《中华人民共和国国籍法》 7 u( V8 F; g3 i, R* V. G4 I
( v; A6 s5 k7 e& a" n* V 第一条 中华人民共和国国籍的取得、丧失和恢复,都适用本法。
+ r0 O2 g3 n& m5 F* r 第二条 中华人民共和国是统一的多民族的国家,各民族的人都具有中国国籍。
& W b6 X9 m0 { J& D& u( p2 p 第三条 中华人民共和国不承认中国公民具有双重国籍。
3 g; v" N+ c/ A" J9 m1 { 第四条 父母双方或一方为中国公民,本人出生在中国,具有中国国籍。
2 C9 n) m: U2 T) v 第五条 父母双方或一方为中国公民,本人出生在外国,具有中国国籍;但父母双方或一方为中国公民并定居在外国,本人出生时即具有外国国籍的,不具有中国国籍。% { ~- j& H+ f8 F9 d. @/ z: ~
第六条 父母无国籍或国籍不明,定居在中国,本人出生在中国,具有中国国籍。/ z7 j: c/ p- a. ?& E4 Z6 u
第七条 外国人或无国籍人,愿意遵守中国宪法和法律,并具有下列条件之一的,可以经申请批准加入中国国籍:& P% V9 E" |; u3 g
一、中国人的近亲属;$ e1 j0 K4 ]5 m
二、定居在中国的;
% {1 w6 ?( m& k7 b/ ] 三、有其它正当理由。9 V% G, w# v) \+ o/ j; J) O7 Z8 ~
第八条 申请加入中国国籍获得批准的,即取得中国国籍;被批准加入中国国籍的,不得再保留外国国籍。
/ B }$ T; @: K& j, H( `" x 第九条 定居外国的中国公民,自愿加入或取得外国国籍的,即自动丧失中国国籍。" N' q3 r3 r. j0 z) s5 h# W& `& d3 G
第十条 中国公民具有下列条件之一的,可以经申请批准退出中国国籍:

5 G- t! p8 u0 _* b, r- k7 f! @ 二、定居在外国的;# \) q, H# }0 G! }; Q
三、有其它正当理由。
5 D) U- x& @0 N/ F 第十一条 申请退出中国国籍获得批准的,即丧失中国国籍。
D6 J$ e! g* b- R$ [ 第十二条 国家工作人员和现役军人,不得退出中国国籍。8 O1 A- M/ e) c2 S: F. P3 S; o
第十三条 曾有过中国国籍的外国人,具有正当理由,可以申请恢复中国国籍;被批准恢复中国国籍的,不得再保留外国国籍。
. ^1 y. j9 ?2 D& n7 @2 @0 V8 v: @* a 第十四条 中国国籍的取得、丧失和恢复,除第九条规定的以外,必须办理申请手续。未满十八周岁的人,可由其父母或其他法定代理人代为办理申请。
% d$ i7 _8 Z+ a+ p5 q2 ?, k( {9 s; x 第十五条 受理国籍申请的机关,在国内为当地市、县公安局,在国外为中国外交代表机关和领事机关。+ I- p/ S+ x7 j) J. s! ?
第十六条 加入、退出和恢复中国国籍的申请,由中华人民共和国公安部审批。经批准的,由公安部发给证书。: ~ A% c9 B) @# a
第十七条 本法公布前,已经取得中国国籍的或已经丧失中国国籍的,继续有效。

This Law is applicable to the acquisition, loss and restoration of
8 J4 b& b" F7 a( @- w3 ynationality of the People''s Republic of China.

The People''s Republic of China is a unitary multinational state; persons
" P5 I( N' i* R6 g. V X6 Lbelonging to any of the nationalities in China shall have Chinese

The People''s Republic of China does not recognize dual nationality for any

Article 4

1 \8 s- @ x1 D3 Oof whose parents is a Chinese national shall have Chinese nationality.

whose parents is a Chinese national shall have Chinese nationality. But a
0 G4 v2 [5 {8 e5 q, e! t& G: r* {7 Zperson whose parents are both Chinese nationals and have both settled
^3 R+ S T9 @" J7 O. B/ _; oabroad, or one of whose parents is a Chinese national and has settled
; C2 s9 g& D* q |; a' ?0 labroad, and who has acquired foreign nationality at birth shall not have

Any person born in China whose parents are stateless or of uncertain
' x5 S/ J! j& E+ anationality and have settled in China shall have Chinese nationality.

$ y/ L7 N* Y8 K' p5 }% RForeign nationals or stateless persons who are willing to abide by China''s
% a+ j" }& v! @* _* k/ U K/ |: t) IConstitution and laws and who meet one of the following conditions may be
7 m( m- d" V- q# w' r0 Inaturalized upon approval of their applications:
' C. c( n- U9 r. j) ^8 Y$ n4 S$ C(1) they are near relatives of Chinese nationals;6 I0 u( M2 v4 ]: r, D( j3 A
(2) they have settled in China; or
1 e6 V# v# m' ^/ C6 a% f1 v; l; l(3) they have other legitimate reasons.

Any person who applies for naturalization as a Chinese national shall
9 v( r0 A3 C% X9 macquire Chinese nationality upon approval of his application; a person
1 A6 K, F' G1 W/ X/ lwhose application for naturalization as a Chinese national has been( h" C8 t- h4 \5 y
approved shall not retain foreign nationality.
1 ?9 ~: N$ s/ ~8 wArticle 9) l+ P- M$ m9 y7 ^! u
Any Chinese national who has settled abroad and who has been naturalized
. V& p2 a- g& Y" F$ H3 Zas a foreign national or has acquired foreign nationality of his own free
* X3 ^# t1 m; Q2 B4 m; `# {will shall automatically lose Chinese nationality.

Chinese nationals who meet one of the following conditions may renounce# O. O% t6 m3 I& {
Chinese nationality upon approval of their applications:
. y) j. @1 e8 ~& w. m2 K1 H4 L(1) they are near relatives of foreign nationals;8 b" K- z9 R5 `* c8 N
(2) they have settled abroad; or
7 M7 M0 {* ?8 M9 `) K- v: n(3) they have other legitimate reasons.

Any person who applies for renunciation of Chinese nationality shall lose
/ w, r7 f4 F+ i& r \7 c ^Chinese nationality upon approval of his application. U- ]1 @/ |# ^$ x
Article 126 r0 k4 B/ K5 h+ ^
State functionaries and military personnel on active service shall not, d# `3 g) ?$ U' ] n. N
renounce Chinese nationality.

2 _' \( Z6 H8 NForeign nationals who once held Chinese nationality may apply for
! g1 E* n! o8 e6 wrestoration of Chinese nationality if they have legitimate reasons; those5 X1 ?, K* N1 }% ~1 R$ a
whose applications for restoration of Chinese nationality have been
& ?7 Y) B0 @. t+ }- fapproved shall not retain foreign nationality.! [$ K% i6 h& [; o: p
Article 14' `5 P/ m+ a+ A) ]% V* Y, m8 O
Persons who wish to acquire, renounce or restore Chinese nationality, with5 C. J' f$ K9 K) E/ S6 z1 Q
the exception of the cases provided for in Article 9, shall go through the
% v$ l5 G7 u1 K. i# Z9 cformalities of application. Applications of persons under the age of 18
. L% e/ F( d# Amay be filed on their behalf by their parents or other legal
1 {8 B; `9 _. U! m+ `* Trepresentatives.6 X( H: h! t9 W( M& z
Article 158 k& C; [2 M2 {+ d6 W& a
Nationality applications at home shall be handled by the public security
1 a; t! c$ x: _0 _2 r& pbureaus of the municipalities or counties where the applicants reside;
0 i) O" d! l Nnationality applications abroad shall be handled by China''s diplomatic' ` N' a( v4 ^& x% h5 y* O
representative agencies and consular offices.6 B1 H+ P# {! B1 w" |
Article 16
) P8 B! r5 {& H$ k' `Applications for naturalization as Chinese nationals and for renunciation6 W7 k1 i* L4 v, E7 |1 E
or restoration of Chinese nationality are subject to examination and8 ~9 {, n* _4 d( F) i
approval by the Ministry of Public Security of the People''s Republic of
" [! _( M K0 K+ q) L$ X6 hChina. The Ministry of Public Security shall issue a certificate to any
3 n) l6 B; q* C$ Rperson whose application has been approved.$ U: |, O5 r/ w% U
Article 17
: {+ z/ ?9 d1 R) @. VThe nationality status of persons who have acquired or lost Chinese
2 H& N- C2 g9 e0 K( qnationality before the promulgation of this Law shall remain valid.9 ?& q: m% T' S! ^# B( B A
Article 18! \+ \& |% c' E: J3 }7 `4 Q
This Law shall come into force on the day of its promulgation. |
