第一条 中华人民共和国国籍的取得、丧失和恢复,都适用本法。5 e: J O$ ^; }8 o7 T: G* d
第二条 中华人民共和国是统一的多民族的国家,各民族的人都具有中国国籍。
s* j" L5 F* J8 Y& m: S 第三条 中华人民共和国不承认中国公民具有双重国籍。
" P" ]' E& _* q+ @ 第四条 父母双方或一方为中国公民,本人出生在中国,具有中国国籍。
9 P5 V) S; {' g$ A9 Y. w 第五条 父母双方或一方为中国公民,本人出生在外国,具有中国国籍;但父母双方或一方为中国公民并定居在外国,本人出生时即具有外国国籍的,不具有中国国籍。' y6 P3 W( |, N- d. m
第六条 父母无国籍或国籍不明,定居在中国,本人出生在中国,具有中国国籍。

二、定居在中国的;, A3 }. `. T$ `5 l' l, u3 F, i

第八条 申请加入中国国籍获得批准的,即取得中国国籍;被批准加入中国国籍的,不得再保留外国国籍。
4 s# X" F" b; j" `: q 第九条 定居外国的中国公民,自愿加入或取得外国国籍的,即自动丧失中国国籍。
; X$ L3 Y; @8 x4 k6 C 第十条 中国公民具有下列条件之一的,可以经申请批准退出中国国籍:
' u" d! x& _9 |2 e' f; C% z 一、外国人的近亲属;2 \+ Z( K" @5 Y; Y* g
二、定居在外国的;/ |. Q3 r) c9 g1 Z" L
三、有其它正当理由。) V6 u1 C5 G( t; O
第十一条 申请退出中国国籍获得批准的,即丧失中国国籍。2 W; ]4 C9 z5 s3 R0 W5 P! u
第十二条 国家工作人员和现役军人,不得退出中国国籍。
9 S8 c! D1 Q h) ]/ I$ ~5 Q 第十三条 曾有过中国国籍的外国人,具有正当理由,可以申请恢复中国国籍;被批准恢复中国国籍的,不得再保留外国国籍。 D# g# E& q1 Y
第十四条 中国国籍的取得、丧失和恢复,除第九条规定的以外,必须办理申请手续。未满十八周岁的人,可由其父母或其他法定代理人代为办理申请。

. s9 J+ Y. a) w2 ]' t% L" l6 c 第十六条 加入、退出和恢复中国国籍的申请,由中华人民共和国公安部审批。经批准的,由公安部发给证书。9 V- G: C; P. p4 H4 Z
第十七条 本法公布前,已经取得中国国籍的或已经丧失中国国籍的,继续有效。& Z0 B: ^, I, b- T8 e( s9 h
第十八条 本法自公布之日起施行。

The People''s Republic of China is a unitary multinational state; persons3 G( t, i/ N J0 E) W3 G: L
belonging to any of the nationalities in China shall have Chinese

Any person born in China whose parents are both Chinese nationals or one
+ L \ u& ~3 X' m1 K6 R# Sof whose parents is a Chinese national shall have Chinese nationality.

Any person born abroad whose parents are both Chinese nationals or one of
) X4 ?1 q/ o# ~whose parents is a Chinese national shall have Chinese nationality. But a
! l- m, P$ Q( x9 @; Yperson whose parents are both Chinese nationals and have both settled5 J: z" m0 s/ O4 q: h2 ^
abroad, or one of whose parents is a Chinese national and has settled( W6 I+ m' R" N5 n; d6 n
abroad, and who has acquired foreign nationality at birth shall not have" W, E# r5 Y8 j
Chinese nationality.

2 p0 Y) M6 _# N2 T1 VForeign nationals or stateless persons who are willing to abide by China''s
. d4 l' Q5 T* R l( lConstitution and laws and who meet one of the following conditions may be
) y/ B% b' r& g4 h* ^naturalized upon approval of their applications:/ X4 ~) V* e9 k
(1) they are near relatives of Chinese nationals;

5 I: p1 e6 k2 KAny person who applies for naturalization as a Chinese national shall
8 S8 f, e; l- zacquire Chinese nationality upon approval of his application; a person
8 r! @9 p. x0 e: rwhose application for naturalization as a Chinese national has been6 X2 A2 W, L$ L
approved shall not retain foreign nationality.

Any Chinese national who has settled abroad and who has been naturalized
; h9 A) t% O" z- C! }8 K0 a3 ias a foreign national or has acquired foreign nationality of his own free
$ x5 ~9 `. A: a4 Z! k7 |will shall automatically lose Chinese nationality.
* q) B& `. |# [+ X- @Article 10" v* Y( S7 }0 j. o
Chinese nationals who meet one of the following conditions may renounce8 a: S& m' `: S3 B4 P1 `
Chinese nationality upon approval of their applications:
. e) v$ ]! a: m- m' q, W(1) they are near relatives of foreign nationals;' y, [: v# F$ {. x! |
(2) they have settled abroad; or8 |2 \: k# d* e

Article 11
# `: ^- x5 k3 a( bAny person who applies for renunciation of Chinese nationality shall lose; I# Z- e( `- m: t* c$ H. K% f
Chinese nationality upon approval of his application.1 l- \8 ?9 ]: a5 a5 |% ]
Article 12
$ M; S ?* a8 C- a" L& P' l0 m& C% vState functionaries and military personnel on active service shall not6 j+ E8 O) T: w. @8 H7 {% W$ J) p$ U7 N
renounce Chinese nationality., y3 {. }, r0 ?3 c' o7 O& ~) l0 L
Article 13; ? a$ A/ _5 i. ]
Foreign nationals who once held Chinese nationality may apply for
/ U1 `4 E. h8 M2 orestoration of Chinese nationality if they have legitimate reasons; those6 S+ k" j0 w# ]9 d/ ~. S6 \
whose applications for restoration of Chinese nationality have been" o, g% o! X" C9 S4 [
approved shall not retain foreign nationality.
% }7 ]( N H8 n3 yArticle 14
1 S* ~+ a$ b& F) B$ I! CPersons who wish to acquire, renounce or restore Chinese nationality, with
( P( W* {0 s ?8 {* b3 [the exception of the cases provided for in Article 9, shall go through the: L2 b2 }0 t, ^
formalities of application. Applications of persons under the age of 18! C* C2 A' \! {7 r5 y t+ _8 }' @
may be filed on their behalf by their parents or other legal
: f! J" V+ b7 y+ s9 t& f1 G; u! Xrepresentatives.
) v8 I1 c4 @# r6 @) _! e- xArticle 15
8 E( ^( u. E3 w( b& ]2 \$ N% dNationality applications at home shall be handled by the public security: D9 M/ ~6 u% X p/ }
bureaus of the municipalities or counties where the applicants reside;
, d7 X) Z0 _. u1 `nationality applications abroad shall be handled by China''s diplomatic6 e; G+ w9 X3 b/ s
representative agencies and consular offices.

0 C0 ]0 r$ d; J5 ~5 e+ ?9 X# Y) RApplications for naturalization as Chinese nationals and for renunciation
7 o, s, k+ E. y( tor restoration of Chinese nationality are subject to examination and* r! C, m$ I2 O! V2 @$ D i
approval by the Ministry of Public Security of the People''s Republic of
6 f( |1 [; I: h' q) L2 ZChina. The Ministry of Public Security shall issue a certificate to any3 ?0 F: Q1 n% u% U
person whose application has been approved. N" {3 R+ C% V/ A, ^- w. X
Article 17% ]3 v7 d; y! S% G, D9 V( z
The nationality status of persons who have acquired or lost Chinese: C" h" i4 M4 L: G' C F/ G7 {
nationality before the promulgation of this Law shall remain valid.

3 k* E' _# U( ZThis Law shall come into force on the day of its promulgation. |
