8 w2 C& N0 Q+ K" b+ x5 q 第一条   中华人民共和国国籍的取得、丧失和恢复,都适用本法。7 x" x, N' L' y7 Y. j
    第二条   中华人民共和国是统一的多民族的国家,各民族的人都具有中国国籍。
; f+ g4 i! n6 k% f    第三条    中华人民共和国不承认中国公民具有双重国籍。
( d9 _4 E4 j* h: n; r  P, z) _6 ~6 D    第四条   父母双方或一方为中国公民,本人出生在中国,具有中国国籍。: B. A' k# t+ a: z
    第五条   父母双方或一方为中国公民,本人出生在外国,具有中国国籍;但父母双方或一方为中国公民并定居在外国,本人出生时即具有外国国籍的,不具有中国国籍。8 I3 k3 E) f) L5 D- x' f
    第六条   父母无国籍或国籍不明,定居在中国,本人出生在中国,具有中国国籍。5 Q' k; T! J' N; [% d8 e7 C3 {
    第七条   外国人或无国籍人,愿意遵守中国宪法和法律,并具有下列条件之一的,可以经申请批准加入中国国籍:
; F; z1 ^% T' z, `; J    一、中国人的近亲属;9 Y2 }3 f1 |* i
    二、定居在中国的;7 d& Q* P7 k, |+ |5 \
    三、有其它正当理由。
8 S/ }5 t7 T+ U% H    第八条   申请加入中国国籍获得批准的,即取得中国国籍;被批准加入中国国籍的,不得再保留外国国籍。, s( H6 _0 e1 m* B. z
    第九条    定居外国的中国公民,自愿加入或取得外国国籍的,即自动丧失中国国籍。
: M9 h% V3 ^. |( d. E9 E; R    第十条    中国公民具有下列条件之一的,可以经申请批准退出中国国籍:% s) |) V$ o8 {" V+ z5 H
    一、外国人的近亲属;
3 ^# R' C6 I2 ]2 a. L1 _    二、定居在外国的;
* I2 \' T- m; _3 `6 M' ]5 s    三、有其它正当理由。3 ?: M' X0 `; k8 `
    第十一条    申请退出中国国籍获得批准的,即丧失中国国籍。
. V2 ~; D* [- i    第十二条   国家工作人员和现役军人,不得退出中国国籍。
/ P* s0 K$ L& {  r2 @    第十三条   曾有过中国国籍的外国人,具有正当理由,可以申请恢复中国国籍;被批准恢复中国国籍的,不得再保留外国国籍。& J, C8 X; o, q4 k: e" j
    第十四条   中国国籍的取得、丧失和恢复,除第九条规定的以外,必须办理申请手续。未满十八周岁的人,可由其父母或其他法定代理人代为办理申请。' G$ u* W1 ?7 C  r/ h
    第十五条    受理国籍申请的机关,在国内为当地市、县公安局,在国外为中国外交代表机关和领事机关。/ L/ t5 B' |( d
    第十六条   加入、退出和恢复中国国籍的申请,由中华人民共和国公安部审批。经批准的,由公安部发给证书。6 V; k( l8 W# l' {% y
    第十七条   本法公布前,已经取得中国国籍的或已经丧失中国国籍的,继续有效。8 M0 o. i7 ]1 O
    第十八条   本法自公布之日起施行。4 H' T# [. _5 @0 C

This Law is  applicable  to  the  acquisition,  loss  and  restoration  of' p& F1 s7 C4 n8 A6 C& d
nationality of the People''s Republic of China.
8 i5 O" ]! D, E6 H% E! U0 PArticle 2
1 L' f0 Q$ G0 B# {2 d# I+ AThe People''s Republic of China is a unitary multinational  state;  persons1 s" R  K7 [; }) @) N9 i; ?
belonging to  any  of  the  nationalities  in  China  shall  have  Chinese/ d/ r/ q7 I9 }2 a: g
nationality., o: A# B: ]# C, B
Article 3
! t* U5 S+ M0 }0 q; NThe People''s Republic of China does not recognize dual nationality for any: N5 f$ U6 j0 U8 i. S
Chinese national.1 k( x6 L" T* s* a
Article 4
2 W; u! e' M9 _; M2 rAny person born in China whose parents are both Chinese nationals  or  one
! d0 q$ ^3 _% J# F( S4 _of whose parents is a Chinese national shall have Chinese nationality.7 p3 Q) k& v' H2 \9 v+ Z
Article 5
2 o/ |  e: [5 h; J* o$ }: i& yAny person born abroad whose parents are both Chinese nationals or one  of% F2 v* B) g8 M; V
whose parents is a Chinese national shall have Chinese nationality. But  a
+ r& \4 W+ B: i! j% bperson whose parents are both Chinese  nationals  and  have  both  settled# C) l" T# N! _& [
abroad, or one of whose parents is a  Chinese  national  and  has  settled9 [! a! m% [  Z# k
abroad, and who has acquired foreign nationality at birth shall  not  have7 D" Z3 ]9 ~7 y* x4 C
Chinese nationality.6 t3 l6 f# v; D9 K8 Q5 p; N" t
Article 6* K6 @; o+ ^4 n/ m  S& I
Any person born in China whose  parents  are  stateless  or  of  uncertain" A  L" q9 |) B4 d( n) ^" F! f% Z
nationality and have settled in China shall have Chinese nationality.3 C6 x/ [  {8 m& A9 j/ W" ]0 Y
Article 7
9 h8 h& }1 R3 Y% TForeign nationals or stateless persons who are willing to abide by China''s
$ r) V" u* T. T- T/ XConstitution and laws and who meet one of the following conditions may  be
" ~; y+ h$ i. V# X) N  Snaturalized upon approval of their applications:, T* u6 |2 i7 S; m, V6 _
(1) they are near relatives of Chinese nationals;$ C) n- |7 A' n# w: {, N( ~" U
(2) they have settled in China; or
) h& L3 s: C* o" n! M$ h6 s(3) they have other legitimate reasons.

Any person who applies for naturalization  as  a  Chinese  national  shall$ l( c1 p" @, c
acquire Chinese nationality upon approval of  his  application;  a  person
# x& `7 ^  I7 `  X6 m! awhose application for  naturalization  as  a  Chinese  national  has  been9 n! U' F  H, `; X- t$ R1 ^* e
approved shall not retain foreign nationality.
; x3 T/ s0 x2 Z" C! m/ y$ XArticle 99 c* h2 q- V8 O+ O' o2 t+ H
Any Chinese national who has settled abroad and who has  been  naturalized
# ]! ~$ W3 {9 f4 B4 Qas a foreign national or has acquired foreign nationality of his own  free6 F& e$ \7 o4 U0 t# \& A
will shall automatically lose Chinese nationality.
, M9 u7 N  w1 wArticle 100 M; l. V  m; q2 C
Chinese nationals who meet one of the following  conditions  may  renounce
+ J+ K5 R4 A- Z5 kChinese nationality upon approval of their applications:7 A6 A. i3 d# v9 d  J7 j
(1) they are near relatives of foreign nationals;, R2 W# F( S4 l; h9 k0 S) I
(2) they have settled abroad; or
% n8 E' _( H7 V. e/ e  n+ O, D(3) they have other legitimate reasons.
$ g; H6 R' v% G8 Q! o% p3 DArticle 11# K9 O# N/ o* q
Any person who applies for renunciation of Chinese nationality shall  lose0 N1 D: F$ }. P
Chinese nationality upon approval of his application.
( {( n2 M" s7 _* xArticle 12
  z( h; A2 E; g- d6 g1 kState functionaries and military personnel on  active  service  shall  not0 j) h  b# e  N0 s9 t# g
renounce Chinese nationality.
% j" Q1 V0 j5 k( t1 |Article 13
) d" J0 J9 R8 _4 @Foreign  nationals  who  once  held  Chinese  nationality  may  apply  for
- o0 g! g4 y3 _, Frestoration of Chinese nationality if they have legitimate reasons;  those
/ x; z* D& V2 l2 x/ W: fwhose applications  for  restoration  of  Chinese  nationality  have  been
. h$ I( x( l  u" T7 \approved shall not retain foreign nationality.
2 c# e+ L7 u' c7 GArticle 14
' Q  E5 m% M. `. Y% O% HPersons who wish to acquire, renounce or restore Chinese nationality, with3 }" _7 Z: M! Y; u" i
the exception of the cases provided for in Article 9, shall go through the
: ]& x3 e0 R4 Nformalities of application.  Applications of persons under the age  of  18- y! O+ X: G9 C# \% |( B- M2 |
may  be  filed  on  their  behalf  by  their  parents   or   other   legal
0 z7 f8 {& p: o4 N4 h- ]& |representatives.& |* |% o7 z6 v" U
Article 15
: S& E, i! z4 E, v4 h5 p) SNationality applications at home shall be handled by the  public  security
; {, q# o, Q! @) d5 l$ I6 |bureaus of the municipalities or counties where the applicants reside;
* w( U8 O# ]! G# i& qnationality applications abroad shall be  handled  by  China''s  diplomatic( J6 Y7 p) r1 O  ]# E: [
representative agencies and consular offices.0 `# D' J. t5 w0 _( X9 T! k
Article 16
3 {5 s- O5 ^/ O5 FApplications for naturalization as Chinese nationals and for  renunciation
/ Q* p3 @  l+ F7 K9 o( \( oor restoration of Chinese  nationality  are  subject  to  examination  and, x0 }2 [' _# V! h2 r$ A
approval by the Ministry of Public Security of the  People''s  Republic  of* e# V( I- ?* n6 M3 p* X3 B6 S6 ?
China. The Ministry of Public Security shall issue a  certificate  to  any- Y5 _. J1 Q! C
person whose application has been approved.
- ?; U3 p/ \2 c0 n& NArticle 17; w& Z3 i/ h) I; n# D% A
The nationality status of  persons  who  have  acquired  or  lost  Chinese* W0 Z2 T) v' o  V3 m" U! ?( k5 ~
nationality before the promulgation of this Law shall remain valid.# w. F. F6 P+ Z9 D1 c4 x
Article 186 V; [: e1 ]5 X0 P% `
This Law shall come into force on the day of its promulgation.
