1 G+ h* Q7 s3 X3 @' D& t 第一条 中华人民共和国国籍的取得、丧失和恢复,都适用本法。
" V' h3 u, J4 S( {7 f 第二条 中华人民共和国是统一的多民族的国家,各民族的人都具有中国国籍。; w+ f d, F8 T# ~
第三条 中华人民共和国不承认中国公民具有双重国籍。7 K/ c7 U* z' `. v. Z0 T" C
第四条 父母双方或一方为中国公民,本人出生在中国,具有中国国籍。
, k( E- I7 r$ K) W$ k 第五条 父母双方或一方为中国公民,本人出生在外国,具有中国国籍;但父母双方或一方为中国公民并定居在外国,本人出生时即具有外国国籍的,不具有中国国籍。
5 e" ]3 e' r5 j% B+ P! L# U; O 第六条 父母无国籍或国籍不明,定居在中国,本人出生在中国,具有中国国籍。
* Y6 z/ q( ]* j0 j7 d% H6 _- K 第七条 外国人或无国籍人,愿意遵守中国宪法和法律,并具有下列条件之一的,可以经申请批准加入中国国籍:

第八条 申请加入中国国籍获得批准的,即取得中国国籍;被批准加入中国国籍的,不得再保留外国国籍。+ P$ ?$ d; b$ [/ U3 |. G' F4 h9 Z
第九条 定居外国的中国公民,自愿加入或取得外国国籍的,即自动丧失中国国籍。
: F8 _$ }7 y( I% x6 f 第十条 中国公民具有下列条件之一的,可以经申请批准退出中国国籍:8 V! ]9 O* e; @% ?$ h8 |+ q
一、外国人的近亲属;1 ]* a8 @& s V9 V
二、定居在外国的;5 Q1 ^& ~6 Z3 Q/ x* s

第十一条 申请退出中国国籍获得批准的,即丧失中国国籍。, e- n. u8 M, K8 B, X* O& t( r
第十二条 国家工作人员和现役军人,不得退出中国国籍。+ {* f( q- T v- u9 e7 C* G6 N: ?
第十三条 曾有过中国国籍的外国人,具有正当理由,可以申请恢复中国国籍;被批准恢复中国国籍的,不得再保留外国国籍。; `. s; P0 @7 G
第十四条 中国国籍的取得、丧失和恢复,除第九条规定的以外,必须办理申请手续。未满十八周岁的人,可由其父母或其他法定代理人代为办理申请。
! b) u7 }' b0 F4 f/ C& ` 第十五条 受理国籍申请的机关,在国内为当地市、县公安局,在国外为中国外交代表机关和领事机关。 }( |8 ~+ f! t: I) K+ S
第十六条 加入、退出和恢复中国国籍的申请,由中华人民共和国公安部审批。经批准的,由公安部发给证书。

第十八条 本法自公布之日起施行。

This Law is applicable to the acquisition, loss and restoration of

Article 2, t# B4 { c2 J
The People''s Republic of China is a unitary multinational state; persons
. u; z) |/ {0 _& D9 Z" [$ Gbelonging to any of the nationalities in China shall have Chinese, ^9 I6 Q, \% H, J/ P
nationality.

The People''s Republic of China does not recognize dual nationality for any
6 e4 o- d4 h4 \Chinese national.

Any person born in China whose parents are both Chinese nationals or one6 J5 l9 _+ s+ a/ M; K
of whose parents is a Chinese national shall have Chinese nationality.

person whose parents are both Chinese nationals and have both settled

Any person born in China whose parents are stateless or of uncertain
8 J' W, L8 ?; J- ]( t% [# A( m7 Hnationality and have settled in China shall have Chinese nationality.. C$ H' M/ C# V6 Y8 p, u
Article 7$ F1 q. `; W1 x* _. i/ N
Foreign nationals or stateless persons who are willing to abide by China''s4 F$ J2 C: W& ~# P: r
Constitution and laws and who meet one of the following conditions may be
) M! z* F* h' O; G$ s% o" dnaturalized upon approval of their applications:, i# p, E* c. y2 G. C& }% i. w
(1) they are near relatives of Chinese nationals;
% K8 B6 T& P7 G(2) they have settled in China; or
! T" }, J# j' ]: K7 p(3) they have other legitimate reasons.

" ~3 [: ^/ ^: Y! qAny person who applies for naturalization as a Chinese national shall
- {8 j2 ]. j/ U5 Cacquire Chinese nationality upon approval of his application; a person' Y& N- ?9 y+ _ v
whose application for naturalization as a Chinese national has been2 e0 n1 o$ ?6 c$ v7 z. W
approved shall not retain foreign nationality.

Any Chinese national who has settled abroad and who has been naturalized
; H! U, j7 O1 E- Z& K2 Uas a foreign national or has acquired foreign nationality of his own free
% p; |1 a. j0 Q# c5 Zwill shall automatically lose Chinese nationality.

Chinese nationals who meet one of the following conditions may renounce, N/ j6 G1 l4 e% e0 C5 Z
Chinese nationality upon approval of their applications:
0 C _" Q+ E5 L3 }( s8 E3 W(1) they are near relatives of foreign nationals;$ @1 m, P5 C4 o; |4 B
(2) they have settled abroad; or/ l' p! O7 T2 T/ o
(3) they have other legitimate reasons.+ d2 A+ Q. s/ T5 G
Article 11) G# C5 E0 a2 M$ M1 p- t# P' j: S+ E
Any person who applies for renunciation of Chinese nationality shall lose+ k* \8 }+ N8 H6 n; K; I/ y6 n
Chinese nationality upon approval of his application.

9 m" D9 I8 u4 F( J; M3 Q8 gState functionaries and military personnel on active service shall not
- E; `7 ~; u+ Y) r6 t" }; Arenounce Chinese nationality.
* J9 a% T+ l4 {7 O' ^. C" O2 JArticle 13, m" ?5 [* R0 \
Foreign nationals who once held Chinese nationality may apply for
. f( E8 |: S wrestoration of Chinese nationality if they have legitimate reasons; those" D# m% l3 |% |
whose applications for restoration of Chinese nationality have been
) @4 e) ^! K8 m% I. wapproved shall not retain foreign nationality.
9 J+ V9 a1 E/ x3 P% z) m* X8 ^Article 14: E/ E) `4 [& |- g* S; {9 I! _
Persons who wish to acquire, renounce or restore Chinese nationality, with
) ]( Z1 [5 ~' e! hthe exception of the cases provided for in Article 9, shall go through the2 E; v; {/ w) v3 W7 S. H+ a3 D. c
formalities of application. Applications of persons under the age of 18% c. G" V3 o- C4 ?( K
may be filed on their behalf by their parents or other legal
: h# ]5 b3 g9 orepresentatives.* X$ l. R( G3 d/ ]% u
Article 15
0 |: y( ?! j9 s5 YNationality applications at home shall be handled by the public security
( k% G: q4 J1 X& e2 q1 s# Sbureaus of the municipalities or counties where the applicants reside;+ F+ J# d* |) U; B. M$ B
nationality applications abroad shall be handled by China''s diplomatic
% _; R1 d0 O& S9 i' U- b. g' V: M# Mrepresentative agencies and consular offices.
& O% z4 O. s3 R: FArticle 16% o5 P4 ?7 v; z
Applications for naturalization as Chinese nationals and for renunciation
7 ^" P! a9 v; ]! `7 X9 X5 Jor restoration of Chinese nationality are subject to examination and
2 P' G* f# m. B* [" H8 @$ Sapproval by the Ministry of Public Security of the People''s Republic of
% C- c& ?( O. b; yChina. The Ministry of Public Security shall issue a certificate to any9 I- O8 W2 a v' n. Q0 J
person whose application has been approved.

The nationality status of persons who have acquired or lost Chinese
) ?! l' U0 K9 f* p4 p5 [5 Ynationality before the promulgation of this Law shall remain valid.

This Law shall come into force on the day of its promulgation. |
