  " |( M- k! M$ v* Y9 Z
第一条   中华人民共和国国籍的取得、丧失和恢复,都适用本法。# s2 ^. e( D  `3 m1 B
    第二条   中华人民共和国是统一的多民族的国家,各民族的人都具有中国国籍。
0 P7 b$ e5 u1 O; Q8 d    第三条    中华人民共和国不承认中国公民具有双重国籍。
7 |) ^' C$ w  i8 K$ v2 V' y4 r! w    第四条   父母双方或一方为中国公民,本人出生在中国,具有中国国籍。
" f3 A0 a& n- X! {; E8 y6 M    第五条   父母双方或一方为中国公民,本人出生在外国,具有中国国籍;但父母双方或一方为中国公民并定居在外国,本人出生时即具有外国国籍的,不具有中国国籍。+ f6 P% [# o1 v, l. a
    第六条   父母无国籍或国籍不明,定居在中国,本人出生在中国,具有中国国籍。! U$ e/ g% z& e1 n. K0 N5 x. i" x
    第七条   外国人或无国籍人,愿意遵守中国宪法和法律,并具有下列条件之一的,可以经申请批准加入中国国籍:
: p* G% c  R. u" }/ K- h    一、中国人的近亲属;  v2 i2 J+ g% a0 L4 o
    二、定居在中国的;1 D) |* e( A$ Y/ ?
    三、有其它正当理由。. u; u3 g- R& W0 c. V2 _
    第八条   申请加入中国国籍获得批准的,即取得中国国籍;被批准加入中国国籍的,不得再保留外国国籍。
; G+ a1 Z' W6 ^# I, o1 Q    第九条    定居外国的中国公民,自愿加入或取得外国国籍的,即自动丧失中国国籍。6 ~0 P3 t3 r  |- _2 F3 k7 H
    第十条    中国公民具有下列条件之一的,可以经申请批准退出中国国籍:
5 J9 @$ K% |, B; S5 t5 Z    一、外国人的近亲属;/ z: F% }/ r/ a/ g
    二、定居在外国的;
" _& B- y0 Y  y  H" R7 q$ ?    三、有其它正当理由。. J3 |7 W' j% F( \' r$ t
    第十一条    申请退出中国国籍获得批准的,即丧失中国国籍。' ]" d$ j- Y0 k! P- x& K
    第十二条   国家工作人员和现役军人,不得退出中国国籍。- l, G* C" @8 J% K$ v+ s
    第十三条   曾有过中国国籍的外国人,具有正当理由,可以申请恢复中国国籍;被批准恢复中国国籍的,不得再保留外国国籍。
1 _! D% U9 p0 M2 F$ X    第十四条   中国国籍的取得、丧失和恢复,除第九条规定的以外,必须办理申请手续。未满十八周岁的人,可由其父母或其他法定代理人代为办理申请。
; G1 |% s1 G' {    第十五条    受理国籍申请的机关,在国内为当地市、县公安局,在国外为中国外交代表机关和领事机关。% B8 {# M! k! e" w8 N! g  _
    第十六条   加入、退出和恢复中国国籍的申请,由中华人民共和国公安部审批。经批准的,由公安部发给证书。
7 a3 Z, R; X! U; R    第十七条   本法公布前,已经取得中国国籍的或已经丧失中国国籍的,继续有效。1 ~; o1 G7 g; t9 S% y- I
    第十八条   本法自公布之日起施行。; t$ }. }' U: [3 Z

Article 1
. h/ p1 l9 R: x' P* p8 C$ HThis Law is  applicable  to  the  acquisition,  loss  and  restoration  of- U1 Y6 @  J/ a! f
nationality of the People''s Republic of China.
0 E( f6 P* w: v& D1 N) j7 n2 ^Article 2
! q) d: E, P; h8 [. ?% gThe People''s Republic of China is a unitary multinational  state;  persons: {$ m9 x6 K2 U: n0 y2 l$ k6 [
belonging to  any  of  the  nationalities  in  China  shall  have  Chinese3 D/ C* y' E5 X" X0 h, l) u
nationality.
" D& w  L+ p4 B) X( AArticle 3" ~$ c, a% h9 X$ X" r5 H
The People''s Republic of China does not recognize dual nationality for any- M0 J. K2 l4 I, t
Chinese national.
  V1 Q" k4 F4 zArticle 4  I( F, n5 `& ^4 n
Any person born in China whose parents are both Chinese nationals  or  one
6 B3 P/ X0 D8 `4 [1 r8 N7 \( W( Bof whose parents is a Chinese national shall have Chinese nationality.
- Y# o; q- f/ v$ s  l8 I  t3 \Article 5
  C# i' ~/ ^; [$ J2 y2 MAny person born abroad whose parents are both Chinese nationals or one  of+ m% m5 {6 A! A2 i0 @; R( C0 k
whose parents is a Chinese national shall have Chinese nationality. But  a+ Q7 _# G' u7 @
person whose parents are both Chinese  nationals  and  have  both  settled
! t- i7 E$ n- f: Jabroad, or one of whose parents is a  Chinese  national  and  has  settled
: Y6 u: A, C+ q; Yabroad, and who has acquired foreign nationality at birth shall  not  have1 u* u, P6 j" }: }7 A) P5 Z  }
Chinese nationality.
, U) K" m7 n: l' [Article 64 v- i+ N+ k2 b' O# p
Any person born in China whose  parents  are  stateless  or  of  uncertain% J* p7 q* T! o- U; i- y% n: R
nationality and have settled in China shall have Chinese nationality.
6 u9 g* i1 C% n9 F4 H! rArticle 7  `/ ]; R9 h2 e* w6 J# D
Foreign nationals or stateless persons who are willing to abide by China''s: a2 ]0 ?% a% L2 q* D% {
Constitution and laws and who meet one of the following conditions may  be
# \; a. ^1 J( G; ynaturalized upon approval of their applications:
( y' t3 D7 E8 K* a* `(1) they are near relatives of Chinese nationals;
( s, ]: p+ j( C5 V(2) they have settled in China; or6 n/ O7 r) ]( p
(3) they have other legitimate reasons.& \  q* V5 z: U& x- V  x
Article 8
9 `! J  l5 M; \- a, FAny person who applies for naturalization  as  a  Chinese  national  shall
0 C' `  z  N5 n" wacquire Chinese nationality upon approval of  his  application;  a  person! t9 L: f$ c1 O4 ~+ w6 m) v8 R
whose application for  naturalization  as  a  Chinese  national  has  been0 G! j7 x& W7 {' D% k. {; ?2 h
approved shall not retain foreign nationality.
6 h/ `( @1 {- ]8 n9 f/ B5 kArticle 9" D7 o! i7 k& m0 |) l8 w4 y& M
Any Chinese national who has settled abroad and who has  been  naturalized
7 M+ U$ I5 O- ]as a foreign national or has acquired foreign nationality of his own  free: X% u$ m% {1 j# e; C8 k6 |* P7 ]
will shall automatically lose Chinese nationality.; k, P( i5 h2 l
Article 10
% v: v/ |$ j) e$ f' UChinese nationals who meet one of the following  conditions  may  renounce% |6 R4 o3 [6 A' A9 ?
Chinese nationality upon approval of their applications:$ T: p+ _" [( M5 D, `3 p! J( z  w
(1) they are near relatives of foreign nationals;
# H5 \2 _" b* v3 z: `(2) they have settled abroad; or' m* s- e4 B+ T7 p4 o# _& U
(3) they have other legitimate reasons.  B) }! H- f" C9 m  Q3 Y( V( {
Article 11+ Q# K% O0 Q: Z  G* Y; V
Any person who applies for renunciation of Chinese nationality shall  lose9 o0 u$ h3 C/ k
Chinese nationality upon approval of his application.
/ L6 G2 [7 f2 o) M) uArticle 12! i. w9 g$ S! \# Z& R
State functionaries and military personnel on  active  service  shall  not
9 P4 U5 H9 i* W# jrenounce Chinese nationality.
1 k( b5 Z# m  |Article 13
- G" L2 p- G" o+ mForeign  nationals  who  once  held  Chinese  nationality  may  apply  for
: Z( [; R; y' q$ o. t$ L* `, Zrestoration of Chinese nationality if they have legitimate reasons;  those
" N) |) n: s& E0 mwhose applications  for  restoration  of  Chinese  nationality  have  been7 v" x+ I) U9 Q: o  _
approved shall not retain foreign nationality.8 R) |7 o. @4 ?  @& x. I, v2 W
Article 14
; z5 j- c+ Y# [! ]1 l- z! A- [Persons who wish to acquire, renounce or restore Chinese nationality, with
- ]9 Y4 O! {9 d" D1 Mthe exception of the cases provided for in Article 9, shall go through the' e) ^# `$ Y5 Z8 s* A# P- b( n
formalities of application.  Applications of persons under the age  of  18
, W% ?8 M2 a; Y- n) ?: {- K0 m! Dmay  be  filed  on  their  behalf  by  their  parents   or   other   legal# F; z$ o6 G: N+ T2 D  ?) b% u
representatives.2 ^7 c  G/ j7 E# `6 j. y$ b# K
Article 15
6 t7 m  B8 n5 c8 _% ^: L( zNationality applications at home shall be handled by the  public  security
3 L. j6 K/ G% s) k. tbureaus of the municipalities or counties where the applicants reside;
* f1 S- K  y" Qnationality applications abroad shall be  handled  by  China''s  diplomatic
7 ]$ _9 r- w' Hrepresentative agencies and consular offices.+ L3 R- N/ A6 ?6 |; n6 p. i' R, Q
Article 16
) |" W% E2 ~3 X2 K6 ^Applications for naturalization as Chinese nationals and for  renunciation; Q+ q: u0 M- l$ h
or restoration of Chinese  nationality  are  subject  to  examination  and+ f  n. X' ~: F  \3 x
approval by the Ministry of Public Security of the  People''s  Republic  of% O# f7 g0 n5 r! |
China. The Ministry of Public Security shall issue a  certificate  to  any3 G7 S( ~" y- L9 ?1 z* y! D4 k9 R
person whose application has been approved.
" m8 j2 q! q/ g- UArticle 176 ?9 P8 [9 G) y# x" y7 B+ v
The nationality status of  persons  who  have  acquired  or  lost  Chinese
" M/ _& c$ s) Xnationality before the promulgation of this Law shall remain valid.
3 @( Z8 S/ h5 ?; T! BArticle 18
% S$ }1 {, E* m' V8 W# qThis Law shall come into force on the day of its promulgation.
