公民具有双重国籍。5 p9 N  o6 Q& Q
    第四条   父母双方或一方为中国公民,本人出生在中国,具有中国国籍。. F2 U) L7 m4 @( g0 _% V) \+ S
    第五条   父母双方或一方为中国公民,本人出生在外国,具有中国国籍;但父母双方或一方为中国公民并定居在外国,本人出生时即具有外国国籍的,不具有中国国籍。
& E  |# m2 Q& E8 b    第六条   父母无国籍或国籍不明,定居在中国,本人出生在中国,具有中国国籍。9 u- L! _3 v. L) S
    第七条   外国人或无国籍人,愿意遵守中国宪法和法律,并具有下列条件之一的,可以经申请批准加入中国国籍:
, `; H# g2 \0 n& |  y    一、中国人的近亲属;7 ?9 s; Y  M& Z: W
    二、定居在中国的;' w( P3 O1 ?# T# r
    三、有其它正当理由。
. T7 L& u& ~4 `+ c6 H    第八条   申请加入中国国籍获得批准的,即取得中国国籍;被批准加入中国国籍的,不得再保留外国国籍。
9 o2 N& P6 S- s8 p+ A2 u* n    第九条    定居外国的中国公民,自愿加入或取得外国国籍的,即自动丧失中国国籍。
: D, \  ~- Q  `- x) T    第十条    中国公民具有下列条件之一的,可以经申请批准退出中国国籍:  H# c* h  h* y$ N  a
    一、外国人的近亲属;/ y$ J9 b' b, E% C0 f: F6 P, i' E
    二、定居在外国的;
; k; T) W. q! i7 \' l- N    三、有其它正当理由。# g- f$ h6 w7 j$ G" x
    第十一条    申请退出中国国籍获得批准的,即丧失中国国籍。
( \) j( ~* F7 I# A" N5 A    第十二条   国家工作人员和现役军人,不得退出中国国籍。
+ i( K7 A" ?* _& ]8 N: L" y    第十三条   曾有过中国国籍的外国人,具有正当理由,可以申请恢复中国国籍;被批准恢复中国国籍的,不得再保留外国国籍。3 J0 A! v2 q" Z/ o
    第十四条   中国国籍的取得、丧失和恢复,除第九条规定的以外,必须办理申请手续。未满十八周岁的人,可由其父母或其他法定代理人代为办理申请。/ d, f! G$ J9 R0 N
    第十五条    受理国籍申请的机关,在国内为当地市、县公安局,在国外为中国外交代表机关和领事机关。
/ t, A4 t3 H: q) k5 `$ `    第十六条   加入、退出和恢复中国国籍的申请,由中华人民共和国公安部审批。经批准的,由公安部发给证书。
5 G9 a+ j& H/ d* [    第十七条   本法公布前,已经取得中国国籍的或已经丧失中国国籍的,继续有效。/ u9 N! f/ ~& i7 A+ m4 C
    第十八条   本法自公布之日起施行。

Article 1
1 J# O# H; g! x. uThis Law is  applicable  to  the  acquisition,  loss  and  restoration  of
7 y2 }$ _+ E7 z2 i% _4 d4 v% \' |nationality of the People''s Republic of China.
, M0 H/ |" h- ^3 i2 x! K! VArticle 2
6 |/ t: u1 J3 }9 E/ _$ o1 oThe People''s Republic of China is a unitary multinational  state;  persons: F! X% J9 u# q/ l+ n' o
belonging to  any  of  the  nationalities  in  China  shall  have  Chinese
' p1 d1 O# P7 bnationality.4 D9 I+ L$ W" p6 X  }; b3 [) p2 F
Article 3- i* _$ p( M/ I% _
The People''s Republic of China does not recognize dual nationality for any- }5 H4 w8 b+ G4 I
Chinese national.. F! t) N" b; v0 p/ V5 n0 Q; B0 l
Article 41 [) ^) R& @; w- ]7 Z- B) c: v
Any person born in China whose parents are both Chinese nationals  or  one2 {. ]3 D; B2 @5 _5 v" U
of whose parents is a Chinese national shall have Chinese nationality.5 \( V( n; K) M
Article 53 I) b$ g; F  H/ v
Any person born abroad whose parents are both Chinese nationals or one  of
4 m- p- x; i7 a, H, A2 E/ o9 e  fwhose parents is a Chinese national shall have Chinese nationality. But  a" c( ^1 |* k/ G9 s1 L* n4 p/ U
person whose parents are both Chinese  nationals  and  have  both  settled5 i3 u+ a# f) e* Q7 z$ k" F
abroad, or one of whose parents is a  Chinese  national  and  has  settled
1 w# {* k, L( v8 Q+ Fabroad, and who has acquired foreign nationality at birth shall  not  have2 b- T; q  w8 n, ~8 V  g
Chinese nationality.
( M0 C7 O" f( b$ ^4 gArticle 6
7 y5 E; ~1 V& v; `0 sAny person born in China whose  parents  are  stateless  or  of  uncertain9 h" p2 U; U& X& ]( Q  ~( u
nationality and have settled in China shall have Chinese nationality.

* ~, i$ v6 Q3 p/ L7 ZForeign nationals or stateless persons who are willing to abide by China''s  v3 Z8 E" d% C* @2 f# R: r
Constitution and laws and who meet one of the following conditions may  be8 `& D. C- v1 b* r$ z( p/ L4 \
naturalized upon approval of their applications:1 f# K. V4 A3 K0 A! \8 c/ t
(1) they are near relatives of Chinese nationals;
$ \  q7 L4 f' A6 `7 K(2) they have settled in China; or
. c; o' M9 b% Z& e; Q* e(3) they have other legitimate reasons.6 N/ G; `  L: X: B
Article 8
. F* `  h- B% ]+ W0 J' \Any person who applies for naturalization  as  a  Chinese  national  shall8 w5 A' R$ H) d+ X$ ?6 c: m
acquire Chinese nationality upon approval of  his  application;  a  person& j0 }' R& j0 t7 F# h
whose application for  naturalization  as  a  Chinese  national  has  been
% n4 f& [& @- y. m. lapproved shall not retain foreign nationality.
. k; k0 Z3 i% @Article 93 f/ s, @+ M3 J$ ]/ {; x
Any Chinese national who has settled abroad and who has  been  naturalized
0 v7 q7 ]( {8 v6 cas a foreign national or has acquired foreign nationality of his own  free2 u% C. |0 Y3 R. N0 _
will shall automatically lose Chinese nationality.
5 \, i% o: N$ a5 B* AArticle 10% b4 V. ?& e; H  j  s
Chinese nationals who meet one of the following  conditions  may  renounce
; x# J9 a8 `. Q4 N' KChinese nationality upon approval of their applications:
/ _) e! y7 e6 e(1) they are near relatives of foreign nationals;
# a7 P1 X% f/ n, _9 r( t2 W# r(2) they have settled abroad; or
& I2 Z2 D; R6 ~2 S: C% _(3) they have other legitimate reasons.% ~( h, G' S% R
Article 114 M4 P0 f3 z& U% \4 P
Any person who applies for renunciation of Chinese nationality shall  lose7 i5 L0 Z7 H' {; a) p% l% P0 o
Chinese nationality upon approval of his application.
2 a" h4 f, M5 a" \+ zArticle 12' Y. F$ t7 `4 Y$ [
State functionaries and military personnel on  active  service  shall  not
+ d3 M+ M- {6 W/ Crenounce Chinese nationality.+ ^; i- C' k5 P2 c1 }
Article 13
% ?6 G) w4 v( s/ Q2 vForeign  nationals  who  once  held  Chinese  nationality  may  apply  for! s! }  f- [7 {$ D$ o
restoration of Chinese nationality if they have legitimate reasons;  those
* U& H( a  Z' n4 e3 t- M. t, dwhose applications  for  restoration  of  Chinese  nationality  have  been
% p7 T3 p0 u" {" |, S; N( q( Yapproved shall not retain foreign nationality.
) S4 P6 @. c" Q  aArticle 14' p  V$ z6 n$ J8 c( M
Persons who wish to acquire, renounce or restore Chinese nationality, with* R! M, G$ v/ j; O. g) U
the exception of the cases provided for in Article 9, shall go through the
* X: W1 F3 A. E) qformalities of application.  Applications of persons under the age  of  18) C  }- \% n# t4 ^; s) h  B5 P
may  be  filed  on  their  behalf  by  their  parents   or   other   legal
0 a" _$ _4 a% U" b2 Xrepresentatives.
1 \+ l' e' B' I( R. x3 hArticle 15' v9 s* ?1 W3 f5 X
Nationality applications at home shall be handled by the  public  security! o1 m( S  |. O$ h+ t8 Y3 n) N2 P# H; V
bureaus of the municipalities or counties where the applicants reside;  M! X  R+ i& A9 h1 b
nationality applications abroad shall be  handled  by  China''s  diplomatic& ~  j2 F0 h% M" e
representative agencies and consular offices.
5 o4 y/ w- j* k4 f5 PArticle 161 a; V0 v3 T! P/ k
Applications for naturalization as Chinese nationals and for  renunciation4 H0 T9 v$ e) O. i7 g; |/ P; T
or restoration of Chinese  nationality  are  subject  to  examination  and
* i+ e$ ?$ H* @- c& D8 _approval by the Ministry of Public Security of the  People''s  Republic  of
: C( j- n. `: V! D/ P* y( ~7 AChina. The Ministry of Public Security shall issue a  certificate  to  any& \( V% ]! W6 m& @  w5 E) ?
person whose application has been approved.
+ w" a) l+ v# v( q/ j+ c7 `( GArticle 17
2 Z& l  N5 ~% I5 B2 ZThe nationality status of  persons  who  have  acquired  or  lost  Chinese
  {& {4 [/ T+ z  N9 Z% J( J) Hnationality before the promulgation of this Law shall remain valid.
* _7 K  ?5 ]) r, H' h& t/ k( sArticle 18
0 X7 Z3 Y) R  k  Y3 U+ PThis Law shall come into force on the day of its promulgation.
