第一条 中华人民共和国国籍的取得、丧失和恢复,都适用本法。
/ q; t( o+ T" H% \ 第二条 中华人民共和国是统一的多民族的国家,各民族的人都具有中国国籍。
! D; t* j9 i2 ]6 x0 | 第三条 中华人民共和国不承认中国公民具有双重国籍。
% H# F$ z3 J. J 第四条 父母双方或一方为中国公民,本人出生在中国,具有中国国籍。
1 r# L1 Q. p2 v8 K; t 第五条 父母双方或一方为中国公民,本人出生在外国,具有中国国籍;但父母双方或一方为中国公民并定居在外国,本人出生时即具有外国国籍的,不具有中国国籍。( y5 a3 J) j& d, N# F4 V& F
第六条 父母无国籍或国籍不明,定居在中国,本人出生在中国,具有中国国籍。: [# V, G: H6 w2 K. A6 U, A$ P3 \
第七条 外国人或无国籍人,愿意遵守中国宪法和法律,并具有下列条件之一的,可以经申请批准加入中国国籍:9 \7 E+ E1 g+ A! @1 m* V/ _+ K5 g
一、中国人的近亲属;# N( f$ Y# a7 D; |& D# t; E: \
二、定居在中国的;
8 e) X6 J- {' M 三、有其它正当理由。
J" y* C; K9 q! M* m* Z 第八条 申请加入中国国籍获得批准的,即取得中国国籍;被批准加入中国国籍的,不得再保留外国国籍。
0 F3 ?: a# d% ~( g* P9 R 第九条 定居外国的中国公民,自愿加入或取得外国国籍的,即自动丧失中国国籍。
2 H6 {' p' M- e7 D# y) b) N 第十条 中国公民具有下列条件之一的,可以经申请批准退出中国国籍:
6 P% X( ?; Z" j0 \% ]. G, \ 一、外国人的近亲属;( ?( d; p9 c: A9 a. U
二、定居在外国的;
# P7 I( k: V) y3 w9 r+ v/ J 三、有其它正当理由。
# i/ j) C& [5 C" V& l1 U; k. M/ S6 f 第十一条 申请退出中国国籍获得批准的,即丧失中国国籍。+ }$ k2 o4 x) }6 C! x
第十二条 国家工作人员和现役军人,不得退出中国国籍。0 Z' b5 I7 C& o3 T7 \* @: o2 i3 n
第十三条 曾有过中国国籍的外国人,具有正当理由,可以申请恢复中国国籍;被批准恢复中国国籍的,不得再保留外国国籍。- P1 U8 p/ W4 J! [$ @2 w5 S4 V
第十四条 中国国籍的取得、丧失和恢复,除第九条规定的以外,必须办理申请手续。未满十八周岁的人,可由其父母或其他法定代理人代为办理申请。: j6 a8 P, t8 D
第十五条 受理国籍申请的机关,在国内为当地市、县公安局,在国外为中国外交代表机关和领事机关。8 s# `8 x: M2 G
第十六条 加入、退出和恢复中国国籍的申请,由中华人民共和国公安部审批。经批准的,由公安部发给证书。

第十八条 本法自公布之日起施行。* X8 X' t; ~$ M6 _+ L% S' }

This Law is applicable to the acquisition, loss and restoration of
' J% f' D9 C6 F* n3 tnationality of the People''s Republic of China.
o# G& s% n% T, Y7 w! S4 CArticle 2
- }8 G- u" Q# F% {The People''s Republic of China is a unitary multinational state; persons
7 E9 {* D. `( j: O/ abelonging to any of the nationalities in China shall have Chinese# i2 C# ]" O6 m* b

The People''s Republic of China does not recognize dual nationality for any
/ f/ W% W- g5 S& I: ZChinese national.

# E! p+ L% i% p7 AAny person born in China whose parents are both Chinese nationals or one" u: y* ~0 v1 X+ a4 D
of whose parents is a Chinese national shall have Chinese nationality.

Any person born abroad whose parents are both Chinese nationals or one of
& y8 ]! u" k+ f2 b8 m! U& ewhose parents is a Chinese national shall have Chinese nationality. But a
7 m# D9 E/ P- q! q1 p$ _person whose parents are both Chinese nationals and have both settled
! @' A! D! X# xabroad, or one of whose parents is a Chinese national and has settled

Article 6
8 Z6 z* ~* y! J4 i, n& ~4 R7 @Any person born in China whose parents are stateless or of uncertain- O' `4 s ]% F
nationality and have settled in China shall have Chinese nationality.- I3 W9 s8 ~% w0 {
Article 75 f# I$ R/ s0 H. N* Q5 G a# s. a0 p
Foreign nationals or stateless persons who are willing to abide by China''s
6 p" E2 z8 v6 _$ yConstitution and laws and who meet one of the following conditions may be% e- ?: k h! P0 O* E$ h; R! O# W
naturalized upon approval of their applications:! g' f& G, |1 k
(1) they are near relatives of Chinese nationals;: V/ M* W, N7 S8 h
(2) they have settled in China; or
7 W y& h/ }& S/ X(3) they have other legitimate reasons. M, l7 l7 z6 x9 J/ q! }
Article 87 `- d. F* w* H& s2 o# _7 t! I
Any person who applies for naturalization as a Chinese national shall4 z& V7 z- K# u g) O3 A
acquire Chinese nationality upon approval of his application; a person
5 n7 a4 U3 `! a* T& z G0 @whose application for naturalization as a Chinese national has been1 c4 O3 G8 e5 V4 f: R! A5 R0 {
approved shall not retain foreign nationality.7 f- M L, n! D" {" g; Z$ R/ W
Article 9
+ ^: R- q8 o4 M- S( D6 l& wAny Chinese national who has settled abroad and who has been naturalized; F7 u+ A6 B; \$ K% j, A
as a foreign national or has acquired foreign nationality of his own free
- G+ D! r3 Q* X: q; v3 t( O" {will shall automatically lose Chinese nationality.- K4 O# y: k. c1 C. A7 Q0 V
Article 103 p' R8 B# u) n7 i; X
Chinese nationals who meet one of the following conditions may renounce% y" \' Q/ r! u) y- R
Chinese nationality upon approval of their applications:- m" ?+ z( k: ]8 a8 B4 G
(1) they are near relatives of foreign nationals;
1 L) K: O6 V# \) J/ ]6 T(2) they have settled abroad; or
0 z t y, m! D& K4 |(3) they have other legitimate reasons.
7 p# W6 r8 v# W5 `* K3 qArticle 11
* L6 C ?; H$ \Any person who applies for renunciation of Chinese nationality shall lose
- U4 ^ g" k# R. R% b3 S4 xChinese nationality upon approval of his application.- G Q8 Y# i8 K5 S ~& M
Article 12
$ q4 H$ u5 Z' v$ @State functionaries and military personnel on active service shall not
" H: c1 N& n% | h3 v0 ~renounce Chinese nationality.9 t+ h' U B& j' _: l
Article 134 S M8 g7 n1 A8 \" U) }3 g7 [9 J
Foreign nationals who once held Chinese nationality may apply for
# ]* e% ^$ q3 J, Trestoration of Chinese nationality if they have legitimate reasons; those5 O. F/ S ?/ I+ b! M4 b O
whose applications for restoration of Chinese nationality have been y3 s7 ?# m( e, q5 `
approved shall not retain foreign nationality.
& h& C& g( S% }$ vArticle 14
$ |$ U; O, r+ e: l, ~! dPersons who wish to acquire, renounce or restore Chinese nationality, with
2 t/ {) B; }# ~! s( l" ^the exception of the cases provided for in Article 9, shall go through the2 @0 e0 L) U0 m
formalities of application. Applications of persons under the age of 18, Q. J( j3 a* I# V& P2 E
may be filed on their behalf by their parents or other legal& @) l$ a) ]4 \7 D: o+ d4 [/ |
representatives./ H( [# Y' {' D- X/ Q, q5 e; _
Article 15/ J$ S+ B" D% o/ N
Nationality applications at home shall be handled by the public security+ P7 c" A: l9 w9 _; R
bureaus of the municipalities or counties where the applicants reside;& L0 E y9 y1 I
nationality applications abroad shall be handled by China''s diplomatic
- f5 V/ L$ v: V! z5 m _" frepresentative agencies and consular offices.
' f) _2 r7 y6 R: jArticle 16& ~3 h" M& e" `0 h4 @
Applications for naturalization as Chinese nationals and for renunciation
|' u% Z: P& y! ~# e: E+ Oor restoration of Chinese nationality are subject to examination and. {3 ? C5 A! z3 f6 Z
approval by the Ministry of Public Security of the People''s Republic of
, i, W8 H9 a, {: bChina. The Ministry of Public Security shall issue a certificate to any3 B' L; D9 b% I+ C, r2 _
person whose application has been approved.8 Q% f% x$ L) o0 F0 {1 I
Article 17, m( x0 i* S6 g% ?, ]% R) Y6 S
The nationality status of persons who have acquired or lost Chinese
( W% \# s0 F1 m$ Y4 c2 Hnationality before the promulgation of this Law shall remain valid.3 t$ H' W* F7 ~$ a4 \# x) E
Article 18
, J! F0 @7 E+ tThis Law shall come into force on the day of its promulgation. |
