# ]0 Z+ a3 z3 I7 a; q 第一条 中华人民共和国国籍的取得、丧失和恢复,都适用本法。- f3 |; t; k) `
第二条 中华人民共和国是统一的多民族的国家,各民族的人都具有中国国籍。
8 D5 v8 Y Q# d: t3 q) K 第三条 中华人民共和国不承认中国公民具有双重国籍。
$ F& P' E7 _; n( l! P 第四条 父母双方或一方为中国公民,本人出生在中国,具有中国国籍。0 X( z. p0 X' |
第五条 父母双方或一方为中国公民,本人出生在外国,具有中国国籍;但父母双方或一方为中国公民并定居在外国,本人出生时即具有外国国籍的,不具有中国国籍。
, O5 v% k4 t% A8 r. _ 第六条 父母无国籍或国籍不明,定居在中国,本人出生在中国,具有中国国籍。
$ g V+ ~( b, t7 v) I4 _ 第七条 外国人或无国籍人,愿意遵守中国宪法和法律,并具有下列条件之一的,可以经申请批准加入中国国籍:

( V+ h; f" Y* k {4 a 二、定居在中国的;; \. z, [2 S7 V* R4 u' C+ k' o
三、有其它正当理由。
, L, f. l& r; O- L! {7 j; o( x 第八条 申请加入中国国籍获得批准的,即取得中国国籍;被批准加入中国国籍的,不得再保留外国国籍。6 n% ]- I7 P# o2 \2 }! h3 l/ m+ g
第九条 定居外国的中国公民,自愿加入或取得外国国籍的,即自动丧失中国国籍。% r5 ]: J m2 O2 H% y& V7 Q- L
第十条 中国公民具有下列条件之一的,可以经申请批准退出中国国籍:
8 O4 T+ C; k4 Q* F5 l 一、外国人的近亲属;' q3 [# w; g! p1 P
二、定居在外国的;7 S: Y! R4 e' R! Q% i8 Z- Z
三、有其它正当理由。
1 N' [7 t' k- Z3 Z$ Z 第十一条 申请退出中国国籍获得批准的,即丧失中国国籍。+ U; Y8 t/ z, C# ]( a* x
第十二条 国家工作人员和现役军人,不得退出中国国籍。! t% [/ L$ |6 q0 G K4 i
第十三条 曾有过中国国籍的外国人,具有正当理由,可以申请恢复中国国籍;被批准恢复中国国籍的,不得再保留外国国籍。/ ?, V4 ?* \9 N' O# s
第十四条 中国国籍的取得、丧失和恢复,除第九条规定的以外,必须办理申请手续。未满十八周岁的人,可由其父母或其他法定代理人代为办理申请。$ T( O2 b: H- O5 l" L K
第十五条 受理国籍申请的机关,在国内为当地市、县公安局,在国外为中国外交代表机关和领事机关。5 r( v& ]# W& n( G+ @- y6 |: F
第十六条 加入、退出和恢复中国国籍的申请,由中华人民共和国公安部审批。经批准的,由公安部发给证书。

This Law is applicable to the acquisition, loss and restoration of
+ W; N9 z7 r' x; b; }( hnationality of the People''s Republic of China.

The People''s Republic of China is a unitary multinational state; persons
, w* E5 |& c2 Z4 ^belonging to any of the nationalities in China shall have Chinese

The People''s Republic of China does not recognize dual nationality for any0 m I" p) z w* [" r

Article 4& r' m# R; ^& v9 C. i
Any person born in China whose parents are both Chinese nationals or one
) Z8 b( L" s% } ]of whose parents is a Chinese national shall have Chinese nationality.6 x9 B" i5 d' g. b. o
Article 5
) u1 E/ f6 ~6 BAny person born abroad whose parents are both Chinese nationals or one of
% E2 {; T7 c6 Z4 s) cwhose parents is a Chinese national shall have Chinese nationality. But a$ Y! R! I- @; D& l- `% m
person whose parents are both Chinese nationals and have both settled9 v1 ?8 z; w) Q3 |
abroad, or one of whose parents is a Chinese national and has settled) ~5 w5 e9 o0 }( k1 H
abroad, and who has acquired foreign nationality at birth shall not have
( d4 k4 @! g( }/ p( C4 _4 M- ]; i4 X6 UChinese nationality.9 o0 n4 N l5 X
Article 6
7 }* Y7 I/ x; H5 O5 GAny person born in China whose parents are stateless or of uncertain" Z3 `4 G2 h# Y3 e
nationality and have settled in China shall have Chinese nationality.

# F/ \% y3 l6 V# T5 sForeign nationals or stateless persons who are willing to abide by China''s; E) ]/ M- t. ?: c$ }
Constitution and laws and who meet one of the following conditions may be
% h D5 R9 d; x0 B3 Z9 `. gnaturalized upon approval of their applications:
2 v4 V/ `0 l/ c(1) they are near relatives of Chinese nationals;
8 X4 V0 B9 T/ D% \) J5 G(2) they have settled in China; or
) p, g1 L. C+ h$ u; x(3) they have other legitimate reasons.6 N7 ~4 @9 Y" l+ R1 ^$ Y2 t
Article 82 G- ^3 {$ C* l; n* ?$ r$ l! e
Any person who applies for naturalization as a Chinese national shall: O5 T6 Z5 w! T9 U( x5 R
acquire Chinese nationality upon approval of his application; a person$ _/ P$ p& J& O
whose application for naturalization as a Chinese national has been
3 {; H) Y3 W3 u8 C, Z0 o- xapproved shall not retain foreign nationality. ] A" M( n$ H1 j
Article 90 [& p r" o% k, f, g1 B+ O
Any Chinese national who has settled abroad and who has been naturalized( p a9 w9 f5 O4 ^
as a foreign national or has acquired foreign nationality of his own free
3 _0 H9 m0 L+ w8 H6 E3 E" Pwill shall automatically lose Chinese nationality." z; @# W8 e. R! q3 \
Article 10
2 P" g+ Y9 ~% @- S0 b L$ lChinese nationals who meet one of the following conditions may renounce
; p3 K L/ ]% C1 Q8 aChinese nationality upon approval of their applications:
' x0 y1 p& D- m! ?6 e' O9 o: {: u N(1) they are near relatives of foreign nationals;$ T: N" o$ l r
(2) they have settled abroad; or) O. \$ |8 V. p- e" t3 D
(3) they have other legitimate reasons.& ^" }7 B# j# q d) h+ q, L" [
Article 11
" T% T$ m! O$ @" V# l/ kAny person who applies for renunciation of Chinese nationality shall lose
" ?9 J ^6 g/ z: c8 `6 {Chinese nationality upon approval of his application.
& g4 f3 |$ E5 t! [8 pArticle 12
; @3 i( J* |7 E; i1 LState functionaries and military personnel on active service shall not
, O; o" [2 N' {% {/ d/ d! D* f0 Yrenounce Chinese nationality.7 q4 `5 [9 V5 g' c( S' I
Article 13# I1 L: G& J0 M9 u6 L/ v+ q9 Q, f
Foreign nationals who once held Chinese nationality may apply for
4 \8 W) D/ r: f9 C1 h7 rrestoration of Chinese nationality if they have legitimate reasons; those
/ j# w) W. T7 K- U# Wwhose applications for restoration of Chinese nationality have been; _$ `/ e- d$ C: a! @
approved shall not retain foreign nationality. [' f ?) M u* V
Article 14
! ~) P& g5 S+ O9 R3 c7 @+ v! rPersons who wish to acquire, renounce or restore Chinese nationality, with& R2 g/ F% W. ^& {8 ` e7 q2 Z
the exception of the cases provided for in Article 9, shall go through the
$ F( T* A9 h1 k: G, N" {4 f& O5 jformalities of application. Applications of persons under the age of 18
4 h* x S2 \: t+ j5 j! I" Qmay be filed on their behalf by their parents or other legal4 y, Z) D1 P( B' u+ [6 R
representatives.1 \# J* H( y! N
Article 15
' H$ T* Z/ ]* s5 R" i3 UNationality applications at home shall be handled by the public security) e, N7 U$ R7 f' X2 m0 F
bureaus of the municipalities or counties where the applicants reside;
) H( N+ u1 u" G' d! d# enationality applications abroad shall be handled by China''s diplomatic
0 z/ u& E( V- c8 vrepresentative agencies and consular offices.+ n- Q2 n8 G% W7 Q0 q
Article 16
0 P$ R3 l: g$ U% r: {, c# gApplications for naturalization as Chinese nationals and for renunciation7 }) E% A2 t6 _% u2 W
or restoration of Chinese nationality are subject to examination and
( n, z0 t! @: a* P+ f3 B; L. ^' p& j. dapproval by the Ministry of Public Security of the People''s Republic of
) t. g) ^- r0 x" [/ T9 @China. The Ministry of Public Security shall issue a certificate to any
0 Z* v2 y1 |" F9 pperson whose application has been approved.

v3 p. c- j0 j# D% FThe nationality status of persons who have acquired or lost Chinese; z; {5 X+ L+ P0 i' X2 e
nationality before the promulgation of this Law shall remain valid.7 B+ o: q$ U" T6 d( W
Article 18
: m7 {2 Y4 K! R" ]- z& BThis Law shall come into force on the day of its promulgation. |
