5 I+ D/ ]' u8 @, l3 \8 S 第一条 中华人民共和国国籍的取得、丧失和恢复,都适用本法。( r" e$ D8 e$ q" @5 z; O X; t
第二条 中华人民共和国是统一的多民族的国家,各民族的人都具有中国国籍。7 E! N$ c2 y+ E H5 [; D/ A" R( @
第三条 中华人民共和国不承认中国公民具有双重国籍。
* d; p" ?( E: q 第四条 父母双方或一方为中国公民,本人出生在中国,具有中国国籍。
1 F$ R8 H/ f( k3 l 第五条 父母双方或一方为中国公民,本人出生在外国,具有中国国籍;但父母双方或一方为中国公民并定居在外国,本人出生时即具有外国国籍的,不具有中国国籍。
6 t! }0 y6 e R' k" F3 P$ Y 第六条 父母无国籍或国籍不明,定居在中国,本人出生在中国,具有中国国籍。- C3 Z6 M8 c1 ]7 G
第七条 外国人或无国籍人,愿意遵守中国宪法和法律,并具有下列条件之一的,可以经申请批准加入中国国籍:( i2 p* U& _6 p. Y; c6 X2 N
一、中国人的近亲属;

第八条 申请加入中国国籍获得批准的,即取得中国国籍;被批准加入中国国籍的,不得再保留外国国籍。
4 j4 j- f$ g& y' ~ 第九条 定居外国的中国公民,自愿加入或取得外国国籍的,即自动丧失中国国籍。
" N7 @0 R$ Y7 w5 b3 B 第十条 中国公民具有下列条件之一的,可以经申请批准退出中国国籍:
# T2 o, q+ i7 ~* [/ A2 o1 T3 ~ m 一、外国人的近亲属;5 L6 D3 r' I8 |% ]# ?' O
二、定居在外国的;/ |. u+ l, |8 `9 u/ n( }
三、有其它正当理由。1 u( z5 t( R5 U6 R3 Q
第十一条 申请退出中国国籍获得批准的,即丧失中国国籍。
; b# _" j, w% t3 V9 |4 K 第十二条 国家工作人员和现役军人,不得退出中国国籍。4 H6 g5 c {( P7 C% w' ?- s. v2 K
第十三条 曾有过中国国籍的外国人,具有正当理由,可以申请恢复中国国籍;被批准恢复中国国籍的,不得再保留外国国籍。
) ?. x' M7 B8 V2 ]! d7 z7 | 第十四条 中国国籍的取得、丧失和恢复,除第九条规定的以外,必须办理申请手续。未满十八周岁的人,可由其父母或其他法定代理人代为办理申请。0 P- e! [# U. C2 N2 B' R% Z) @
第十五条 受理国籍申请的机关,在国内为当地市、县公安局,在国外为中国外交代表机关和领事机关。
0 F5 l: [3 }: }4 B7 M' \$ G @% E 第十六条 加入、退出和恢复中国国籍的申请,由中华人民共和国公安部审批。经批准的,由公安部发给证书。' J- n+ H: s; r, g2 A+ {4 H9 v
第十七条 本法公布前,已经取得中国国籍的或已经丧失中国国籍的,继续有效。

9 Q+ q- @$ E3 x9 wThe People''s Republic of China is a unitary multinational state; persons

The People''s Republic of China does not recognize dual nationality for any

Any person born in China whose parents are both Chinese nationals or one
9 \6 R/ }* k& N' D ~1 ~7 \& pof whose parents is a Chinese national shall have Chinese nationality.

Any person born abroad whose parents are both Chinese nationals or one of8 Z0 D9 t* _; M
whose parents is a Chinese national shall have Chinese nationality. But a
% z3 P" J- w- `person whose parents are both Chinese nationals and have both settled/ g- a4 J! W. c) d9 ]
abroad, or one of whose parents is a Chinese national and has settled
$ E2 e5 S" m% ^1 `) Pabroad, and who has acquired foreign nationality at birth shall not have

Any person born in China whose parents are stateless or of uncertain9 C- K+ X+ n2 Q1 a! Q( i% `
nationality and have settled in China shall have Chinese nationality.: ^% L, {8 l8 A! J, `
Article 7$ f6 l7 o; `; j8 a
Foreign nationals or stateless persons who are willing to abide by China''s) X( Z2 t( t- J/ {
Constitution and laws and who meet one of the following conditions may be
% f$ C: T7 k' h# p8 dnaturalized upon approval of their applications:
+ F# F- a3 i8 T8 c( E( P(1) they are near relatives of Chinese nationals;% s \& Z4 @; i- X
(2) they have settled in China; or. F) x5 i3 `7 r) `0 ~/ s
(3) they have other legitimate reasons.& C3 B+ m$ S, T& _4 }% e2 m
Article 8# Q- k5 B* h& C3 J* r9 H5 d
Any person who applies for naturalization as a Chinese national shall
* x+ {$ Y4 A7 P V/ @4 cacquire Chinese nationality upon approval of his application; a person) p6 ~0 a6 e9 V6 U
whose application for naturalization as a Chinese national has been C1 m3 A" |* ~! \' w
approved shall not retain foreign nationality.8 H d& o6 @+ ?; f1 T# I2 E3 s
Article 98 z! b, U1 v, c, G9 D1 Z# v) `; J4 e
Any Chinese national who has settled abroad and who has been naturalized
( B E4 z7 y/ u! u4 }: _) Sas a foreign national or has acquired foreign nationality of his own free
. w' \! r# n- b( Z4 {) l8 F8 Qwill shall automatically lose Chinese nationality.: f* s& d& S7 U& q, O/ y8 M
Article 10 y5 W5 {% q1 I' S( Y/ m
Chinese nationals who meet one of the following conditions may renounce( b1 M" P5 l% ]- b( c/ m
Chinese nationality upon approval of their applications:
* H+ F: [( M/ l3 p(1) they are near relatives of foreign nationals;
+ X) [5 e) C7 P(2) they have settled abroad; or
4 p# V5 X; u& Q. @1 b% o# w(3) they have other legitimate reasons.% w% m. W: T1 X+ P: ~3 P' u
Article 11
. ~3 P" M! h1 ` |/ C3 UAny person who applies for renunciation of Chinese nationality shall lose9 G1 T3 Z7 `( k& m P" T0 W, T6 Y# J
Chinese nationality upon approval of his application.
$ ^3 p0 E% }5 s8 y& D" qArticle 12( R0 Y( n3 @/ q
State functionaries and military personnel on active service shall not7 T6 J! f8 o. O
renounce Chinese nationality.
3 W, k/ `3 u+ [0 Q- h% k EArticle 135 O# a8 m% e2 ~8 d
Foreign nationals who once held Chinese nationality may apply for% Q2 d m: `$ G9 M
restoration of Chinese nationality if they have legitimate reasons; those
7 V1 C! ^4 F4 Y1 X* ywhose applications for restoration of Chinese nationality have been
* }" w F" q0 n, ?' X6 sapproved shall not retain foreign nationality.
; n0 ?( H5 P1 _- \9 hArticle 14, S% A# N8 F& S, C& M ^0 @+ t
Persons who wish to acquire, renounce or restore Chinese nationality, with) M, f, z4 L, A3 G3 h$ ^8 b9 _
the exception of the cases provided for in Article 9, shall go through the
' [1 z0 p: z' G$ s/ C; M7 C* qformalities of application. Applications of persons under the age of 18 `! U2 D: e2 v4 u8 X& t9 b
may be filed on their behalf by their parents or other legal
# H: N9 H9 R" h# ^representatives.4 U* ?, m0 P1 A+ R; s$ s# T7 Q
Article 15- W) A7 B; N, J4 m5 [! j
Nationality applications at home shall be handled by the public security3 u! d' Z0 v0 O' ]) \
bureaus of the municipalities or counties where the applicants reside;: |% V" Q5 f" l* ^
nationality applications abroad shall be handled by China''s diplomatic% ]) x( D4 t3 _ U4 c
representative agencies and consular offices.2 {. U5 _ I* w# w3 n
Article 16
- z5 p+ L0 S$ u q9 \1 M8 sApplications for naturalization as Chinese nationals and for renunciation
; e: w$ f% B% v2 J9 sor restoration of Chinese nationality are subject to examination and
8 ~: q2 a, X3 B) j P1 M. h6 lapproval by the Ministry of Public Security of the People''s Republic of3 n) A2 i9 u( \& o
China. The Ministry of Public Security shall issue a certificate to any
$ Q; O2 v& w% q" ^! p! a9 Kperson whose application has been approved.% V6 \! W/ Y; V5 z
Article 17+ o* Y" k3 X( G. g6 b5 v
The nationality status of persons who have acquired or lost Chinese
8 @3 k: T; I8 l' Onationality before the promulgation of this Law shall remain valid.

This Law shall come into force on the day of its promulgation. |
