第一条   中华人民共和国国籍的取得、丧失和恢复,都适用本法。5 Y4 N0 q, [2 t0 }
    第二条   中华人民共和国是统一的多民族的国家,各民族的人都具有中国国籍。
& {8 Z7 Z' j% O% J& j$ n: P    第三条    中华人民共和国不承认中国公民具有双重国籍。
" ], {% N2 S% D/ l0 f4 M8 Y+ S    第四条   父母双方或一方为中国公民,本人出生在中国,具有中国国籍。2 t/ F3 E, ^& g# ^' t$ m
    第五条   父母双方或一方为中国公民,本人出生在外国,具有中国国籍;但父母双方或一方为中国公民并定居在外国,本人出生时即具有外国国籍的,不具有中国国籍。" ]4 e/ Q7 v  n1 }+ r* y7 w* d
    第六条   父母无国籍或国籍不明,定居在中国,本人出生在中国,具有中国国籍。; v4 R3 d! w( c
    第七条   外国人或无国籍人,愿意遵守中国宪法和法律,并具有下列条件之一的,可以经申请批准加入中国国籍:
1 K* h' m5 T8 D* `" N0 I    一、中国人的近亲属;
) l, G! ^" T3 v* u  Z" C    二、定居在中国的;
5 V1 b! U7 f  y0 G9 g/ w5 D    三、有其它正当理由。9 ?2 r8 S$ W3 @" n7 }
    第八条   申请加入中国国籍获得批准的,即取得中国国籍;被批准加入中国国籍的,不得再保留外国国籍。; j9 U0 T5 a( K$ m8 m
    第九条    定居外国的中国公民,自愿加入或取得外国国籍的,即自动丧失中国国籍。. v$ |0 q6 b  [  d4 k' s# ~6 n
    第十条    中国公民具有下列条件之一的,可以经申请批准退出中国国籍:
1 v, F& o- e2 i. W    一、外国人的近亲属;
. h" z- `- J7 L    二、定居在外国的;  x/ S2 N* Z4 z0 M( B
    三、有其它正当理由。
8 w9 D5 ?* E# F9 }: Q( K* O" I    第十一条    申请退出中国国籍获得批准的,即丧失中国国籍。
: I1 I6 C  E6 `6 [& F- t    第十二条   国家工作人员和现役军人,不得退出中国国籍。
" |5 G' i( n& ?: M    第十三条   曾有过中国国籍的外国人,具有正当理由,可以申请恢复中国国籍;被批准恢复中国国籍的,不得再保留外国国籍。
% w+ c) E% L' M    第十四条   中国国籍的取得、丧失和恢复,除第九条规定的以外,必须办理申请手续。未满十八周岁的人,可由其父母或其他法定代理人代为办理申请。# @4 c0 C# r; z# ?+ J
    第十五条    受理国籍申请的机关,在国内为当地市、县公安局,在国外为中国外交代表机关和领事机关。
' _4 G/ a; w4 D5 X3 y( Y) v    第十六条   加入、退出和恢复中国国籍的申请,由中华人民共和国公安部审批。经批准的,由公安部发给证书。
9 s3 ?7 D, }* u1 K    第十七条   本法公布前,已经取得中国国籍的或已经丧失中国国籍的,继续有效。

Article 1
; s6 ?% ^$ \  ]. O+ vThis Law is  applicable  to  the  acquisition,  loss  and  restoration  of) X8 r/ \: _( ], ?
nationality of the People''s Republic of China.
& p6 z5 O4 q; \7 G4 H$ [6 d. xArticle 2, a+ ?3 A5 T, w! Q6 [4 y1 k" M9 z
The People''s Republic of China is a unitary multinational  state;  persons4 V4 n( g+ y! ~) V: A2 l3 v
belonging to  any  of  the  nationalities  in  China  shall  have  Chinese
9 U4 {  C1 m+ K( ]; ^9 B  S5 qnationality.% m. z" d+ q1 O6 A& c
Article 3
& y. G: d' b1 ]3 _The People''s Republic of China does not recognize dual nationality for any
8 p. B4 H$ E* U  c, Z, t3 rChinese national.. y- T3 Y6 m$ e/ P. r( N
Article 40 z; ~. L7 e4 V3 e& P  R2 Y  |
Any person born in China whose parents are both Chinese nationals  or  one! h- x- {. q0 R' h, q
of whose parents is a Chinese national shall have Chinese nationality.

Any person born abroad whose parents are both Chinese nationals or one  of# T" A" q2 P; I# k
whose parents is a Chinese national shall have Chinese nationality. But  a( c  V0 e8 a, x+ L) T/ C0 d
person whose parents are both Chinese  nationals  and  have  both  settled9 S/ C& Y. r5 y
abroad, or one of whose parents is a  Chinese  national  and  has  settled+ |" J5 b' v/ l! C
abroad, and who has acquired foreign nationality at birth shall  not  have& a& j% r3 X  O; B
Chinese nationality.
, }! z2 }, l) g5 P- AArticle 61 M* L7 `: Q, c; Y
Any person born in China whose  parents  are  stateless  or  of  uncertain
0 B7 z2 |5 J0 Bnationality and have settled in China shall have Chinese nationality.* [" S% o. `  F1 |2 C" r0 h0 H
Article 7
, l  B. z9 O# g! m# W! ^: CForeign nationals or stateless persons who are willing to abide by China''s4 A' H% B( ^% C+ ~1 z2 t
Constitution and laws and who meet one of the following conditions may  be& U" m& t0 @* p% [; x: G: u
naturalized upon approval of their applications:
( O; i4 r/ P# C/ J- K4 g(1) they are near relatives of Chinese nationals;- H. b9 b3 i, E6 X$ d4 q/ }
(2) they have settled in China; or
6 D3 V5 m- a0 F(3) they have other legitimate reasons.
4 }0 H# `6 J0 }5 U, X' wArticle 87 [6 u2 {) `5 y  w" n: Y  \' n
Any person who applies for naturalization  as  a  Chinese  national  shall
3 u. |1 I3 F& t$ ^  _acquire Chinese nationality upon approval of  his  application;  a  person+ Y6 j) Z! \/ x6 L  H* f. t, ~
whose application for  naturalization  as  a  Chinese  national  has  been
) d5 s- ?9 \1 sapproved shall not retain foreign nationality.
- v6 D) {# S2 L" \0 G# P4 T6 SArticle 9
+ i1 ]- y/ v% B5 ?2 {5 ZAny Chinese national who has settled abroad and who has  been  naturalized
+ X- A7 n" G" j8 B$ Y8 I! Fas a foreign national or has acquired foreign nationality of his own  free9 Y: s: }! Y- M; b
will shall automatically lose Chinese nationality.1 x/ d& X! a6 l. }
Article 10  p2 e7 W8 [! W$ n. G1 |( [
Chinese nationals who meet one of the following  conditions  may  renounce: Z" u; r5 y! g2 W, {& `+ D
Chinese nationality upon approval of their applications:
* o9 g2 x! P; O# F* @5 S(1) they are near relatives of foreign nationals;0 y' ]8 p+ |* l# t4 J9 k9 A! E3 R! J
(2) they have settled abroad; or
9 d/ g' G( G: G5 k& V3 u(3) they have other legitimate reasons.0 a( L$ H4 e9 Q
Article 11
7 {! @/ i3 l/ \7 K1 F2 wAny person who applies for renunciation of Chinese nationality shall  lose/ z( u* A3 t- i0 }6 q1 y
Chinese nationality upon approval of his application.
' t% m; p4 T, Q, h' ^; nArticle 12
  i1 s7 n/ @' v8 F, @/ {$ oState functionaries and military personnel on  active  service  shall  not& A- B7 Y- a( U6 {# \; n7 `9 s
renounce Chinese nationality.9 f6 ?  I+ J  j9 z  l5 U: z$ F
Article 13, }4 p' I8 E' ]; v$ M, i" ]8 H+ p
Foreign  nationals  who  once  held  Chinese  nationality  may  apply  for/ T% p2 p. g* n1 U: H: P
restoration of Chinese nationality if they have legitimate reasons;  those' c6 ?6 X: G! ^# t9 H( N! D) ?
whose applications  for  restoration  of  Chinese  nationality  have  been
' V2 M6 O$ }# a* d- R# u/ eapproved shall not retain foreign nationality.. ]. o+ g; z2 Y' d) S
Article 141 M0 W0 U9 }) L: ]
Persons who wish to acquire, renounce or restore Chinese nationality, with* I5 p& W, f; V! q4 e
the exception of the cases provided for in Article 9, shall go through the+ d9 n1 j* [9 M( I6 G! r, A2 T
formalities of application.  Applications of persons under the age  of  18, S, p- ]$ w; O( G0 r
may  be  filed  on  their  behalf  by  their  parents   or   other   legal, F) m/ w$ q+ S. H
representatives.8 k' @8 [; m4 ^2 V5 z' f  a
Article 15
/ {# m: G' A1 q6 L8 {Nationality applications at home shall be handled by the  public  security
) s% \) j, x* `; u& v! E* `bureaus of the municipalities or counties where the applicants reside;7 d: m0 r9 j  f$ c! T8 u! ~
nationality applications abroad shall be  handled  by  China''s  diplomatic
6 g/ t* b: ]+ Krepresentative agencies and consular offices.& }$ D! `; N( n) y" A
Article 16% V, d6 b/ Y  f2 t
Applications for naturalization as Chinese nationals and for  renunciation6 C+ B! U, c7 @0 x4 }) s
or restoration of Chinese  nationality  are  subject  to  examination  and
: }  n6 f& L) iapproval by the Ministry of Public Security of the  People''s  Republic  of/ i7 y4 q" ]( k3 L0 f3 }7 D$ S. b7 t
China. The Ministry of Public Security shall issue a  certificate  to  any0 H! V; ^' g8 h- b( Q
person whose application has been approved.
! Q- k* T" A: V0 G( q4 d2 A- qArticle 173 x4 h" @7 d1 r- k' t2 B! G  G! j
The nationality status of  persons  who  have  acquired  or  lost  Chinese
3 }* j9 y5 ]3 z. ^nationality before the promulgation of this Law shall remain valid.% r  q4 ]" x7 l5 q- L( E& g2 H
Article 18
2 G2 C/ I" y3 a3 ]* OThis Law shall come into force on the day of its promulgation.
