第一条   中华人民共和国国籍的取得、丧失和恢复,都适用本法。2 y2 B0 G9 |" z/ q# G% f
    第二条   中华人民共和国是统一的多民族的国家,各民族的人都具有中国国籍。1 i1 N+ z  _9 x
    第三条    中华人民共和国不承认中国公民具有双重国籍。
2 \; p- d4 Q! |8 s    第四条   父母双方或一方为中国公民,本人出生在中国,具有中国国籍。; z* b& w; [- N4 S1 I; |2 q
    第五条   父母双方或一方为中国公民,本人出生在外国,具有中国国籍;但父母双方或一方为中国公民并定居在外国,本人出生时即具有外国国籍的,不具有中国国籍。, a0 @# q6 L; X
    第六条   父母无国籍或国籍不明,定居在中国,本人出生在中国,具有中国国籍。
) r1 g" ?6 S: d    第七条   外国人或无国籍人,愿意遵守中国宪法和法律,并具有下列条件之一的,可以经申请批准加入中国国籍:
- ?; J$ Q4 [* B    一、中国人的近亲属;" q$ p' R: t- Z7 k; E
    二、定居在中国的;; H' I' o+ t9 _# E- n
    三、有其它正当理由。% d1 E3 t9 P$ c& v0 H$ L
    第八条   申请加入中国国籍获得批准的,即取得中国国籍;被批准加入中国国籍的,不得再保留外国国籍。. C3 B/ w/ E4 w' c
    第九条    定居外国的中国公民,自愿加入或取得外国国籍的,即自动丧失中国国籍。
2 [7 _  o1 V) q( g6 r) n3 f) U    第十条    中国公民具有下列条件之一的,可以经申请批准退出中国国籍:5 H1 w; o$ Q6 Z) q# ^$ H9 k  \- @' O
    一、外国人的近亲属;5 d$ |+ c/ [, L4 Z
    二、定居在外国的;
) G' A. W- D+ w' c  ~" F+ p1 o    三、有其它正当理由。0 Z5 E9 r! |! e5 l5 B
    第十一条    申请退出中国国籍获得批准的,即丧失中国国籍。7 J  F  A6 y/ U2 v4 N  l5 h# Y
    第十二条   国家工作人员和现役军人,不得退出中国国籍。, x/ j* E) ~$ n' T, a
    第十三条   曾有过中国国籍的外国人,具有正当理由,可以申请恢复中国国籍;被批准恢复中国国籍的,不得再保留外国国籍。
5 q4 \$ E4 z, `' A: ^& x    第十四条   中国国籍的取得、丧失和恢复,除第九条规定的以外,必须办理申请手续。未满十八周岁的人,可由其父母或其他法定代理人代为办理申请。) ]# }, D) B0 F, W
    第十五条    受理国籍申请的机关,在国内为当地市、县公安局,在国外为中国外交代表机关和领事机关。% T* w, _9 t% n8 u
    第十六条   加入、退出和恢复中国国籍的申请,由中华人民共和国公安部审批。经批准的,由公安部发给证书。
1 N( K, S+ X* B7 Z$ o% Z    第十七条   本法公布前,已经取得中国国籍的或已经丧失中国国籍的,继续有效。
; \+ x  u1 N1 J6 v    第十八条   本法自公布之日起施行。

Article 1* o+ d7 R/ H- s: B9 J# ?" C( M
This Law is  applicable  to  the  acquisition,  loss  and  restoration  of
' ]' y% p. Q+ Znationality of the People''s Republic of China.1 Q5 [/ o1 |, g% c
Article 25 P$ g$ k4 r4 i" N; E% Q4 v
The People''s Republic of China is a unitary multinational  state;  persons( O) A" \* a  V6 X; D1 L2 }- w
belonging to  any  of  the  nationalities  in  China  shall  have  Chinese
9 N& s8 ^8 `; q! @! S+ e* M( E  wnationality., l8 ~+ T. W& m, o8 O% m
Article 3
( r6 l- f0 {6 C- y2 }( F& zThe People''s Republic of China does not recognize dual nationality for any
/ \- e& b, Y+ g0 QChinese national.+ N& J1 R, O1 M0 R+ X; q
Article 4
: q; K7 X, H8 `% t' _Any person born in China whose parents are both Chinese nationals  or  one  J2 @, n5 U, ]3 J$ z6 [- }* S
of whose parents is a Chinese national shall have Chinese nationality.2 }: F; i$ e2 ]/ ?9 D, d. \: I4 ^% n/ e
Article 5
( a4 }# P* z2 p) v) yAny person born abroad whose parents are both Chinese nationals or one  of
' _: A: M, ~; ywhose parents is a Chinese national shall have Chinese nationality. But  a
# Q, d0 Z3 }2 Z. a8 Y' R9 Eperson whose parents are both Chinese  nationals  and  have  both  settled
  ~0 l) i+ H7 ~abroad, or one of whose parents is a  Chinese  national  and  has  settled
. f/ X$ }* f: ^% K, l* `. D( n! a9 {abroad, and who has acquired foreign nationality at birth shall  not  have2 [1 {0 N9 L' ~5 p) [% k% M! [! ^
Chinese nationality.
9 q1 t6 D+ w' l% B% v6 O, dArticle 6
! `/ H( Q* Q) m2 f2 r: v* dAny person born in China whose  parents  are  stateless  or  of  uncertain; r. ?. e4 R7 p0 J- ?1 ?
nationality and have settled in China shall have Chinese nationality.* J* U# i3 }+ _% h
Article 7
, o4 K" R+ H" e5 S. RForeign nationals or stateless persons who are willing to abide by China''s: N* E! e7 z4 M
Constitution and laws and who meet one of the following conditions may  be. O* c/ ~, N$ S/ g  [6 x
naturalized upon approval of their applications:+ |# D: k8 z+ x' A
(1) they are near relatives of Chinese nationals;
, {+ A4 [$ X/ q7 f, l" j( B(2) they have settled in China; or
+ c4 o: y  {2 ~4 J8 \0 H(3) they have other legitimate reasons.! c2 Z1 b9 ~  A# l' h/ C( s
Article 80 ~1 G: c2 m: ^9 Q1 G( y# g, o; _
Any person who applies for naturalization  as  a  Chinese  national  shall- m( }. Q$ L/ D  D
acquire Chinese nationality upon approval of  his  application;  a  person
0 _* U$ B/ _6 y4 |) z0 U  {whose application for  naturalization  as  a  Chinese  national  has  been
, l: ^: T8 ^; h* sapproved shall not retain foreign nationality.1 }. B* b) i) @# ^0 A
Article 9: O, I" M+ u9 V+ |+ A+ I
Any Chinese national who has settled abroad and who has  been  naturalized6 h4 V) I5 a0 z3 P0 l1 t
as a foreign national or has acquired foreign nationality of his own  free
! L; A# h4 z0 |- {3 e' Cwill shall automatically lose Chinese nationality.
4 Z# {3 j/ Y  _0 {$ qArticle 10: `6 Q$ R# u) O+ V. g% e) }
Chinese nationals who meet one of the following  conditions  may  renounce9 v1 A# j( f, U9 b1 o5 D
Chinese nationality upon approval of their applications:
! e, E6 M' I. D(1) they are near relatives of foreign nationals;
+ y" b  i& n/ Q1 N' W: G, e(2) they have settled abroad; or
+ ?" Q& P2 y# x* W$ o% q(3) they have other legitimate reasons.0 c3 Z) R$ d+ s  g" P9 P8 ]3 d
Article 11
4 g; u6 B, A9 o- s4 t9 l* h& {Any person who applies for renunciation of Chinese nationality shall  lose
. z4 {) d9 s& l) E2 IChinese nationality upon approval of his application.# `' j- c' P. }4 \
Article 12
7 ?5 u1 \4 K! bState functionaries and military personnel on  active  service  shall  not' L2 l# [+ O) v" q1 V
renounce Chinese nationality.
; Y2 m+ X0 K0 |4 HArticle 13% k! P3 z1 g1 u( A0 n
Foreign  nationals  who  once  held  Chinese  nationality  may  apply  for. {# ?0 T0 z7 U
restoration of Chinese nationality if they have legitimate reasons;  those- ?. K& L/ @2 U, G# ~
whose applications  for  restoration  of  Chinese  nationality  have  been' i$ p: w2 T: L
approved shall not retain foreign nationality." U0 ?5 O% \' ~7 g# J
Article 14
; E- r6 X0 W6 c- w+ bPersons who wish to acquire, renounce or restore Chinese nationality, with
: ~% w6 j2 J  j+ }  zthe exception of the cases provided for in Article 9, shall go through the) V' y% x8 j/ O6 `
formalities of application.  Applications of persons under the age  of  186 T& u( \. ]! H+ _  f/ X; G1 Q
may  be  filed  on  their  behalf  by  their  parents   or   other   legal
# O* g: ^1 i  i, x! ^4 r% hrepresentatives.$ R: P$ Q' B( B3 k5 M! {
Article 15; a, ^! B& b7 A; `0 M
Nationality applications at home shall be handled by the  public  security
3 d! ^0 |' F$ ?( x! n! o; Ubureaus of the municipalities or counties where the applicants reside;
4 }1 L% L* c* Z% A' x& _: p9 pnationality applications abroad shall be  handled  by  China''s  diplomatic
7 x7 k/ d* V; L* ?4 _7 z" lrepresentative agencies and consular offices.% W- w. r8 J. ^$ g) x% S7 S
Article 16' y' I5 V  q" _( C. N4 X
Applications for naturalization as Chinese nationals and for  renunciation( r/ [+ v7 `0 p7 p6 Q: p
or restoration of Chinese  nationality  are  subject  to  examination  and% N6 V$ I# T& Q1 }+ b* U
approval by the Ministry of Public Security of the  People''s  Republic  of0 y0 N' ^# C- ^  V7 B  b0 a( L
China. The Ministry of Public Security shall issue a  certificate  to  any
+ Q3 b8 N' X7 _- qperson whose application has been approved.
. J  E) f3 A% l- n8 ^Article 170 A$ I3 a- \) E( x7 g% r* n
The nationality status of  persons  who  have  acquired  or  lost  Chinese) C/ a8 u! K; }) V" q( E2 c! X
nationality before the promulgation of this Law shall remain valid.  ~) u: |+ d! T2 z* i; f
Article 18& o( T. o( {8 q, Q+ x9 o: {; N
This Law shall come into force on the day of its promulgation.
