(一九八0年九月十日第五届全国人民代表大会第三次会议通过)
' y% ]3 g7 T2 p《中华人民共和国国籍法》
9 y: v; R/ @* j4 T# W  & \9 }  Y  X3 }3 Z) W+ @& V
第一条   中华人民共和国国籍的取得、丧失和恢复,都适用本法。' c+ a! c' F' A( ^3 h: C! c+ Z
    第二条   中华人民共和国是统一的多民族的国家,各民族的人都具有中国国籍。: w; |1 p/ J2 X
    第三条    中华人民共和国不承认中国公民具有双重国籍。7 V5 T9 O6 q: @
    第四条   父母双方或一方为中国公民,本人出生在中国,具有中国国籍。
$ _+ k( [+ c( B( G    第五条   父母双方或一方为中国公民,本人出生在外国,具有中国国籍;但父母双方或一方为中国公民并定居在外国,本人出生时即具有外国国籍的,不具有中国国籍。
9 L% R  m* ^  O, Q    第六条   父母无国籍或国籍不明,定居在中国,本人出生在中国,具有中国国籍。: Y# P% ~% B% ~& J$ k9 }0 z
    第七条   外国人或无国籍人,愿意遵守中国宪法和法律,并具有下列条件之一的,可以经申请批准加入中国国籍:
/ A8 [; ^, F+ D) I0 R    一、中国人的近亲属;4 M+ `; J, ^$ O0 L
    二、定居在中国的;
( B4 H, o$ [/ ?+ `    三、有其它正当理由。* L. U- _9 G0 n0 s
    第八条   申请加入中国国籍获得批准的,即取得中国国籍;被批准加入中国国籍的,不得再保留外国国籍。, w8 w& E$ p) U5 b
    第九条    定居外国的中国公民,自愿加入或取得外国国籍的,即自动丧失中国国籍。3 I5 n* u2 F3 c' z" O
    第十条    中国公民具有下列条件之一的,可以经申请批准退出中国国籍:- P' K8 _7 `6 W$ I
    一、外国人的近亲属;
4 `6 v$ z4 Z$ G3 [* p& a4 O    二、定居在外国的;
+ s* @% t% Y2 z5 \8 d0 @    三、有其它正当理由。
0 \$ K  D% O6 ?  L" ~    第十一条    申请退出中国国籍获得批准的,即丧失中国国籍。  ^+ ?) d, P7 h1 |) ^& M& L7 I* C
    第十二条   国家工作人员和现役军人,不得退出中国国籍。
. E8 D' U" A$ N1 w3 y# E    第十三条   曾有过中国国籍的外国人,具有正当理由,可以申请恢复中国国籍;被批准恢复中国国籍的,不得再保留外国国籍。
+ W; z$ U' F& z) O; \9 z    第十四条   中国国籍的取得、丧失和恢复,除第九条规定的以外,必须办理申请手续。未满十八周岁的人,可由其父母或其他法定代理人代为办理申请。' f' b) \2 v7 F* M( P5 K$ K' N
    第十五条    受理国籍申请的机关,在国内为当地市、县公安局,在国外为中国外交代表机关和领事机关。
4 k0 q8 V9 g! \  V/ X8 K# V& C  N- K% d    第十六条   加入、退出和恢复中国国籍的申请,由中华人民共和国公安部审批。经批准的,由公安部发给证书。
8 [6 K5 I/ d. T5 }8 u    第十七条   本法公布前,已经取得中国国籍的或已经丧失中国国籍的,继续有效。# ^2 E8 m! g) g; [! n+ E, [; n, J
    第十八条   本法自公布之日起施行。4 j* Z  N& T: [  k5 w* s

NATIONALITY LAW OF THE PEOPLE''S REPUBLIC OF CHINA

1 t) {$ r( r  E. v7 m; {3 ^( E4 ZCongress, promulgated by Order No. 8  of  the  Chairman  of  the  Standing
& r0 C1 e( E2 X2 V- {+ E3 wCommittee of the  National  People''s  Congress  on  and  effective  as  of
2 z( K  f! I) \  F# qSeptember 10, 1980)/ C$ o  Z5 w- F/ x1 P
Article 1% v# Y% T. D& j  P" Q8 ]- b
This Law is  applicable  to  the  acquisition,  loss  and  restoration  of
( N4 I. [$ J) |! pnationality of the People''s Republic of China.
3 n6 H) E7 H& B) l! `1 D3 UArticle 2, v5 T# X9 m' N  u& U4 r0 {
The People''s Republic of China is a unitary multinational  state;  persons; {  Z- b/ z0 f$ A, E  r: T4 t
belonging to  any  of  the  nationalities  in  China  shall  have  Chinese6 X% l& F- u% U9 o
nationality.( x& x. ~, O$ c1 v0 J1 V' k
Article 3
1 f2 X* ~6 _7 D" ~% tThe People''s Republic of China does not recognize dual nationality for any
5 g/ }" Y) a; QChinese national.
+ L  t4 z$ t# H$ t7 DArticle 4+ W' C, W! X6 Y- q* _: M) Q) R" ?% m
Any person born in China whose parents are both Chinese nationals  or  one! e/ E  `; F. d/ P% i
of whose parents is a Chinese national shall have Chinese nationality.
" n: _/ m5 @( d6 M: M+ rArticle 5% P( j$ M$ W# |
Any person born abroad whose parents are both Chinese nationals or one  of! }! V: j& Z8 ^; o2 O4 b" t
whose parents is a Chinese national shall have Chinese nationality. But  a) B* L5 N+ N3 @% c+ W5 m7 J
person whose parents are both Chinese  nationals  and  have  both  settled
! A$ u, B" g- zabroad, or one of whose parents is a  Chinese  national  and  has  settled
5 C5 Z, b) H  k& B! f% babroad, and who has acquired foreign nationality at birth shall  not  have
; q) D% Y$ d* @; QChinese nationality.6 B2 T% Q4 h& W3 M7 }4 i& `
Article 6
; g" k9 B! d; QAny person born in China whose  parents  are  stateless  or  of  uncertain
3 Q; t" k0 F. mnationality and have settled in China shall have Chinese nationality.
5 J5 A8 W5 G4 q- s( G0 R7 \# a- tArticle 7
1 o8 M: D' C. Z6 W- Z/ ?4 |$ v/ GForeign nationals or stateless persons who are willing to abide by China''s
$ s, k! C: z% Z& x! ^) j  n0 uConstitution and laws and who meet one of the following conditions may  be, b9 ]# K. f5 s- r* v
naturalized upon approval of their applications:
; t) j! R, j) ]  ~* Q(1) they are near relatives of Chinese nationals;' A7 ^/ j5 h4 i$ c. @# K& g
(2) they have settled in China; or
$ h9 z) c5 \; E7 R(3) they have other legitimate reasons.
3 {1 f/ S5 x& c. W- tArticle 8
7 E; g( j. T. U3 L- Q6 CAny person who applies for naturalization  as  a  Chinese  national  shall
3 h6 n- B6 @1 |. facquire Chinese nationality upon approval of  his  application;  a  person
$ d1 L. T' ~! Uwhose application for  naturalization  as  a  Chinese  national  has  been
1 q7 k0 `% v9 D3 {approved shall not retain foreign nationality.- Z8 }0 `5 O) P/ z+ y: C' L4 c1 }
Article 9
3 I/ n8 N8 I9 A0 ~* j5 M# {2 |Any Chinese national who has settled abroad and who has  been  naturalized8 J+ F6 E& N# L& Y$ ?
as a foreign national or has acquired foreign nationality of his own  free3 f3 j6 R0 a9 |8 j  W
will shall automatically lose Chinese nationality.5 ]  H5 h( K, f* j
Article 10
5 C& t. e2 Y5 ^Chinese nationals who meet one of the following  conditions  may  renounce- N! @6 O3 A! ]: R* Y; A
Chinese nationality upon approval of their applications:
3 v' n+ Q% f& e9 @/ d( j; ?(1) they are near relatives of foreign nationals;$ w, e- C7 T8 B- }: q' C  y2 w
(2) they have settled abroad; or
; L1 r* v6 G/ ?(3) they have other legitimate reasons.
& b) |3 L, b: O- O( Q, R0 ^- pArticle 11/ w6 m1 H- \: y5 h7 x; D9 y
Any person who applies for renunciation of Chinese nationality shall  lose
4 T! O1 S; I7 }. L5 _& f  rChinese nationality upon approval of his application.
, b4 J/ c3 O7 @# G) g, kArticle 12% M3 d# A, F2 Z' G, S
State functionaries and military personnel on  active  service  shall  not
3 d& o9 g: n! Urenounce Chinese nationality.
2 Z+ |9 j3 K. r' n0 S2 k& lArticle 130 {2 c% c% g( D2 R* y
Foreign  nationals  who  once  held  Chinese  nationality  may  apply  for
+ |3 Z/ P) @- _" R/ arestoration of Chinese nationality if they have legitimate reasons;  those
4 U, P6 s- T+ M2 J" Z; i# W: d  Fwhose applications  for  restoration  of  Chinese  nationality  have  been; |1 N; i# U+ ]4 J9 A# q2 |
approved shall not retain foreign nationality.0 J* }$ `& T: q; _* E
Article 14
  o6 D; x, @: L( ]Persons who wish to acquire, renounce or restore Chinese nationality, with; S8 x+ T; `' y1 l0 M7 |
the exception of the cases provided for in Article 9, shall go through the" K7 o3 C& b4 P9 g
formalities of application.  Applications of persons under the age  of  189 I( x/ Q2 j; L) X6 N  G! O
may  be  filed  on  their  behalf  by  their  parents   or   other   legal
' F% |$ {6 U) K/ Q0 v1 E" Trepresentatives.
1 c' c7 V2 K6 n- N8 |7 @/ jArticle 15
; c) b* C' h2 A+ @1 [  _Nationality applications at home shall be handled by the  public  security) y/ g/ x, |! |! v
bureaus of the municipalities or counties where the applicants reside;5 t4 A8 B, P; t( p
nationality applications abroad shall be  handled  by  China''s  diplomatic( X) j2 ^4 n) W; \6 r: j3 B
representative agencies and consular offices.
8 U$ ~5 ]. `% @5 {. d. }# `Article 16
, W; x8 U! Q" |3 MApplications for naturalization as Chinese nationals and for  renunciation! F2 K$ ~1 g( s  Q8 `1 J
or restoration of Chinese  nationality  are  subject  to  examination  and
' W2 A3 b  D9 [- aapproval by the Ministry of Public Security of the  People''s  Republic  of
" y0 ^3 v' O' n( k9 Z2 X. NChina. The Ministry of Public Security shall issue a  certificate  to  any
; Z; T2 W  Y: v: `! l2 u: ~person whose application has been approved.
; L, r, ?6 T. a: JArticle 17
- ?& u: @: r5 E2 Q) ]1 _The nationality status of  persons  who  have  acquired  or  lost  Chinese$ u' L$ V$ g6 c- p# \' ]( t) O
nationality before the promulgation of this Law shall remain valid.. l0 W* ~$ T6 w; _' P# P
Article 18
" ^. p$ o8 D# }! j5 `; H8 zThis Law shall come into force on the day of its promulgation.
