% L7 C/ V9 K8 L3 D9 D- Q 第一条   中华人民共和国国籍的取得、丧失和恢复,都适用本法。
9 B2 O( y5 Z6 O+ ?  f" L+ V    第二条   中华人民共和国是统一的多民族的国家,各民族的人都具有中国国籍。
" r/ I+ P. J7 l' o- J    第三条    中华人民共和国不承认中国公民具有双重国籍。1 c* j, v/ q$ X" P# K- Y3 W
    第四条   父母双方或一方为中国公民,本人出生在中国,具有中国国籍。
3 r: [. y1 P  y2 T: }' e    第五条   父母双方或一方为中国公民,本人出生在外国,具有中国国籍;但父母双方或一方为中国公民并定居在外国,本人出生时即具有外国国籍的,不具有中国国籍。
/ |$ Q. n* h. n' z    第六条   父母无国籍或国籍不明,定居在中国,本人出生在中国,具有中国国籍。: H  g  l2 `3 g: T6 ?; F
    第七条   外国人或无国籍人,愿意遵守中国宪法和法律,并具有下列条件之一的,可以经申请批准加入中国国籍:7 s( M4 y/ q: B8 }. O: i2 c
    一、中国人的近亲属;( [2 R9 b1 q: K+ d2 \& S4 P
    二、定居在中国的;
' V2 x7 g4 ?! S1 c3 N0 D& g    三、有其它正当理由。
$ o$ H) |1 P# L( m; C    第八条   申请加入中国国籍获得批准的,即取得中国国籍;被批准加入中国国籍的,不得再保留外国国籍。' W) S6 T% b  ~. Z) k8 W. K/ c. x) I
    第九条    定居外国的中国公民,自愿加入或取得外国国籍的,即自动丧失中国国籍。
+ V  C1 G! B/ q. V    第十条    中国公民具有下列条件之一的,可以经申请批准退出中国国籍:6 H- N2 ]* ^+ o6 _! B% J. ~
    一、外国人的近亲属;$ E  w! s/ ^, f$ Z( b
    二、定居在外国的;
3 G' h- \' M) T) h1 a+ q    三、有其它正当理由。1 c) f. D; L9 p6 F/ ^
    第十一条    申请退出中国国籍获得批准的,即丧失中国国籍。9 o; d/ h' d! }8 Q
    第十二条   国家工作人员和现役军人,不得退出中国国籍。
, x& x3 b- N2 i! J3 X    第十三条   曾有过中国国籍的外国人,具有正当理由,可以申请恢复中国国籍;被批准恢复中国国籍的,不得再保留外国国籍。
4 A3 z. Q1 ^! b    第十四条   中国国籍的取得、丧失和恢复,除第九条规定的以外,必须办理申请手续。未满十八周岁的人,可由其父母或其他法定代理人代为办理申请。0 {# G' E1 f; m7 _9 v
    第十五条    受理国籍申请的机关,在国内为当地市、县公安局,在国外为中国外交代表机关和领事机关。5 b* M0 D# h* U2 w
    第十六条   加入、退出和恢复中国国籍的申请,由中华人民共和国公安部审批。经批准的,由公安部发给证书。
4 M9 u+ F3 @  N: {    第十七条   本法公布前,已经取得中国国籍的或已经丧失中国国籍的,继续有效。7 t0 u3 J2 u: m8 k0 o0 u6 I
    第十八条   本法自公布之日起施行。

Article 1$ z1 c/ U& T+ v- z3 l
This Law is  applicable  to  the  acquisition,  loss  and  restoration  of
; H- I6 I- A# w$ l$ ?$ \nationality of the People''s Republic of China., Y5 A% N( u% S, C- v! u  g" n
Article 2
) @2 R/ @* E$ a& d$ L$ DThe People''s Republic of China is a unitary multinational  state;  persons+ \( g0 k! ?7 D( g/ K; t/ r6 i
belonging to  any  of  the  nationalities  in  China  shall  have  Chinese
+ @( b9 ]* d# x9 wnationality.2 e3 w4 v8 ]6 c+ d
Article 3
* P! M% j* t  a) v  MThe People''s Republic of China does not recognize dual nationality for any
  [3 R9 D4 M" }5 DChinese national.  Z: m9 ~7 ?$ }  D; H& b
Article 41 c1 A% k- Z0 ^6 V/ Y
Any person born in China whose parents are both Chinese nationals  or  one5 Q  b* S1 m4 V6 D  h  W
of whose parents is a Chinese national shall have Chinese nationality., w- r! [) n) k3 A5 Q) \& V8 f5 T
Article 5
3 [2 y: d2 t/ |) W* T; i; JAny person born abroad whose parents are both Chinese nationals or one  of2 y+ ]" T1 a1 p. }2 E1 E. G; U
whose parents is a Chinese national shall have Chinese nationality. But  a! W. B9 W% y2 m* L# K2 P  D# O8 X
person whose parents are both Chinese  nationals  and  have  both  settled0 q  f4 ?( A6 n3 e4 X1 B
abroad, or one of whose parents is a  Chinese  national  and  has  settled
( L5 d' x& \" Zabroad, and who has acquired foreign nationality at birth shall  not  have
9 n' a& |" _2 B: l) N2 I( o" D" |Chinese nationality.9 H; O# J) q& ^  u( ]# [
Article 6
$ o* g/ r1 |  O# t( P! i- ZAny person born in China whose  parents  are  stateless  or  of  uncertain
2 I6 v3 Q( m. k. A9 Y+ [2 K0 u0 ]nationality and have settled in China shall have Chinese nationality.
, \2 q9 _0 H- F: X) K- `* F% OArticle 7( D4 K1 u& X) B
Foreign nationals or stateless persons who are willing to abide by China''s8 {) u' F4 g8 [# e1 C
Constitution and laws and who meet one of the following conditions may  be4 R9 T( }( o$ ?$ C1 o' f
naturalized upon approval of their applications:+ |/ P; E4 @7 g0 B: e( `' G3 u
(1) they are near relatives of Chinese nationals;7 {, }5 X, X0 c5 V, ~- Z
(2) they have settled in China; or
% N+ v/ V7 C6 Q5 A' i5 C+ }(3) they have other legitimate reasons.
! h7 O0 m8 W; j1 i" W  A# JArticle 8' O, M3 U/ ~) i3 X
Any person who applies for naturalization  as  a  Chinese  national  shall
# e& d$ {: Z3 I5 \acquire Chinese nationality upon approval of  his  application;  a  person
* R  M* U9 M- X! \0 z$ L# S( Qwhose application for  naturalization  as  a  Chinese  national  has  been
( f$ t4 i+ y/ z4 R3 b+ happroved shall not retain foreign nationality.7 L; S8 j8 T: J$ w0 _+ \
Article 9$ c, b( n, x; z# M# D! R" {2 N6 w( }
Any Chinese national who has settled abroad and who has  been  naturalized6 V7 }5 ~9 }- O
as a foreign national or has acquired foreign nationality of his own  free2 j9 J# x; C/ T% B$ I+ J
will shall automatically lose Chinese nationality.
* t8 j! N+ x: d  a6 O# xArticle 10$ j, g* N8 f  C, F$ J
Chinese nationals who meet one of the following  conditions  may  renounce
  Q! K4 Q# I# p9 NChinese nationality upon approval of their applications:
1 c& M% ?& i9 K; g(1) they are near relatives of foreign nationals;  W/ H% d2 l+ [& l2 q6 K
(2) they have settled abroad; or
- I1 E3 W5 M9 [, ^( T" y+ j(3) they have other legitimate reasons.' x& |1 ^' K, f" T" D0 \* i- E
Article 11- f+ Z/ f) D0 w  ~9 i
Any person who applies for renunciation of Chinese nationality shall  lose; q, Q- m6 P. q0 }  D
Chinese nationality upon approval of his application.
- m( {) Q+ ?! d/ ^Article 12+ _2 {( j4 T& L
State functionaries and military personnel on  active  service  shall  not2 M# ]  s% g  P$ ~) z
renounce Chinese nationality.7 g. D' P; v, Z" l5 Q9 ^, u# O9 c: j
Article 13
( K: l. G9 X, y+ e" J3 U7 O% C5 JForeign  nationals  who  once  held  Chinese  nationality  may  apply  for/ l, }$ T0 [: W3 F' h/ I5 m0 z
restoration of Chinese nationality if they have legitimate reasons;  those
& |  o; |2 ~; X6 @" ?whose applications  for  restoration  of  Chinese  nationality  have  been
, W3 w! I% N1 G6 uapproved shall not retain foreign nationality.
" [6 C. Q7 z( o7 j1 oArticle 14
8 i7 y- T/ D5 z/ xPersons who wish to acquire, renounce or restore Chinese nationality, with
: t4 v! D6 k7 W# ]$ r; Zthe exception of the cases provided for in Article 9, shall go through the
# Y' |( Q1 t- F* H- e% eformalities of application.  Applications of persons under the age  of  18
, \' d2 h4 o. bmay  be  filed  on  their  behalf  by  their  parents   or   other   legal
. B( Y2 @2 m9 Q; s7 a1 Frepresentatives., f2 y9 S% A* d4 D3 @3 b  f
Article 15- i+ P* J9 }/ N6 D0 H9 r
Nationality applications at home shall be handled by the  public  security, v6 u) ?9 [. R
bureaus of the municipalities or counties where the applicants reside;
) ~4 b5 w/ D4 S) q; Hnationality applications abroad shall be  handled  by  China''s  diplomatic
6 _; ?. r. k: Trepresentative agencies and consular offices.# ], P: z2 i, y  P
Article 16
* }7 p" K* h7 ?5 \% LApplications for naturalization as Chinese nationals and for  renunciation
2 q0 f( u+ C% @/ V" mor restoration of Chinese  nationality  are  subject  to  examination  and6 X' C  @7 Z% `
approval by the Ministry of Public Security of the  People''s  Republic  of
; L' x' c  j8 L; p1 u' ^. MChina. The Ministry of Public Security shall issue a  certificate  to  any  u( W+ B) _* G* S+ g
person whose application has been approved.4 }) T- ]9 j. f* Q& D: R) C
Article 17% g4 V! `$ d. O% J3 n. ~# s- h
The nationality status of  persons  who  have  acquired  or  lost  Chinese* O  F% K" L% {2 V; u3 c- _/ z- X
nationality before the promulgation of this Law shall remain valid.
- \# }/ X0 B7 ?1 LArticle 18# H$ u3 ^9 S2 F+ C, A
This Law shall come into force on the day of its promulgation.
