9 A0 d! P( k2 _4 s# C 第一条   中华人民共和国国籍的取得、丧失和恢复,都适用本法。! c7 i1 h# h/ N/ [2 Y- O
    第二条   中华人民共和国是统一的多民族的国家,各民族的人都具有中国国籍。1 `1 t$ u/ U  n
    第三条    中华人民共和国不承认中国公民具有双重国籍。- j0 b0 E2 L; v
    第四条   父母双方或一方为中国公民,本人出生在中国,具有中国国籍。) e, ~; r1 T( z0 |  ^! X/ Y1 |
    第五条   父母双方或一方为中国公民,本人出生在外国,具有中国国籍;但父母双方或一方为中国公民并定居在外国,本人出生时即具有外国国籍的,不具有中国国籍。
$ t4 U% d% S- t# w8 r0 [    第六条   父母无国籍或国籍不明,定居在中国,本人出生在中国,具有中国国籍。% C& o4 y/ a; M, z/ ^' I( K
    第七条   外国人或无国籍人,愿意遵守中国宪法和法律,并具有下列条件之一的,可以经申请批准加入中国国籍:9 j/ A9 ?' b; X$ i
    一、中国人的近亲属;( I: H, c* n; \3 y0 S, h2 n& k
    二、定居在中国的;
# ~  e/ R+ U) [, N    三、有其它正当理由。  W- h+ r5 F+ _1 u
    第八条   申请加入中国国籍获得批准的,即取得中国国籍;被批准加入中国国籍的,不得再保留外国国籍。
0 v* k# i: `  O: y2 A    第九条    定居外国的中国公民,自愿加入或取得外国国籍的,即自动丧失中国国籍。
/ }: n# ^* @2 l/ e    第十条    中国公民具有下列条件之一的,可以经申请批准退出中国国籍:
/ T6 p$ X2 @/ X5 ^' W5 Q: j    一、外国人的近亲属;) m  G) R: G9 m- u  }" t9 T
    二、定居在外国的;
( [2 x! Y/ s7 V6 H; t0 u& \# ]    三、有其它正当理由。
9 {2 X" m% |9 J. o    第十一条    申请退出中国国籍获得批准的,即丧失中国国籍。" ^; L5 Y7 r5 |, N9 P
    第十二条   国家工作人员和现役军人,不得退出中国国籍。
5 i9 ]* O' U0 S4 a" y. F& V1 F    第十三条   曾有过中国国籍的外国人,具有正当理由,可以申请恢复中国国籍;被批准恢复中国国籍的,不得再保留外国国籍。# s2 T3 z1 Z: A! T- b
    第十四条   中国国籍的取得、丧失和恢复,除第九条规定的以外,必须办理申请手续。未满十八周岁的人,可由其父母或其他法定代理人代为办理申请。
* ~: V  B5 ?# M; \5 g& D, p' ]% U    第十五条    受理国籍申请的机关,在国内为当地市、县公安局,在国外为中国外交代表机关和领事机关。
6 d% `% `" g  W    第十六条   加入、退出和恢复中国国籍的申请,由中华人民共和国公安部审批。经批准的,由公安部发给证书。
# x: P1 D/ H+ S* B: c    第十七条   本法公布前,已经取得中国国籍的或已经丧失中国国籍的,继续有效。
7 @# v$ s4 d0 _% M5 F' w/ U0 R    第十八条   本法自公布之日起施行。

Article 1
3 m; U- d8 w! @0 ?3 h. }- m2 EThis Law is  applicable  to  the  acquisition,  loss  and  restoration  of, u5 o. K$ V* r: L
nationality of the People''s Republic of China.7 [/ O) B% R) z$ z
Article 2& M0 C2 [* X& _' M
The People''s Republic of China is a unitary multinational  state;  persons
5 m  V9 E: h# ]" ~# k# u! D' n( Hbelonging to  any  of  the  nationalities  in  China  shall  have  Chinese
. X- s% |; H! b! e& Znationality.2 w4 q5 O& [4 I- h: p9 o2 w

The People''s Republic of China does not recognize dual nationality for any

Article 4
7 f. N3 i, N( E! r* gAny person born in China whose parents are both Chinese nationals  or  one7 |+ a! w: N/ B# q- |' J, j2 @4 j# @
of whose parents is a Chinese national shall have Chinese nationality.# z8 l0 Q, P8 R
Article 58 ], ?' h6 |% x. s  Y. B- F1 j
Any person born abroad whose parents are both Chinese nationals or one  of* K2 y( i8 }# n+ K# n9 q
whose parents is a Chinese national shall have Chinese nationality. But  a
, G2 w+ o8 C( @/ t+ B! r: sperson whose parents are both Chinese  nationals  and  have  both  settled( ?9 f& m2 y& h$ m
abroad, or one of whose parents is a  Chinese  national  and  has  settled2 A* b' v% K7 S6 U& n8 r( `% V$ y
abroad, and who has acquired foreign nationality at birth shall  not  have4 ^. m9 T; L  p9 t' h
Chinese nationality.

Any person born in China whose  parents  are  stateless  or  of  uncertain
( H4 g0 K2 \$ o, E" Cnationality and have settled in China shall have Chinese nationality.
( w6 d% h7 U0 JArticle 7" V5 W# v9 I/ t+ N% b* A5 f
Foreign nationals or stateless persons who are willing to abide by China''s
2 n7 c( K* }) qConstitution and laws and who meet one of the following conditions may  be. V" i/ T% ?" i+ g" L
naturalized upon approval of their applications:
- m' c' @: L1 ]! f(1) they are near relatives of Chinese nationals;: t; J( p( N) W  B
(2) they have settled in China; or
8 s  ?' X" f1 W0 c- M7 J( H/ w6 Y9 P(3) they have other legitimate reasons.

Any person who applies for naturalization  as  a  Chinese  national  shall) `6 i: V6 `" u9 F' _, `& H
acquire Chinese nationality upon approval of  his  application;  a  person
4 e3 ~; A4 G! \) Cwhose application for  naturalization  as  a  Chinese  national  has  been! l9 a, N/ m( d# I) \4 A9 l8 \
approved shall not retain foreign nationality.
1 W& }" K) f5 C$ R1 i0 pArticle 9
5 J, z: V) U3 D  \# j$ {Any Chinese national who has settled abroad and who has  been  naturalized
0 M/ l* C" X+ H' ias a foreign national or has acquired foreign nationality of his own  free0 k7 {# V$ O2 z$ D. G& h7 d. G" J
will shall automatically lose Chinese nationality.* X* H* N4 b2 Z5 q8 p1 n
Article 10+ z. ]5 L; {8 w5 d4 F, v
Chinese nationals who meet one of the following  conditions  may  renounce2 U! O9 i$ Z" @8 \" h
Chinese nationality upon approval of their applications:
5 N4 v% R; B# B, A- P(1) they are near relatives of foreign nationals;
( V+ e( O% \9 E4 ]. H6 h(2) they have settled abroad; or
' u+ ]; a" ?& D6 s9 ^% d(3) they have other legitimate reasons.: Z1 `6 w  c2 |3 Q  g8 g
Article 117 R/ e2 S( ]% v' Z2 }) O  b# G
Any person who applies for renunciation of Chinese nationality shall  lose" M) T  c" @( z5 o9 \
Chinese nationality upon approval of his application.
; p% Y; Z2 ]1 E9 h: P8 h/ JArticle 129 O5 C0 ]4 F0 j
State functionaries and military personnel on  active  service  shall  not
; ]8 c8 z/ o6 ]* b$ Krenounce Chinese nationality.
9 n: j& m+ u5 V( J0 ]Article 13
9 N$ p+ G+ I, e2 ^$ u2 g: e4 jForeign  nationals  who  once  held  Chinese  nationality  may  apply  for
3 z2 X" a% K, W0 L& Xrestoration of Chinese nationality if they have legitimate reasons;  those- j6 u, \+ D3 u+ e
whose applications  for  restoration  of  Chinese  nationality  have  been
3 P4 w( P0 W  I& fapproved shall not retain foreign nationality.$ Z3 m0 d% {) M# d
Article 14, B  E( U* E, c" |; M% x$ A- f
Persons who wish to acquire, renounce or restore Chinese nationality, with! E1 S" j0 H+ W- y
the exception of the cases provided for in Article 9, shall go through the% P' E: }  f9 h+ `, @4 ?, g$ p$ _7 O
formalities of application.  Applications of persons under the age  of  18" ?- \! @; [, K9 D0 J# y
may  be  filed  on  their  behalf  by  their  parents   or   other   legal
, C7 {, h( R( d5 A! J2 @/ k9 Trepresentatives.; j5 W% `5 f  v- W. u, r
Article 15
, p1 x/ b% U/ c- }- SNationality applications at home shall be handled by the  public  security
% g& s' b; x3 V7 o& O; i) p" _bureaus of the municipalities or counties where the applicants reside;
" y8 b4 x  W8 s& K% {) Q+ lnationality applications abroad shall be  handled  by  China''s  diplomatic
1 C$ w/ ]% s4 k" A; urepresentative agencies and consular offices.
8 a' e+ e" r& t% Z3 j( T$ r# wArticle 16% p% n" O, a" F
Applications for naturalization as Chinese nationals and for  renunciation
2 x% o: r2 ^- |; for restoration of Chinese  nationality  are  subject  to  examination  and* U$ Q2 X4 X/ S2 W
approval by the Ministry of Public Security of the  People''s  Republic  of6 a% x7 w, B0 D8 G/ }# `
China. The Ministry of Public Security shall issue a  certificate  to  any( p: ~( H6 o2 B# _
person whose application has been approved.9 K, R' H0 J" `, U9 G( L
Article 17* |# @- M$ ~( x2 k7 u( Q6 k6 N5 G
The nationality status of  persons  who  have  acquired  or  lost  Chinese6 g. j& i8 |' I# D  E9 [
nationality before the promulgation of this Law shall remain valid.( S; ^& S$ `1 A7 @# R6 Q6 n- f- j
Article 18- q7 \7 Q2 W7 z/ h
This Law shall come into force on the day of its promulgation.
