《中华人民共和国国籍法》

第一条 中华人民共和国国籍的取得、丧失和恢复,都适用本法。
) V9 u' O! N0 B' g: }5 m% l2 d 第二条 中华人民共和国是统一的多民族的国家,各民族的人都具有中国国籍。
$ ?! {8 f- _6 m6 Y/ T1 w& s 第三条 中华人民共和国不承认中国公民具有双重国籍。
2 _3 j8 ^6 v+ j" W- k- j 第四条 父母双方或一方为中国公民,本人出生在中国,具有中国国籍。% r9 `, x2 u* ^* @+ d+ A2 D, M
第五条 父母双方或一方为中国公民,本人出生在外国,具有中国国籍;但父母双方或一方为中国公民并定居在外国,本人出生时即具有外国国籍的,不具有中国国籍。
8 a$ B; p4 D. f8 ^& b- X0 V5 {7 B* S 第六条 父母无国籍或国籍不明,定居在中国,本人出生在中国,具有中国国籍。
. W* t5 X, e, C 第七条 外国人或无国籍人,愿意遵守中国宪法和法律,并具有下列条件之一的,可以经申请批准加入中国国籍:
( \, ~: r6 ?6 v- L 一、中国人的近亲属;
W l, I& Z# ~% g3 z- E5 _ 二、定居在中国的;
( f- A% F0 M9 S+ h2 ~) p 三、有其它正当理由。
2 ?6 W# d2 v6 g0 w2 F* s8 r 第八条 申请加入中国国籍获得批准的,即取得中国国籍;被批准加入中国国籍的,不得再保留外国国籍。& |9 H( M4 n9 q4 _" N
第九条 定居外国的中国公民,自愿加入或取得外国国籍的,即自动丧失中国国籍。+ M! y H# m y+ z+ L' r
第十条 中国公民具有下列条件之一的,可以经申请批准退出中国国籍:

3 z; F, \4 W0 Q% {% u" l( N 二、定居在外国的;
9 L$ @* w- `1 m9 v' R5 ? 三、有其它正当理由。
4 O" K7 P8 }2 N! ]1 y; G' B 第十一条 申请退出中国国籍获得批准的,即丧失中国国籍。2 \+ C) e7 |) o( G/ L( q
第十二条 国家工作人员和现役军人,不得退出中国国籍。
( k; v3 X! {$ w( l$ z/ d 第十三条 曾有过中国国籍的外国人,具有正当理由,可以申请恢复中国国籍;被批准恢复中国国籍的,不得再保留外国国籍。
3 S4 L8 T9 u% k D8 |6 h2 | 第十四条 中国国籍的取得、丧失和恢复,除第九条规定的以外,必须办理申请手续。未满十八周岁的人,可由其父母或其他法定代理人代为办理申请。! }/ A& K; T# O9 `4 ]
第十五条 受理国籍申请的机关,在国内为当地市、县公安局,在国外为中国外交代表机关和领事机关。
) ^& e; Y9 I0 _1 l, o 第十六条 加入、退出和恢复中国国籍的申请,由中华人民共和国公安部审批。经批准的,由公安部发给证书。2 i$ F X& Z0 r2 B' u r. k' z9 d3 q
第十七条 本法公布前,已经取得中国国籍的或已经丧失中国国籍的,继续有效。

2 Z) l$ g; K) j. \* b2 [8 ^Any person born in China whose parents are both Chinese nationals or one

Article 5
$ z% V. m J- o# Q! R. @Any person born abroad whose parents are both Chinese nationals or one of
% b( G: d, R" i5 E, qwhose parents is a Chinese national shall have Chinese nationality. But a- n$ I, w$ y- W! ?: A0 D
person whose parents are both Chinese nationals and have both settled& |: ?9 x; F/ D- _: w( D2 r2 f
abroad, or one of whose parents is a Chinese national and has settled
% _8 y. m# f/ b7 Dabroad, and who has acquired foreign nationality at birth shall not have

Article 6
5 g M3 G; [" E" I8 Q& m+ wAny person born in China whose parents are stateless or of uncertain
4 w$ e/ b1 o8 J$ Lnationality and have settled in China shall have Chinese nationality.

Foreign nationals or stateless persons who are willing to abide by China''s
( j4 }( ^7 n+ B: u6 N2 dConstitution and laws and who meet one of the following conditions may be: B; Z, U# h3 g: ~7 Y
naturalized upon approval of their applications:- ^+ H8 q2 o' ~
(1) they are near relatives of Chinese nationals;
, o/ U F4 d$ u7 }" d# `9 h" o(2) they have settled in China; or
8 a7 V+ P, K5 j" i(3) they have other legitimate reasons.4 e! ?, F: Z/ Y+ q( `0 l& K5 t- \
Article 86 e- q7 m7 G! y
Any person who applies for naturalization as a Chinese national shall
, i' @# j( U7 n0 d- @: ~: gacquire Chinese nationality upon approval of his application; a person
% p7 P# \ L4 u5 M% \5 Hwhose application for naturalization as a Chinese national has been
8 C& I Z- N% Yapproved shall not retain foreign nationality.

Any Chinese national who has settled abroad and who has been naturalized
4 T: s) z, u4 z0 S" W% B' uas a foreign national or has acquired foreign nationality of his own free6 j3 _; |' r" C, E! {+ M
will shall automatically lose Chinese nationality.0 e4 V5 s o1 n5 T8 P _, o' N
Article 10. h8 ^. S% b/ `0 e+ `( R
Chinese nationals who meet one of the following conditions may renounce
8 L- k" p1 N! n7 ^, a( k" M4 ~Chinese nationality upon approval of their applications:
; E2 a/ q# F7 [( q& Y(1) they are near relatives of foreign nationals;
" ~5 k: G8 g* ~) f8 w(2) they have settled abroad; or
, C) [" ^; ^" `# ^(3) they have other legitimate reasons.: i& A% v3 c8 U( r: N
Article 11
' R- V+ o9 `. o2 f& s5 X9 gAny person who applies for renunciation of Chinese nationality shall lose+ V p2 ~8 _* D
Chinese nationality upon approval of his application.
1 Y' t2 k! n/ l8 d0 DArticle 12
, u; y% }9 L1 GState functionaries and military personnel on active service shall not
5 P, ?, y, W- s. Erenounce Chinese nationality.& ^8 j1 Z) ~( r' g! x. ]
Article 13
1 C+ P% Q0 d$ `0 F2 m* p, WForeign nationals who once held Chinese nationality may apply for
2 |8 h e# ]0 f: urestoration of Chinese nationality if they have legitimate reasons; those
: d* K y$ E. C+ f' i( pwhose applications for restoration of Chinese nationality have been: u! i3 R! S3 b+ f$ X3 Q2 P6 p
approved shall not retain foreign nationality." a! {& {: e; I8 A& A, Z- b* V- v: F' \2 t
Article 146 v$ E6 r; Y' y. q2 {6 d
Persons who wish to acquire, renounce or restore Chinese nationality, with5 Y" i4 P( C' N V1 T" j' Q4 |. g
the exception of the cases provided for in Article 9, shall go through the
6 q0 r% V9 Z/ S: L2 Fformalities of application. Applications of persons under the age of 18
! D' b7 k1 H! Dmay be filed on their behalf by their parents or other legal
, Z! s5 j# f, T# urepresentatives.
* l8 p' f9 k; O% BArticle 156 X* ^& B1 q! {9 J; o: Q7 \. m
Nationality applications at home shall be handled by the public security7 h7 q o6 T5 j; M' _* s9 G" b, Q, [
bureaus of the municipalities or counties where the applicants reside;
; Y* ?$ W/ M' B8 G8 }nationality applications abroad shall be handled by China''s diplomatic H Q7 u+ X* ~8 M8 V
representative agencies and consular offices.3 j9 [" \" i- l$ p1 H* e
Article 16
/ E, M# T. r `: Y& P. r) \& x. sApplications for naturalization as Chinese nationals and for renunciation
8 [0 r+ N3 J# xor restoration of Chinese nationality are subject to examination and
- T S) E! R. d$ e+ k4 [) _7 Gapproval by the Ministry of Public Security of the People''s Republic of
6 z j! h4 t9 q- `4 MChina. The Ministry of Public Security shall issue a certificate to any
2 K! ?9 N2 X; e4 _person whose application has been approved.1 d; t# o* m/ h( ?
Article 17# X8 ~2 I, `* z) C- t1 T
The nationality status of persons who have acquired or lost Chinese0 `- F$ I% e% |9 j; U
nationality before the promulgation of this Law shall remain valid.% |' v D4 e1 m: I6 j+ V. W
Article 18
0 O. D' v2 @5 }, e: v8 FThis Law shall come into force on the day of its promulgation. |
