4 E9 U4 b7 v: L1 h  y0 _% _* b( M  . w; h) z9 k- D+ R
第一条   中华人民共和国国籍的取得、丧失和恢复,都适用本法。! I" D6 b" t( l! F9 u2 I0 k0 `
    第二条   中华人民共和国是统一的多民族的国家,各民族的人都具有中国国籍。
6 j; S! T& _, t    第三条    中华人民共和国不承认中国公民具有双重国籍。, `; [) |. u! P" q. H5 b; a
    第四条   父母双方或一方为中国公民,本人出生在中国,具有中国国籍。
, l; I4 A1 W2 y, @: u, w    第五条   父母双方或一方为中国公民,本人出生在外国,具有中国国籍;但父母双方或一方为中国公民并定居在外国,本人出生时即具有外国国籍的,不具有中国国籍。
- A& T, Q" K* i* U0 o5 a) E1 W; Q    第六条   父母无国籍或国籍不明,定居在中国,本人出生在中国,具有中国国籍。
- X! @& e! }# B+ s+ Y' g    第七条   外国人或无国籍人,愿意遵守中国宪法和法律,并具有下列条件之一的,可以经申请批准加入中国国籍:1 }1 X" [( q) R' b
    一、中国人的近亲属;
3 B' _2 X4 j) V  B    二、定居在中国的;# V$ h" q% q, K6 \$ n: Q* P: V
    三、有其它正当理由。
' A" O3 t" z1 r9 K+ Z    第八条   申请加入中国国籍获得批准的,即取得中国国籍;被批准加入中国国籍的,不得再保留外国国籍。
+ M' G# M: M4 L  G    第九条    定居外国的中国公民,自愿加入或取得外国国籍的,即自动丧失中国国籍。
4 n1 [/ ~2 Z5 I& \2 y& a    第十条    中国公民具有下列条件之一的,可以经申请批准退出中国国籍:, X; x, {0 C- D) G5 [# E
    一、外国人的近亲属;
4 v" H! X% e1 v9 ?    二、定居在外国的;' y+ i# v9 U' R2 B* g' p* j
    三、有其它正当理由。: m% w/ S+ H. u8 R4 Y
    第十一条    申请退出中国国籍获得批准的,即丧失中国国籍。8 k( a- A% M4 i/ O# L/ a. N( k
    第十二条   国家工作人员和现役军人,不得退出中国国籍。
+ Y2 }, ^" a9 Q0 {* Z5 O6 K- \    第十三条   曾有过中国国籍的外国人,具有正当理由,可以申请恢复中国国籍;被批准恢复中国国籍的,不得再保留外国国籍。0 E6 e' t* W/ Y5 k; s. Z
    第十四条   中国国籍的取得、丧失和恢复,除第九条规定的以外,必须办理申请手续。未满十八周岁的人,可由其父母或其他法定代理人代为办理申请。
+ |* ^4 B* v, I4 i/ ]    第十五条    受理国籍申请的机关,在国内为当地市、县公安局,在国外为中国外交代表机关和领事机关。+ H3 E* a5 n/ F- j7 d
    第十六条   加入、退出和恢复中国国籍的申请,由中华人民共和国公安部审批。经批准的,由公安部发给证书。1 A5 U: F! @+ a
    第十七条   本法公布前,已经取得中国国籍的或已经丧失中国国籍的,继续有效。- j( a) ]/ ?/ c" `" v5 i
    第十八条   本法自公布之日起施行。

2 J9 J5 F, n  d$ P; Z; y, ^) _! l+ qThis Law is  applicable  to  the  acquisition,  loss  and  restoration  of" z% \$ |! ]9 l
nationality of the People''s Republic of China.
# \( O* z# s7 q* Y9 D6 W6 {0 YArticle 2
4 k( s, Q# H# O9 dThe People''s Republic of China is a unitary multinational  state;  persons
2 S1 J; R$ v" n! [6 A/ |0 Kbelonging to  any  of  the  nationalities  in  China  shall  have  Chinese
6 w  J& Q5 N, N  |nationality.3 m: @- d4 c' O' d/ y
Article 3
& v0 x2 N6 T4 k6 o1 k5 yThe People''s Republic of China does not recognize dual nationality for any
, K  g* R6 ^6 q& DChinese national.
! I' B4 {* k) }3 {  D; RArticle 42 D. w) K3 ?) x! K" N! Q
Any person born in China whose parents are both Chinese nationals  or  one
% U9 Q, F( D- H: yof whose parents is a Chinese national shall have Chinese nationality.
6 ?5 \. V5 ~% ~+ P1 _+ T* u( x7 YArticle 5& I4 q9 p1 k+ g5 m, x4 a
Any person born abroad whose parents are both Chinese nationals or one  of
0 G! s$ w' _7 ~5 Cwhose parents is a Chinese national shall have Chinese nationality. But  a
) \5 H! z; ?6 W& C* ?person whose parents are both Chinese  nationals  and  have  both  settled2 s( j- Q* B. E- F8 E% z
abroad, or one of whose parents is a  Chinese  national  and  has  settled' N+ \; _( S( c/ |  D& D2 T
abroad, and who has acquired foreign nationality at birth shall  not  have+ H3 x% g5 S7 j5 G
Chinese nationality.- B; q; F" m1 p" W  |( o+ g
Article 6* l! g% c, d" K! A( ~
Any person born in China whose  parents  are  stateless  or  of  uncertain
" A: e2 c6 t0 enationality and have settled in China shall have Chinese nationality.
, i& v4 H0 T# _( Q# B* mArticle 7: ~* d& _  q: k4 q+ y5 T0 V
Foreign nationals or stateless persons who are willing to abide by China''s
7 x) H- o5 U8 i2 p7 iConstitution and laws and who meet one of the following conditions may  be
+ F3 L  Z4 B0 G9 @+ ]( o# }naturalized upon approval of their applications:* `8 x7 Z" @5 P- l+ N( {7 [" J
(1) they are near relatives of Chinese nationals;8 S* l" X  _+ L  Y+ Y
(2) they have settled in China; or. L9 m0 s# o) N
(3) they have other legitimate reasons.( q5 z" v0 E( s( f1 s! T9 O
Article 8
+ z: b8 U& z6 F! ]8 m* S8 t8 xAny person who applies for naturalization  as  a  Chinese  national  shall8 ^  I* ~! l9 R% `
acquire Chinese nationality upon approval of  his  application;  a  person
7 G' C. d* ]( m) v1 }. jwhose application for  naturalization  as  a  Chinese  national  has  been2 w( f* a  q+ d: C: f/ a* Y
approved shall not retain foreign nationality.
6 d2 h2 U+ j  O) d  ]Article 9
+ V: X2 L. M7 ~, ^Any Chinese national who has settled abroad and who has  been  naturalized
; u; i; @( Z" m, Tas a foreign national or has acquired foreign nationality of his own  free8 g  m* S; w" W" o: {4 f) J
will shall automatically lose Chinese nationality.
5 [0 y2 g! i( c) \Article 10
* N0 [# u3 ?9 n/ k2 jChinese nationals who meet one of the following  conditions  may  renounce
* {, x# {% W4 N  q1 ~Chinese nationality upon approval of their applications:1 b. {4 S4 f+ S, ~
(1) they are near relatives of foreign nationals;; N0 @4 O9 M( q9 f6 ~2 f/ Y$ q
(2) they have settled abroad; or- E$ f1 Y  {* _& j6 m; k1 x
(3) they have other legitimate reasons.
- o; k: J$ _8 FArticle 118 t# y' j1 J6 e
Any person who applies for renunciation of Chinese nationality shall  lose
% m5 @3 ]' g$ J2 X! t- }/ JChinese nationality upon approval of his application.  V( A. X' ~( `
Article 12
- d" m; R8 d! R- i4 r% PState functionaries and military personnel on  active  service  shall  not
1 K" D; O, H) [9 ^4 u+ _7 hrenounce Chinese nationality.
- B0 N- S4 A0 ]$ V$ h$ l- k% lArticle 13$ R$ I! V" b! h
Foreign  nationals  who  once  held  Chinese  nationality  may  apply  for
- d/ e$ Y+ \; C; I' ~restoration of Chinese nationality if they have legitimate reasons;  those2 f3 U9 h1 P; b! e- h2 Q8 l
whose applications  for  restoration  of  Chinese  nationality  have  been
  d: j+ X% W9 l9 `* zapproved shall not retain foreign nationality.
7 f9 ~* G- a$ oArticle 14
7 t7 ~* u7 h4 VPersons who wish to acquire, renounce or restore Chinese nationality, with, E( b. `  I; }# X
the exception of the cases provided for in Article 9, shall go through the
; [: m# j: C9 M/ uformalities of application.  Applications of persons under the age  of  18% |! V" v' M; K# Q' ?1 B2 S
may  be  filed  on  their  behalf  by  their  parents   or   other   legal9 h$ r, ?& P2 f
representatives.
$ G8 a( `; i# \3 B$ z& r0 uArticle 15
' m' A. ^4 ^5 p, M6 G' ANationality applications at home shall be handled by the  public  security& Z% ]9 m5 H9 J+ p
bureaus of the municipalities or counties where the applicants reside;2 ?+ V3 B/ b' }; G
nationality applications abroad shall be  handled  by  China''s  diplomatic6 L/ x* M; `5 s. t; _, [
representative agencies and consular offices.
% ^$ x; c  T) l/ q+ UArticle 16, Q) `. X$ {; b
Applications for naturalization as Chinese nationals and for  renunciation
+ e' g2 G; \3 eor restoration of Chinese  nationality  are  subject  to  examination  and: v$ a' x+ t4 Z; p2 V
approval by the Ministry of Public Security of the  People''s  Republic  of' a9 l" u! x& m1 |5 N" P9 t; @, v+ j
China. The Ministry of Public Security shall issue a  certificate  to  any  f3 \* x9 ]8 a, S% U  Q  F
person whose application has been approved.& L9 f/ }2 a- z1 O! {
Article 17
) n5 o$ n8 a! d* ]6 X; X3 v* |8 @6 WThe nationality status of  persons  who  have  acquired  or  lost  Chinese
/ Q  _/ a3 Q- o* t! @nationality before the promulgation of this Law shall remain valid.
$ N: A$ F5 H$ L3 q. t6 UArticle 18
6 c9 T2 z/ F2 tThis Law shall come into force on the day of its promulgation.
