第一条   中华人民共和国国籍的取得、丧失和恢复,都适用本法。! i6 s9 T* A' u9 u4 @! j
    第二条   中华人民共和国是统一的多民族的国家,各民族的人都具有中国国籍。
2 O4 W) o; u' p/ y    第三条    中华人民共和国不承认中国公民具有双重国籍。
, O9 H9 k8 @; {    第四条   父母双方或一方为中国公民,本人出生在中国,具有中国国籍。
# ~/ ^# R1 q, n' [1 r5 S* v* j) e    第五条   父母双方或一方为中国公民,本人出生在外国,具有中国国籍;但父母双方或一方为中国公民并定居在外国,本人出生时即具有外国国籍的,不具有中国国籍。
# I6 F# i, c- Q: R' q    第六条   父母无国籍或国籍不明,定居在中国,本人出生在中国,具有中国国籍。
' z: p" q! L6 |. p1 h* l1 k5 U1 j- {% [    第七条   外国人或无国籍人,愿意遵守中国宪法和法律,并具有下列条件之一的,可以经申请批准加入中国国籍:! e1 ]  p! a2 q4 m( w
    一、中国人的近亲属;
  o- W: I; f' k    二、定居在中国的;
  i' F8 K7 E# I2 a# h8 f5 f7 @& R5 v    三、有其它正当理由。
0 f1 h% \! Y1 L% {1 O    第八条   申请加入中国国籍获得批准的,即取得中国国籍;被批准加入中国国籍的,不得再保留外国国籍。; W5 A1 c7 v7 X' X8 a
    第九条    定居外国的中国公民,自愿加入或取得外国国籍的,即自动丧失中国国籍。) @: t$ L4 L4 e: k/ q* M, Y' z
    第十条    中国公民具有下列条件之一的,可以经申请批准退出中国国籍:. |% k6 |- W3 h3 u0 u
    一、外国人的近亲属;! g4 q( z" o% Q& u
    二、定居在外国的;
3 j! x1 S6 N; q    三、有其它正当理由。' ~$ f* c  y9 x9 n0 i" K3 [& ~  i
    第十一条    申请退出中国国籍获得批准的,即丧失中国国籍。, b3 ^, K6 }- }( X+ Q- Z
    第十二条   国家工作人员和现役军人,不得退出中国国籍。
* k) t& H) N+ ]" b+ A    第十三条   曾有过中国国籍的外国人,具有正当理由,可以申请恢复中国国籍;被批准恢复中国国籍的,不得再保留外国国籍。7 L' ]% k) C  k2 P
    第十四条   中国国籍的取得、丧失和恢复,除第九条规定的以外,必须办理申请手续。未满十八周岁的人,可由其父母或其他法定代理人代为办理申请。
* s# {' z1 n" g- f! Z0 S' h& ?0 R    第十五条    受理国籍申请的机关,在国内为当地市、县公安局,在国外为中国外交代表机关和领事机关。
2 t6 Q0 y4 b( |1 J% g. K8 F5 U    第十六条   加入、退出和恢复中国国籍的申请,由中华人民共和国公安部审批。经批准的,由公安部发给证书。, R- ?8 m  X1 O& [: c
    第十七条   本法公布前,已经取得中国国籍的或已经丧失中国国籍的,继续有效。

Committee of the  National  People''s  Congress  on  and  effective  as  of7 D+ Y* C7 O* k$ n( {5 z  I

Article 1( [7 t  G4 _4 P; Q7 X$ v. w0 F
This Law is  applicable  to  the  acquisition,  loss  and  restoration  of. c: X, I, j0 Z( F. \$ V
nationality of the People''s Republic of China.
6 @# {% b& y/ z0 v) }6 M( m/ DArticle 2' m4 A+ s* [- x  ~
The People''s Republic of China is a unitary multinational  state;  persons3 J3 h) I5 N  J' t1 r
belonging to  any  of  the  nationalities  in  China  shall  have  Chinese
) n! l/ A1 w# m$ K/ ~4 gnationality.! f  w* c: Z3 t5 f
Article 3
2 e6 X( T8 `) L5 h7 oThe People''s Republic of China does not recognize dual nationality for any' T( V" A; w6 y+ }6 N. D
Chinese national.

Any person born in China whose parents are both Chinese nationals  or  one5 E) p! l, V! [' I0 _5 t
of whose parents is a Chinese national shall have Chinese nationality.
9 P* l" ^, V0 [1 \% PArticle 5: G% b% K# D: @
Any person born abroad whose parents are both Chinese nationals or one  of2 `, q4 B5 a3 e% o, v$ N
whose parents is a Chinese national shall have Chinese nationality. But  a
% T* v) Z/ H" L2 Y5 u4 G' yperson whose parents are both Chinese  nationals  and  have  both  settled
5 k) p  n" I1 ]$ yabroad, or one of whose parents is a  Chinese  national  and  has  settled4 J/ H! W/ W! \# k
abroad, and who has acquired foreign nationality at birth shall  not  have2 \2 Q" y) }; d/ [" [
Chinese nationality.

9 j& Y% }! I. V) ~; U, VAny person born in China whose  parents  are  stateless  or  of  uncertain7 Q( V( y8 I7 R$ u* W
nationality and have settled in China shall have Chinese nationality.$ m9 \1 e$ y) S! I$ O8 E' ]
Article 7) u' v& K8 _* C/ G3 u% [* H
Foreign nationals or stateless persons who are willing to abide by China''s% o' l6 f, B  z+ T4 {. `! j  H
Constitution and laws and who meet one of the following conditions may  be# ~& t& j/ l3 @  \8 O6 c6 B' v( }9 A
naturalized upon approval of their applications:
$ A. d  H, J, U: i7 w7 e' }; k(1) they are near relatives of Chinese nationals;3 n$ `) z2 q8 Y9 ]  j7 A/ L
(2) they have settled in China; or
6 {% s- _; I% u(3) they have other legitimate reasons.
: |$ ^% ^; ^9 K3 k6 O) |Article 8
3 V- B8 f8 }. N2 s- `, QAny person who applies for naturalization  as  a  Chinese  national  shall. D4 I9 |6 F1 J. |, r- j& P, \- v8 }
acquire Chinese nationality upon approval of  his  application;  a  person
! F* p! a' ~+ g- t$ p6 N) Xwhose application for  naturalization  as  a  Chinese  national  has  been3 _8 f1 H* G7 i2 q$ Q6 {0 x5 r4 F
approved shall not retain foreign nationality.
) T7 b+ K- a- r5 H7 W! pArticle 9- b6 D( K' Z* D$ _, s. I  f; Z, t$ P
Any Chinese national who has settled abroad and who has  been  naturalized# R( i8 X! s+ ]8 m, a. g
as a foreign national or has acquired foreign nationality of his own  free
& r! k7 J7 d+ dwill shall automatically lose Chinese nationality.+ V0 E  Y% o2 v% z. r
Article 10" q" K# d1 {# D3 K' U  W. l7 z
Chinese nationals who meet one of the following  conditions  may  renounce* K" S- C0 B9 E; A) \
Chinese nationality upon approval of their applications:
" A- {; v& \" V(1) they are near relatives of foreign nationals;
( \, l' v1 _$ o, b# H/ s(2) they have settled abroad; or
! @0 l* y" E/ i& {% L(3) they have other legitimate reasons.; j" n5 R( |; x! ~
Article 117 C6 P7 t( x4 t' O$ O( |! i0 t
Any person who applies for renunciation of Chinese nationality shall  lose6 l9 N) ~/ ~- Z" Y2 C- U0 |: @
Chinese nationality upon approval of his application.
( R1 O( K1 [) p" x% EArticle 12
+ k5 \8 x2 f0 C+ `( G: eState functionaries and military personnel on  active  service  shall  not
  |, v* m) Y9 W9 n5 Q" E0 zrenounce Chinese nationality.
! d2 g' @. E0 [* T1 @Article 13( A3 |0 m8 W; P- C) |
Foreign  nationals  who  once  held  Chinese  nationality  may  apply  for
1 [$ _/ k' S/ P  z2 I" }restoration of Chinese nationality if they have legitimate reasons;  those4 U5 ^* p; c' y  B* M9 |3 `2 ?
whose applications  for  restoration  of  Chinese  nationality  have  been# a* g0 A8 |4 L' M8 O8 t* D  E) \! `5 r
approved shall not retain foreign nationality.
" h- s0 ~" e! _9 O$ [Article 14
. ~. I& d! x, M6 B+ fPersons who wish to acquire, renounce or restore Chinese nationality, with
) k6 \% f) f  C8 c% B3 l! _the exception of the cases provided for in Article 9, shall go through the! l: `! b0 U* g  }
formalities of application.  Applications of persons under the age  of  18( B- D9 e1 A( {. f: o  S
may  be  filed  on  their  behalf  by  their  parents   or   other   legal, a# f8 E6 z9 x/ j, ]) a  ?8 ?
representatives." r8 E$ W' L1 f0 R/ U
Article 15
6 Y2 w3 M  R0 a) B- ^Nationality applications at home shall be handled by the  public  security7 p2 |5 |8 P7 |- _
bureaus of the municipalities or counties where the applicants reside;
$ g. J) E7 e2 w! r: r! f( W& l' H5 anationality applications abroad shall be  handled  by  China''s  diplomatic
  S9 r7 _( ~: e$ l7 I5 q) ^representative agencies and consular offices.
1 L9 p; `1 J% X- ]; \- p5 _% _# nArticle 16
1 ]3 _/ I" M0 g; m1 U1 IApplications for naturalization as Chinese nationals and for  renunciation, l( L! k0 _) ^( |2 |& q
or restoration of Chinese  nationality  are  subject  to  examination  and+ i! t( @9 F$ o  K0 B7 r/ E% G
approval by the Ministry of Public Security of the  People''s  Republic  of
, k. a  U# B- Q' }$ {6 KChina. The Ministry of Public Security shall issue a  certificate  to  any
+ N9 z6 F% f2 Dperson whose application has been approved.* j6 S; b7 J* C( x! J
Article 171 ~2 Z" p6 p& ^4 U
The nationality status of  persons  who  have  acquired  or  lost  Chinese0 h4 A8 p1 Q& x* f4 _2 f# i+ t7 b
nationality before the promulgation of this Law shall remain valid.
- s3 N+ k1 n! w( y$ k2 ]9 S4 E' Q/ CArticle 180 Q* ?& B( F, b4 e& U. U
This Law shall come into force on the day of its promulgation.
