第一条 中华人民共和国国籍的取得、丧失和恢复,都适用本法。
! p& Q1 ]4 I) u) F 第二条 中华人民共和国是统一的多民族的国家,各民族的人都具有中国国籍。
' W2 n) ?) @/ G* K3 r/ |8 l/ i 第三条 中华人民共和国不承认中国公民具有双重国籍。( Q. h1 I) I- t+ d0 r, Y% s
第四条 父母双方或一方为中国公民,本人出生在中国,具有中国国籍。3 Q; W) C& b p9 T
第五条 父母双方或一方为中国公民,本人出生在外国,具有中国国籍;但父母双方或一方为中国公民并定居在外国,本人出生时即具有外国国籍的,不具有中国国籍。
/ H2 x7 M& G% I7 f" u4 g, | 第六条 父母无国籍或国籍不明,定居在中国,本人出生在中国,具有中国国籍。
7 ^7 o# d5 J+ T, m" L 第七条 外国人或无国籍人,愿意遵守中国宪法和法律,并具有下列条件之一的,可以经申请批准加入中国国籍: z/ f9 j' C7 R3 {* n: d/ q! J! g
一、中国人的近亲属;
! F7 H% _! O9 r5 l 二、定居在中国的;
) ?- y- ]% z5 R4 ?# S/ w 三、有其它正当理由。2 V0 I7 h6 x* k$ ?; O& F! t( x
第八条 申请加入中国国籍获得批准的,即取得中国国籍;被批准加入中国国籍的,不得再保留外国国籍。! t' k: H5 i2 {4 M" G1 U
第九条 定居外国的中国公民,自愿加入或取得外国国籍的,即自动丧失中国国籍。% ^! W9 f8 H% @& A
第十条 中国公民具有下列条件之一的,可以经申请批准退出中国国籍:
b- C: J7 C$ E5 O4 Y8 P$ v! x 一、外国人的近亲属;1 M5 x9 m/ ]. m3 r7 D2 v p8 O
二、定居在外国的;8 u) y: f0 a3 ~, r- J6 l3 v9 M

第十一条 申请退出中国国籍获得批准的,即丧失中国国籍。
8 s& V R8 P% L$ ]" P9 P, m0 g6 Y' i 第十二条 国家工作人员和现役军人,不得退出中国国籍。
G1 w& _4 Z7 M' ~ 第十三条 曾有过中国国籍的外国人,具有正当理由,可以申请恢复中国国籍;被批准恢复中国国籍的,不得再保留外国国籍。3 ?6 ?8 m ^" Y# u+ {9 M
第十四条 中国国籍的取得、丧失和恢复,除第九条规定的以外,必须办理申请手续。未满十八周岁的人,可由其父母或其他法定代理人代为办理申请。

第十六条 加入、退出和恢复中国国籍的申请,由中华人民共和国公安部审批。经批准的,由公安部发给证书。5 }# F+ G1 N$ |) l% |0 w
第十七条 本法公布前,已经取得中国国籍的或已经丧失中国国籍的,继续有效。

6 A( [7 l( K0 I6 UThis Law is applicable to the acquisition, loss and restoration of

The People''s Republic of China is a unitary multinational state; persons6 v( o0 O6 L' Y4 p0 v

Article 5
1 y( t+ ]) n# t' q3 Z4 {# l1 eAny person born abroad whose parents are both Chinese nationals or one of, z7 n' i, ~$ z2 S3 V- o
whose parents is a Chinese national shall have Chinese nationality. But a' q' T- M9 E+ v4 Q, ]0 U' u0 L
person whose parents are both Chinese nationals and have both settled, [( _: z! _8 R. f, w
abroad, or one of whose parents is a Chinese national and has settled

Chinese nationality.

Any person born in China whose parents are stateless or of uncertain! ~0 b5 `0 c$ [7 A9 L* K
nationality and have settled in China shall have Chinese nationality.

Foreign nationals or stateless persons who are willing to abide by China''s
2 O: z/ V5 h/ R5 c, v lConstitution and laws and who meet one of the following conditions may be

: A9 U' ?7 ?$ D* A4 b$ m% t. N(1) they are near relatives of Chinese nationals;

(3) they have other legitimate reasons.

# i d2 W/ T u5 SAny person who applies for naturalization as a Chinese national shall
$ o: @2 {2 i* n/ V0 S0 P7 J5 Nacquire Chinese nationality upon approval of his application; a person# t2 p9 Z/ V& O' B% v
whose application for naturalization as a Chinese national has been
- U- ]9 U A1 b0 C# a. |approved shall not retain foreign nationality.4 n8 I) ]! L1 S$ i" T
Article 9
! Q* C; @5 s4 W! k, [. V+ sAny Chinese national who has settled abroad and who has been naturalized9 ^1 z9 g* R- s) r- ^
as a foreign national or has acquired foreign nationality of his own free
, p; B7 Y& m+ S9 k twill shall automatically lose Chinese nationality.
, ^1 \ _% I$ e) I6 fArticle 10" t# Q) Q# _6 p$ X8 H) U
Chinese nationals who meet one of the following conditions may renounce
4 e/ K- }$ M) LChinese nationality upon approval of their applications:) `" P* v' z1 q! R' |
(1) they are near relatives of foreign nationals;8 @4 Y* x9 Y0 [2 X7 K7 g
(2) they have settled abroad; or6 t& @, ~4 E9 h' m
(3) they have other legitimate reasons.

& H: N/ {% q+ Y8 V/ u, c1 qAny person who applies for renunciation of Chinese nationality shall lose
% K( B; @8 i$ L; z/ s, i+ F \; @1 WChinese nationality upon approval of his application.
+ Y0 ~7 s) L# _, Q2 b) M& X( @Article 12( H8 q; {9 C# s) p1 g
State functionaries and military personnel on active service shall not
1 l2 R) S# d/ W( Prenounce Chinese nationality.4 n5 R5 _$ _1 L5 W& K% I
Article 13' g. d4 d J3 d4 V3 Q( t
Foreign nationals who once held Chinese nationality may apply for* e1 j( `; ?4 \
restoration of Chinese nationality if they have legitimate reasons; those3 j) {6 y! ^! ]+ {' O$ j. w
whose applications for restoration of Chinese nationality have been
# ~0 w0 @% H, C }7 e& T* kapproved shall not retain foreign nationality.
8 u. [* W9 |+ J% mArticle 144 u! P! ]0 C1 o; V' {
Persons who wish to acquire, renounce or restore Chinese nationality, with* `. [7 x$ t5 B+ G* K6 Q
the exception of the cases provided for in Article 9, shall go through the
( I9 ^% Z! y3 [5 W; b+ r" k8 \formalities of application. Applications of persons under the age of 18
0 G5 n [( m" emay be filed on their behalf by their parents or other legal1 ~% ^7 y3 B+ H# i. z4 `
representatives.

/ ?$ y9 |' x' N7 yNationality applications at home shall be handled by the public security
+ v3 y$ n& {. qbureaus of the municipalities or counties where the applicants reside;3 [; S" B2 w4 x- K
nationality applications abroad shall be handled by China''s diplomatic
8 M* n5 b* V; \- C n: y! u" brepresentative agencies and consular offices.2 e. b% l6 q/ T4 O$ j6 ]' @8 H
Article 162 E! P. J& u A2 U
Applications for naturalization as Chinese nationals and for renunciation
1 t5 L1 D6 _/ P5 u/ I8 Nor restoration of Chinese nationality are subject to examination and
& e5 A! n, G. ^! A' c9 K- mapproval by the Ministry of Public Security of the People''s Republic of
( M7 i+ }; V4 B" y8 w5 Z. D# jChina. The Ministry of Public Security shall issue a certificate to any
& Z2 S, q% ~/ m9 h% z5 Qperson whose application has been approved.

The nationality status of persons who have acquired or lost Chinese' \7 B' U) d8 q8 s; S
nationality before the promulgation of this Law shall remain valid.
