第一条 中华人民共和国国籍的取得、丧失和恢复,都适用本法。
) A% h8 Q, {1 S$ f. J4 U& u 第二条 中华人民共和国是统一的多民族的国家,各民族的人都具有中国国籍。
( G0 {2 I3 y' ~+ V9 E! ~5 e! K# ~$ t 第三条 中华人民共和国不承认中国公民具有双重国籍。
+ m: U! @0 k* Y5 X* X9 j 第四条 父母双方或一方为中国公民,本人出生在中国,具有中国国籍。
# P1 M/ {* }6 y6 i7 R6 m6 n 第五条 父母双方或一方为中国公民,本人出生在外国,具有中国国籍;但父母双方或一方为中国公民并定居在外国,本人出生时即具有外国国籍的,不具有中国国籍。
+ f+ \- a5 A, m( O 第六条 父母无国籍或国籍不明,定居在中国,本人出生在中国,具有中国国籍。 ?" ^1 C: v+ @
第七条 外国人或无国籍人,愿意遵守中国宪法和法律,并具有下列条件之一的,可以经申请批准加入中国国籍:

二、定居在中国的;1 M W7 b: x7 O) N

第八条 申请加入中国国籍获得批准的,即取得中国国籍;被批准加入中国国籍的,不得再保留外国国籍。7 p; W9 p; }/ T* F
第九条 定居外国的中国公民,自愿加入或取得外国国籍的,即自动丧失中国国籍。# \; L. R9 W) q' B# h/ j0 a
第十条 中国公民具有下列条件之一的,可以经申请批准退出中国国籍:
2 s4 i- a. a2 H" x 一、外国人的近亲属; V7 I' K& }1 E0 l
二、定居在外国的;
' ^; V0 j6 Y- d0 n9 C 三、有其它正当理由。% E2 \% V% R3 r( G
第十一条 申请退出中国国籍获得批准的,即丧失中国国籍。* j6 W+ a3 z8 l' h+ ?7 |' s/ @! C
第十二条 国家工作人员和现役军人,不得退出中国国籍。
; j0 s2 M9 n/ I5 w 第十三条 曾有过中国国籍的外国人,具有正当理由,可以申请恢复中国国籍;被批准恢复中国国籍的,不得再保留外国国籍。5 ^( t/ U, |; a% Y
第十四条 中国国籍的取得、丧失和恢复,除第九条规定的以外,必须办理申请手续。未满十八周岁的人,可由其父母或其他法定代理人代为办理申请。) R+ U. z/ e% [4 U' x" O
第十五条 受理国籍申请的机关,在国内为当地市、县公安局,在国外为中国外交代表机关和领事机关。4 h! k( C# |+ h; E/ C0 ~
第十六条 加入、退出和恢复中国国籍的申请,由中华人民共和国公安部审批。经批准的,由公安部发给证书。, i( ^% g" W8 A. h" R, O* O9 W2 L1 n
第十七条 本法公布前,已经取得中国国籍的或已经丧失中国国籍的,继续有效。

This Law is applicable to the acquisition, loss and restoration of

7 M. E6 E [2 T- b8 lThe People''s Republic of China is a unitary multinational state; persons; I6 T, N; @7 y( K
belonging to any of the nationalities in China shall have Chinese

The People''s Republic of China does not recognize dual nationality for any$ f) S' y7 c3 L6 ]8 b
Chinese national.

" H0 j1 C* `0 w. M0 dAny person born in China whose parents are both Chinese nationals or one1 d0 _7 h* o9 }
of whose parents is a Chinese national shall have Chinese nationality.

+ {- {. j' e) l# U( oAny person born abroad whose parents are both Chinese nationals or one of
" W% o4 U% G3 w: Ewhose parents is a Chinese national shall have Chinese nationality. But a

abroad, or one of whose parents is a Chinese national and has settled6 n# f* z) I& |4 C0 C a
abroad, and who has acquired foreign nationality at birth shall not have

Any person born in China whose parents are stateless or of uncertain! ~* }8 O8 q8 i6 O1 M' T4 w
nationality and have settled in China shall have Chinese nationality., k4 d$ S* W9 l2 C+ Q7 c
Article 7/ R1 @% N2 y+ `2 g' _/ L, T
Foreign nationals or stateless persons who are willing to abide by China''s
. C; Z, P- `6 sConstitution and laws and who meet one of the following conditions may be/ n/ T! T2 O# K( U% ?# e
naturalized upon approval of their applications:
* P, s, o# k- h3 `' g. k. z6 X' m(1) they are near relatives of Chinese nationals;
b" q2 M$ K7 w+ C8 h& Q4 U(2) they have settled in China; or
, t, m+ }1 }' ~# x4 w/ c# O(3) they have other legitimate reasons.

Any person who applies for naturalization as a Chinese national shall5 j' b7 |: f1 h0 V% w( o
acquire Chinese nationality upon approval of his application; a person
4 ^' G7 T. u# e2 Q7 L0 N0 Xwhose application for naturalization as a Chinese national has been
6 ^6 N* ?1 ^& m& r) Aapproved shall not retain foreign nationality.

; C) G& n5 V% H2 gAny Chinese national who has settled abroad and who has been naturalized
/ c/ c- l* Q* Das a foreign national or has acquired foreign nationality of his own free
( y$ Y! r* _0 c7 j. K# ]will shall automatically lose Chinese nationality.' y- J0 y* }6 k$ t3 z) P* j
Article 10
: o7 p2 K! x5 LChinese nationals who meet one of the following conditions may renounce
* d3 t$ p& D" H' Y$ o3 k3 dChinese nationality upon approval of their applications:
) u; }% ]0 w5 [9 G- {(1) they are near relatives of foreign nationals;8 H7 m' ?/ ]! t
(2) they have settled abroad; or
1 O8 |* |9 W/ Y' D1 M' t(3) they have other legitimate reasons.1 `3 K$ G' P7 B* A( s9 E' r
Article 11
7 j+ r1 L! H: A: a, B, |5 Y% yAny person who applies for renunciation of Chinese nationality shall lose3 P: k3 a$ k' [9 Q4 m) g% e0 K, ~: B
Chinese nationality upon approval of his application.
9 l/ O9 h+ q9 m. K) z7 Y, R. gArticle 124 Q' Q& x }' U) O* r! m! G
State functionaries and military personnel on active service shall not9 k. p( n. s, H6 C! d, _1 W( H6 o
renounce Chinese nationality.
& |5 w9 H9 w( F. w' xArticle 13- \3 w* ?# Q7 H5 u. q% q! h
Foreign nationals who once held Chinese nationality may apply for
' ~5 n- Y) w% f9 m6 L: i" V* u! |restoration of Chinese nationality if they have legitimate reasons; those" g/ I$ V* f" M! A6 Z
whose applications for restoration of Chinese nationality have been3 y. f( n8 A6 S
approved shall not retain foreign nationality.
7 e- f2 A ?8 [! F; d9 JArticle 14: X$ h. L" H, ?3 h- t) E* l! Z
Persons who wish to acquire, renounce or restore Chinese nationality, with
# |! _2 V$ p7 Jthe exception of the cases provided for in Article 9, shall go through the* O2 p \2 B, E% g8 u. t1 R
formalities of application. Applications of persons under the age of 18
9 X, `5 l3 A% A, ~7 K* D! F: L9 Bmay be filed on their behalf by their parents or other legal
5 h; c8 f/ n# u) o; Irepresentatives.* I1 j5 _+ |4 T# g# @
Article 15) n( x# P! B* o# E
Nationality applications at home shall be handled by the public security! ^% K7 z+ Y& D9 G3 W' R
bureaus of the municipalities or counties where the applicants reside;
' o9 F: ]0 Q: Wnationality applications abroad shall be handled by China''s diplomatic
/ q5 `8 E' \2 Z& Crepresentative agencies and consular offices.0 v0 }' U# J' z
Article 167 K9 J0 r9 I5 }+ c: p
Applications for naturalization as Chinese nationals and for renunciation
8 k/ G7 |; y4 \/ R8 tor restoration of Chinese nationality are subject to examination and% c1 F" X7 e1 s; R& C' o
approval by the Ministry of Public Security of the People''s Republic of% Q- w* T( K1 P4 _) o& i
China. The Ministry of Public Security shall issue a certificate to any: r1 B4 l* R/ J- G& I' C3 q
person whose application has been approved.9 x e' H ?$ R% k& v
Article 17
6 |* M2 J) _! n/ r$ B5 lThe nationality status of persons who have acquired or lost Chinese
! j0 e9 L4 n( x0 T7 U8 q5 K# Unationality before the promulgation of this Law shall remain valid.0 {% k5 X8 ` s6 k) N3 `
Article 18# k1 N5 ?# y- B; J
This Law shall come into force on the day of its promulgation. |
